RESOLUTION NO. 80- 205
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA AUTHORIZING REPAIR OF THE FIFTH
STREET BRIDGE AS AN URGENCY PROJECT WITHOUT
ADVERTISEMENT FOR BIDS, AND STATING THE FACTS
CONSITUTING SUCH URGENCY
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SANTA ANA AS FOLLOWS:
1. That the City Council finds and determines
that the repair of the Fifth Street Bridge over the Santa
Ana River is of urgent necessity for the preservation of
life, health, and property, for the following reasons:
a. The repair of the said bridge must commence
immediately in order that the repair work force can
complete work in the river channel prior to the begin-
ning of the rainy season;
b. In the event that repair work on the bridge
is interrupted by winter rains, the bridge could not be
opened until the spring of 1981;
c. Winter rains may cause further damage to the
bridge, requiring more expensive repairs than are now
necessary;
d. The Federal Highway Administration, on
November 10, 1980, authorized federal funding of the
bridge repair work on an emergency basis, thus removing
federal requirements for formal bid advertisement
procedures.
2. That, based on the facts hereinabove set
forth, the City Council does hereby authorize the letting of
a contract for the repair of the Fifth Street bridge across
the Santa Ana River without advertising for bids.
