seconded by Heinly amd carried.

This being the date set for hearing on the annexation of property consisting of
approximately 81 acres bounded on the west by Tustin Avenue and on the south by
Seventeenth Street, designated as "Tustin and Seventeenth Street N. E. Annex~';

the annexation of their properties to the City of Santa Aha. The Clerk read her
report giving the result that the area has a total assessed land valuation of
$250,560.00; the total assessed value of the land represented by the protestants,
whose protests were filed, was found to be $183,430.OO, and from these figures
more than 73.2% of the property owners have protested against the annexation. It
was moved by Councilman Heinly, seconded by Gould and carried, that the City Council
finds there is more than a majority protest in this annexation, and there will be

he owns seven acres on the east side of Tustin Avenue, north of 17th Street II
and personally wanted to see this annexation processed, but said more detailed
information would have to be given the property owners as to sewer lines and other
improvements.
This being the date set for hearing on Amendment Application No. 294, initiated by
the Planning Commission, amending Sectional District Map 15-5-10, Exhibit B, to
reclassify frcm the R-1 District to the A-l, R-2 and C-2-PK Districts, properties
within the area bounded by Harbor Boulevard, Bolsa-First Street, Sullivan Street,
and the easterly extension of Smeltzer Avenue; no protests were received, and the ~i
hearing was closed. On motion of Councilman Gould, seconded ~y Hubbard and car-
ried, the following Ordinance entitled:
"O~dinance mnending Article IX of the Santa Ana Municipal Code
to change district classification on Amendment Application No.
294 and amending Sectional District Map 15-5-10, ~xhibit B"
was introduced, considered and placed on file for second reading.
This being the date set for hearing to establish future right-of-way lines c~
sides of Harbor Boulevard, between proposed Garden Grove Freeway and proposed San
Diego Freeway, measured 60 feet from and at right angles to the survey center line;i
on both sides of Verano Street, between proposed Garden Grove Freeway and Slater
Avenue, measured 52 feet from and at right angles to the survey center line; and ii
on both sides of Seventeenth Street - Westminster Avenue, between King and Verano
Streets, measured 52 feet from and at right angles to the survey center line, the
Mayor declared the hearing will be held on the establishing of future right-of-way~
lines oh both sides of Harbor Boulevard, between proposed Garden Grove Freeway and
proposed San Diego Freeway, measured 60 feet fr~m and at right angles to the surve~i
center line. Q~estionswere asked by L. D. DeVol, 313 So. Harbor Boulevard; Ray
Cowley, 1909 Federal Avenue, Costa Mesa, and Evelyn Wyle, 15742 Harbor Boulevard.
Their questions were satisfactorily answered by Councilman HeirAy and the hearing
was declared closed. The Mayor declared the hearing will be held on the establish-
ing of future right-of-way lines on both sides of Verano Street, between proposed
Garden Grove Freeway and Slater Avenue, measured 52 feet from and at right angles
to the survey center line; and on both sides of Seventeenth Street - Westminster
Avenue, between King and Verano Streets, measured 52 feet frcm and at right angles
to the survey center line. Mrs. Florence Hendricker, 11272 Westminster Boulevard
requested info~mation as to when tb~ City will acquire the property, and her ques-
tions were satisfactorily answered by the Manager. No oth~ protests were receive~
and the hearing was declared closed. On motion of Councilman Heinly, seconded by
Hubbard and carried, the following Ordinance entitled:
"Ordinance establishing future right-of-way lines along Harbor Boulevard
and Verano and Seventeenth Streets"
was introduced, considered m~d placed on file for second reading.
The Mayor announced this is the time and place for hearing protests ~r o~Jections
against the assessment l~vied for the improvement of T~,~r Street and other stree~,
in Assessment District No. 202, and as~d the Clerk if she was in possession of the
Affidavit of Publication~ Affidavit of Posting, and Affidavit of Mailing. The Cle~
stated she had the affidavits, and on motion of Councilman B~ewer, seconded by
Heinly and carried, the affidavits were received amd filed. The Msgor asked the
Clerk if she had recaived~an~ written protests or 'obJections against the assessment~
or against the fmprovement as constructed~ or against the proceedings. The Clerk

Mrs. Sanfcrd Poore, 1148 So. Lowell Street. On motic~ of Councilman Hubbard, secon
ded by Heinly and carried, the prote~ts were received and filed. The Mayor asked
if argrone in the audience wished to protest; Mr. Barney Lewis inquired how the rate
was determined for the square foot of pavement work done on his property, and the
question was satisfactorily answered by the Director of Public Works. Mr. Ponfilo
Madrigal, 1218 W. Oubbon, questioned the statement he received for the pavement wor
on his property, an&his questions were also answered by the Director of Public
Works. On motion of Councilman Heinly, seconded by Hubbard and carried, the hear-
ing was declared closed. The Council having unanimously waived the reading of the
Resolution, on motion of Councilman Heinly, seconded by Hubbard and carried, the
following Resolution entitled:
"Resolution No. 59-280 of the City Council of the City of Santa Arm
confirming the assessment for the improvement of Towner Street and
other streets"

Councilman Heinly presented Chief of Police Allen with a plaque, stating that for
many years the City of Santa Ana has attempted to be one of the best and safest
cities, and from July 1, 1958 to June 30, 1959, the Two-Wheeled Motorcycle-
Police Division of the Police Department had won the National Fleet Safety Contest
presented by the National Safety Council and the International Association of Chief~
of Police. Chief Allen accepted the award with his appreciation and on behalf of
his men.
Chief of Police Allen presented Patrolmen Loran A. N~rton and Kenneth E. Day, stat-~
ing t~ey had been promoted, after two years of service, from the rank of Patrolmam
to Sergeant~ and asked that the Oath of Office be administered to them. The Clerk!!

Communication was read from the Planning~ Cormnission recormnending approval of Var-
iance Application No. 1193, filed by Ramon E. Hetzner· of an addition, already
constructed, to his single-family dwelling, leaving only eleven feet of rear yard

Street in R-1 District. Clarence Hall, 12351 Westminster Avenue· on behalf o£ the

Communication was read frcm the Planning Commission recommending approval of Var-
iance Application No. 1194, filed by William E. and Grace W. Hernon, to erect a
14-unit apartment building on property situated at 11921 Hazard Street in R-1 Dis-
trict, subject to conditions and in accordance with plot plan. Joe P. King, lllgl

moved by Councilman Hubbard that Variance Application No. 1194 be granted subject

a neighborhood shopping center on property situated at the southeast c~rner of
Berrydale and Trask Avenue in R-1 District, subject to conditions. Webb Brown,
representing the applicant, stated that the parking ratio of 3 to 1 imposed in the
conditions of the Variance would take up a considerable portion of the property for
parking~ and they now have 47 parking stalls for the proposed small secondary
~hopping center. The Council having unanimously waived the reading of the Resolu-Ii ~

conditions.

On motion of Councilman Gould, secmded by Hubbard and carried, the recommendation
of the Planning Commission was approved, and Variance Application No. 1202, filed
by Savage Construction Ccmpany, to decrease the required front yard from 60 feet
from center line to 50 feet from center line on Tract 2033, on property situated
at the southwest corner of Bolsa Avenue and Verano Street in R-1 District~ was granted
subject to a condition of the Department of Public Works.

of the Planning Commissi on was approved, and Variance Application No. 1198, filed
by L. Cordova, to move a single-family dwelling onto this lot with an existing
single-family dwelling on property situated at 304 Central Avenue, in R-1 District,?
was granted, subject to conditions.

single-family homes, and on motion of CounciLman Brewer, secunded by Gould and

territory described as an irregular-shaped parcel of land located generally in the
vicinity of the intersection of Paularino and Newport Avenues, and a strip extend-
ing northeasterly along the west side of Newport Avenue to the intersection of
Main Street and Sunflower Avenue, designated as "Newport and Paularino N.W. Annex.'

On motion of Councilman Hubbard, seconded by Heinly and carried, the recon~endatio
of the Planning Commission was approved, and a ninety-day extension of time was

to permit the construction of an office building for a regional operational and
administrative office for the Farmers Insurance Group, on the interior area of
property situated on the east side of Flower Street, between Memory Lane and the
Santa Aha Freeway, subject to conditions.
Communication was read fron the Planning Commission recommending denial of request
for a ninety-da~ extension of time on Variance Application No. 1102, filed by
Laurence Lewis and granted on May 4, 1959, to permit parkinE and sa]~ of new and
used cars and for parkin~ for customers, in connection with automobile business on
adjacent property on Main Street; and also permit use of the property, temporarily:

Communication was again read from the Planning De~m~tm&~ recommending denial of
Preliminary Record of Survey, filed by Jim McHenry, creating one lot to the rear of
two lots owned by Mells Trusty and Frances Davis, respectively, located at the nort~-
west corner of Cypress Avenue and Hobart Street. Larry Golden, Surveyor, represent~
lng the applicant, stated that the adjacent lot is a small one, about 55 feet deep.
On motion of Councilman Hubbard, seconded by Heinty and carried, action was de-
ferred until the next m~eting, and the City Attorney instructed to submit a legal
opinion on this matter.
Communication was again read from the Planning De~a~tme~ recommending approval of
Preliminary Record of Survey, filed by Ed Hall, creating three parcels loeated gen-
erally south of Edinger Street extension and west of Standard Avenue north of the
extension of Occidental Street, subject to couditions. Mr. Ed Hall stated he had
made several attempts to comply with the Ordinance dealing with the sale of four
or less parcels and is agreeable to all of the conditions, provided he has the
cooperation of the other owners; that he has 4-1/2 acres on Standard Avenue and is
willing to deed to the City sixty feet for the extension of Occidental Street.
Mr. Hall explained that he sold to Messrs. Earl and Barker property on ths east
side of Cedar Street, 320 feet long and 1Ofeet on alley way, and does not feel he
shou~d be required to improve property he no longer owns. Councilman Heinly dis-
qualified himself on this matter. Councilman Heinly ~eft the meeting at 10:45 P.N.

On motion of Councilman Hubbard, secomledby Gould and carried, proper officials
were authorized to execute extension of lease with the American National Red Cross,
Southern Orange County Chapter, for a period of thirty months, as provided under th~
option terms of the current lease which expires October 31, 1959, to occupy certain i
quarters at 1104 W. 8th Street.
On motion of Councilman Gould, seconded by Hubbard and carried, the application of
Jack Fisher Chapter 23, Disabled American Veterans, for permission to solicit funds
and sell Forget-me-not blossoms on November 6th and 7th, 1 959, was granted.
Communication was read from the Sully-Miller Contracting Co~pany, requesting post-
ponement of starting date on their contract for Project C-39 (widening of Eighth

with reference to request of Mrs. Morton J. Levand, Corresponding Secretary, John
Adams School P.T.A., and the m~tter was taken off the calendar.

The Manager orally reported that an investigation had been made with reference to
the petition signed by approximately 49 persons, requesting that the apartment hous,
at 425 South Birch Street, owned by George Lum, be placed under proper supervision
as to number of tenants allowed to live therein~ or be declared a public nuisance
andlicense rescinded; and the Manager stated the owner has agreed to conform to the
requirements of the Building Department and the Public Health Dep~rtm~nt. On motio~
of: Councilman Heinly, seconded by Hubbard and carried, the Manager was directed to
notify the affected persons of action taken, and the matter was removed from the
calendar.
The Manager orally reported that a crossing guard had been stationed at Rene Driv~ ~:
and Delhi Road, and acrosswalk has been established on Greenville Street, for-the
Safety of school child~en attending the John Adams School. On motion of Council'm~i
Heinly, seconded by Hubbard and carried, the communication was received and filed.~
The Council having unanimously waived the reading of the Resolution, on motion of:

Communication was read from the Department of Puhlic Works regarding request of
Gilbert and Stearns, Inc. for additional
/extension of time for the completion of the revised electrical services for the
Library, and recommending approval of the completion date for this construction as
of November 22, 1959. On motion of Councilman Hubbard, secca~dedby Brewer and
carried, approval was ~ranted to Gilbert and Stearns, Inc. ~or an extension of time
to Novemher~2R, 1959.
On recommendation of the Department of Public Norks, and on motion of Councilman
Hubbard, seconded by Gould and carried, permission was granted to Fred C. Piepen-
brink to drill a 6" domestic water well on property located 150 feet west of the
center line ~ Harbor Boulevard and 335 feet north of the center line of Sugar Stre~.
On motion of CounciLman Hubbard, seconded by Gould and carried, the San Salvador
newspapers "El Diariode Hoy" and ,,La Prensa Grafica", dated March 14, 1959, sent
