RESOLUTION NO. 80-105
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA OVERRULING THE ZONING
ADMINISTRATOR'S DENIAL OF MINOR EXCEPTION
APPLICATION 80-15, GRANTING APPEAL NO. 416,
AND APPROVING MINOR EXCEPTION NO. 80-15.
WHEREAS, a public hearing was duly held before the
City Council on June 2, 1980, on the action taken by the
Zoning Administrator in denying Minor Exception Application
No. 80-15, which application seeks to allow expansion of a
mini-market with sale of beer and wine for off-site
consumption in an existing service station at 302 West First
Street in the C2 District;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Santa Ana as follows:
1. That based on such public hearing and the oral
and documentary evidence submitted therein, the City
Council does hereby reverse the action of the Zoning
Administrator, grant Appeal No. 416, and approve Minor
Exception No. 80-15.
2. That the City Council adopts as its findings
of fact and conditions of approval for the approval of the
said Minor Exception that certain report entitled "Finding
of Fact, Minor Exception 80-15," submitted by the Zoning
Administrator and on file in the office of the Clerk of the
Council with the exception that "Reason for Decision" (a)
therein is amended to read as follows:
"The proposed expansion of the subject
mini-market is desirable as contributing
to the general well-being of the neighborhood;"
and "Reason for Decision" (b) therein is amended to read as
follows:
"The expansion of the subject mini-market as
proposed will not create any additional
detrimental effect on persons or property
in the vicinity beyond that which now exists."
