Hubbard, Stsnley C. Gould, Jr., Dale H. Heind,V, Bob Brewer, A. A. Hall Absent: Councilmen None The Pledge of Allegiaucewas given. Invocation was given by Reverend Byron Mayfield of the First Christian Church. i Each member of the City Council having received copies of the Minutes of December 7 and December 14~ 1959~ reading of th e Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Hefnly and carried. Davids-,Motors was accepted at the unit price and at the total amount of $5,519.23. A tabulation of bids was presented for the improvement of McClay Street, between McFadden Street and Chestnut Avenue, Project No. 115; and the improvement of Chest- nut Avenue, between McClay and Lyon Streets, Project C-41, as follows: Total Bond Griffith Company $57,775.50 $6,000. Noble Company 62, 311.50 10% On motion of Councilm-n Gould, seconded by Hubbard and carried, the low bid of Sully-Miller Contracting Company was accepted at the unit prices and in the total Hearing Amend. Appl. No. 300 'initiated by Plann. Comm. Ordinance amount of $53,104.50, and all other bids were rejected. This being the date set for hearing on Amendment Application No. 300, initiated by the pl,nnlng C~mmission, amending Sectional District Map 13-5-10, as shown o~ Ex- hibit B, to reclassify from the R-3 District to the P-PK District properties front- ing on Broadway and Sycamore Street, between Walnut and Bishop Streets; no protests were received, and the hearing was closed. On motion of Councilman Gould, seconded by Brewer end carried, the following Ordinance entitled: "Ordinance amending Article IX of the Ssnta Aha Municipal Code to change distrist classification on Amendment Application No. BOO and to amend Sectional District Msp 13-5-10" Hearing Establish future right-of-way lines along Willit s-Bishop St.,Delhi Road and Chestnut Avenue Ordinance was introduced, considered and placed c~ file for second reading. This being the date set for the continued hearing to establish future right-of-way lines on both sides of Willits-Bishop Street, between proposed Fairview Street and Standard Avenue, measured 42 feet from and at right angles to the survey center line, George W. Allison, 602 So. Ross Street, presented petitions containing approximately 100 names of persons protesting the widening of the street, and on motion of Court- cilman Gould, seconded by Hubbard and carried, the petitions were received and filed. Mr. Allison stated this setback is pr,mature, would cause a hardship on the property owners, and devaluate their properties. Attorney Robert F. Waldron, of the firm of Linnell & Waldron, Attorneys, 817 No. Broadway, stated his firm had been retained by the Willits-Bishop Street Property Owners' Association, in regard to the proposed establishment of future right-of-way lines on both sides of Willits- Bishop Street, and the principal objection was that it would injure and depreciate the property values of those persons who own property on these two streets, due Hearing Establish future right-of-way lines Santa Clara Ave. Ordinance largely to the uncertainty as to when these streets will be widened and their actual! width. The mere declaration of the future right-of-way lines depreciates property and causes a blight. If there is a blight of an area and m~uy years later there is a condemnation action to acquire the property for public use, the property owner must take the market value at that time. Miles Sharon, 50531 So. Rosewood Avenue, protested such action would lessen the value of his property and any improvement thereon would be an economic loss. Rev. Francis Parker, 12~8 W. Bishop Street, said their residence houses seven clergymen, their ownership is under the Archdio- cese of Los Angeles, end Msgr. B~adley of their Chancery office, StrOngly tn-tructed: him to request the right-of-wa~ not be established on Willits-Bishop Street. He stated that if Bishop Street became a four-lane street, the noise of the traffic would create a nuisance, and respectfully requested that action be postponed. Mrs. C. W. Couden~ ~10 W. Bishop Street, suggested that Bishop Street be made a one- way street, if the traffic requires it, instead of the proposed widening. Attorney Frank Linnell recounted the unfairness of the project, the d~m~ge to the property owners, invasion of person's property rights, the fact that the owners would not be able to use the property as they desired to, and did net believe, at this time, there was any reason or necessity for such a change on Willits-Bishop Street. Statements of objection were also rendered by Carl Riner, 1302 Willits Street, Gordon Williams, 64b E. Bishop Street, Mayde Rawling, 112 E. Bishop Street, Rev. H. R. Milnor, 505 E. B~shop Street, Harry 01son, 501 E. Bishop Street and Ruth Borchard, 2329 Santiago Avenue. The Mayor declared the heariug closed. On motion of Councilman Gould, by Hubbard and carried, the following Ordinance entitled: seconded "Ordinance establishing future right-of-way lines along Willits and Bishop Street, Delhi Road and Chestnut Avenue" was introduced, considered and placed on file for second reading. Councilmau Heinly stated he had listened to Attorneys and residents and wondered where our City would be a few years from now if we set back and every time we did a little planning for the future of this great City, that the residents would get up and say "not now - later." The big question is when is the time and what are our obligations to our c~mm~nity. I feel an obligation as a member of this Council to answer some of these questions. Under the law there are various sections which provide for future plan- ning and master plans of streets and highways. Recognizing the problem that you have to plan ahead to have future right-of-way setbacks, I believe this is in the best interest of the City. With the permission of the Chair, Miles Sharon stated that he was willing to give a portion of h~ s property to the City upon proper reim- bursement. Paul Walter, ~02 E. Bishop Street, questioned the survey center line and received a satisfactory answer from the Manager. The Mayor declared the Ordinance has been passed to second reading. This being the date set for hearing to establish future right-of-way lines on the north side of Santa Clara Avenue, between Broadway and Main Street, 50 feet measured from and at right angles to the survey centerline; on the south side of Santa Clara Avenue, between Broadway and Main Street, 30 feet measured from and at right angles to the survey center line; end on both sides of Santa Clara Avenue, betweeu Grand Avenue and. east City Limits, 42 feet measured from and at right angles to the survey center line; no protests were received, and the hearing was closed. This being the date set for he,ring to establish the precise alignment of the 'westerly extension of Willits-B~shop Street, between Suliivau and proposed Fairview Street, as shown on Precise Plan SHll0, Exhibit l, as recommended by the Wlanning Commission, no protests were received and the hearing was declared closed. The Council having unanimously waived the reading of the Resolution, on motion of Councilmen Hubbard, seconded by Heinly and carried, the following Resolution entitled: "Resolution No. 59-B16 sdol~ting precise al~gr~ent of westerly extension of Willits~BiShop Street~ Sullivan to Proposed Fairv~ew~ was considered and passed by the following vote~ Ayes, Councilmen Royal E. Hall Noes, Councilmen None Absent, Councilmen None On motion of Councilman Heinly, seconded by Gould and carried, Amendment Application No. ~86, in~tiated by the Planning Commission, was taken from the table, involving the reclassification from the R-1 District to the C-1-PK District of property situa- ted at the southeast corner of the intersection of Fairview Street and Delhi Road (size of the property is approximately 780 feet by 780 feet). On motion of Council- man Hubbard, seconded by Brewer and carried, the date of hearing on ~mendment Appli- cation No. 286 was reset on January 18, 1960. Co~-,uication was read from the Planning Commissiou rec~endiug approval of Variance Application No. 1220, filed by I. H. and Hart Pennington, Evadua and C. Perry, and Jack Rimel, Attorney-in-fact for Violet Holt, on property at 201-05-05½ South Broad- way and 212-214 West Walnut Street, in R-3 District, to permit use of the property for customer and employee parking only, subject to conditions. The applicant re- quested the use of the property for the storage of new automobiles. Mr. L. G. Cone, 211-213 South Broadway, inquired if ingress and egress had been located to this property as set out in the application, and if such an entrance, or exit, is placed on the south side of his property, it would create a traffic hazard on this eight- foot common driveway. It was moved by Councilman Hubbard that action be postponed until the next meeting. Motion lost for lack of a second. Marty Lockney, 120 South Sycamore Street, stated many restrictions have been imposed on this property and the original application asks for the storage of new cars. Mr. Lockney said he has made a substantial monetary improvement on this facility for the specific purpose of storing new automobiles and protested the condition of erecting a concrete block wall along the west property line as a chain link fence is located on the easterly and northerly boundary. It was moved by Councilman Gould that a Resolution be adopted overruling the Planning Commission, and that the Variance be granted subJe~t to conditions l, 2, 3, 5, 6, 7, 8, 9, 10, ll and 19, and that condition 4 be modified that no new or used cars shall be stored on such property for the purpose of sale from said lot, and that no sign larger than 12 sq,~-we feet identifying the business, but excluding commercial advertising, be placed en the property. Motion lost for lack of a second. Mr. Lockney stated they have a new car facility for 160 vehicles but do n~ have facilities for repairs and there will be cases where cars must be readied for display purposes. The reading of the Resolution having been waived, it was moved by Councilm-u Gould, seconded by Brewer and carried, that an amendment to Variance Appl .No .1221 Marvin C. Trochmau, to erect two single-family dwellings on a lot with three existing single-family dwellings, on property at 352~ W. Washington Avenue and 1121 Bewley Street, in the R-1 District (Proposed R-2 District) was approved, subject to conditions, and in accordance with plot plan. Co~ication was read from the Pl-nning Co~mission reco~,ending approval of Variance Application No. 1222, filed by John H. and Dorothy P. Burgess, to erect an addition to front of existing house, to be used as a beauty shop for two operators, on property situated at 1117 South Bristol Street, in the R-1 District. Mrs. Burgess inquired whether the right-of-way had been established on Bristol Street, as she had already given ten feet of her property to the City and needed the extra five feet that would be taken up in the future widening of Bristol Street, and also objected to the condition imposed concerning landscaping. The Council having uneni- mously waived the reading of the Resolution, on motion of Councilman Heinly, seconded by Hubl~ard and carried, the following Resolution entitled: "Resolution No. 59-318 grantfng Variance on Appl~catfon No. 1222 filed by John H. and Dorothy P.BU~gess where recommended conditions were modified" was considered and passed by the following vote: Ayes, Councilmen Royal E. On motion of Councilman Hubbard, seconded by Brewer and carried, action was continued until January 4, 1960, on Variance Application No. 1223, filed by the Bank of America National Trust & Savings Association, to erect an office building to be used by a social service staff, on property at 1612 Spurgeon Street, in the R-3 District, subject to conditions. On motion of Councilman Hubbard, seconded by Heinly and carried, the recommendation of the Planning Commission was approved and Variance Application No. 1224, filed by R. M. Anderson, to erect an additional single-family dwelling, on property at 3411 West Camile Street, in the R-2 District, was granted, subject to conditions. On motion of Councilman Eubbard, seconded by Brewer and carried, the recommendation of the Planning Commissdon was approved and Variance Application No. 1226, filed by Westgate California Corporation, to remodel existing building without setback to the ultimate right-of-way line, on property at 708 North M~n Street, in C-2 District, was granted, subject to conditions. No. ] 226 On motion of Councilman Hubbard, seconded by Heinly and carried, proper officials were authorized to execute agreement, ds~ed December 21, 1959, with the Westgate- California Corporation, which was mandatory as a portion of conditions for the granting of Variance Application No. 1226, to remodel existing building without Variance Appl.No.1228 D. and L. Homes, Inc. setback to the ultimate right-of-way llne, on property at 708 North Nain Street. On motion of Councilman Hubbard, seconded by Brewer and carried, the recommendation of the Planning Cc~mission was approved snd Variance Application No. 1228, filed by D. and L. Homes, Inc., to use existing temporary double-face sign, l0 x 20 feet in size~ with a cut-out, to advertise and direct traffic into Tract 2762, for a period of six months, on property at the southeast corner of Memory Lane and Townley Variance Appl.No. 1229 D. and L. Homes, Inc. Street, in the R-1 District, was granted, subject to conditions.
