HomeMy WebLinkAbout80-177RESOLUTION NO. 80-177 RESOLUTION OF THE CITY COUNCIL CONFIRMING THE ASSESSMENT PURSUANT TO "IMPROVEMENT ACT OF 1911", BEING DIVISION 7 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. CITY OF SANTA ANA WHEREAS, there has been filed with the Clerk of the Council an assessment to represent the costs and expenses of the work and improvements done pursuant to proceedings had and taken under the provisions of the "Improvement Act of 1911", being Division 7 of the Streets and Highways Code of the State of California, and pursuant to Resolution of Intention No. 79-109 , all within the boundaries of a special asse'ssment district known and designated as ASSESSMENT DISTRICT NO. 243 (hereinafter referred to as the "Assessment District"); and, WHEREAS, the Clerk of the Council has duly given notice in the manner provided by law of the filing of said assessment and of the time set for hearing; and, WHEREAS, said Clerk of the Council is now satisfied as to the proper completion of the work and of the spreading of the assessment. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA CALIFORNIA, AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That the assessment and diagram, the proceedings leading up to the same, and all acts and determin- ations of the officers and agents of said City in relation to the work done and appurtenances and appurtenant work in said Assessment District and to the said assessment, and the diagram attached thereto, be, and the same are, hereby ratified and confirmed, the work and improvement is accepted, and the Superintendent of Streets is hereby ordered and directed to attach to said assessment a warrant in the manner and form pro- vided by law, said warrant bearing date of this Resolution, and is further ordered to deliver said warrant, diagram and assessment to the Contractor, or its assignee, as the case may be, forthwith upon payment of the incidental expenses due thereon. SECTION 3. That the assessment roll, warrant and diagram shall be recorded in the Office of the Superintendent of Streets and immediately thereafter the Clerk of the Council shall file a copy of the assessment diagram in the Office of the County Recorder, and RESOLUTION NO. 80-177 PAGE TWO thereafter shall record in said Office of the County Recorder a Notice of Assessment, all in the manner and form as prescribed by Section 3114 of the Streets and Highways Code of the State of California. SECTION 4. Pursuant to Section 5012 of the Streets and Highways Code of the State of California, Robert E. Eichblatt is hereby appointed as acting Superintendent of Streets, and he shall perform all the duties imposed upon the Superintendent of Streets as stated in Division 7 of the Streets and Highways Code ("Improve- ment Act of 1911"), and specifically as the statute authorizes the signature and recordation of the assessment warrant by said Superintendent of Streets.
