A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA AHA
ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 18
WHEREAS, by Minute Order dated November 3, 1980, a public hearing
was called for November 17, 1980 at the hour of 7:30 p.m., at the Council
Chambers of the City Hall, 22 Civic Center Plaza, Santa Ana, California, to
ascertain whether the public necessity, health, safety, or welfare requires
the removal of poles, overhead wires and associated overhead structures,
and the underground installation of wires and facilities for supplying
electrical communication or similar or associated service, for the formation
of the Underground Utility District No. 18 within that certain area of the
City described as follows: said certain area being bounded westerly by
the east line of Hathaway Street, bounded easterly by the west line
of Mabury Street, bounded northerly and southerly by lines 70 feet from
the center line of First Street, as shown on the attached Exhibit "A";
WHEREAS, notice of such hearing has been given to all affected
property owners as such are shown on the last equalized assessment roll and
to all utilities concerned in the manner and within the time required by
law; and
WHEREAS, such hearing has been duly and regularly held, and all
persons interested have been given an opportunity to be heard;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Santa Aha:
1. That pursuant to Santa Ana Municipal Code Sections 37-1 to
37-13, the above-described area is hereby declared an Underground Utility
District, and is designated as Underground Utility District No. 18 of the
City of Santa Ana. Attached hereto, marked Exhibit "A", and hereby incor-
porated as a part of this Resolution, is a map delineating the boundaries
of said District.
2. That the City Council does hereby fix November l, lgS1 as the
date on which affected property owners must be ready to receive underground
service, and does hereby order the removal of all poles, overhead wires and
associated overhead structures and the underground installation of wires and
facilities for supplying electric, communication, or similar or associated
service within Underground Utility District No. 18 on or before January l, 1982.
3. That the Clerk of the Council is hereby instructed to notify
all affected utilities and all persons owning real property within Underground
Utility District No. 18 of the adoption of this Resolution within ten (lO) days
after the date of such adoption. Such notification shall be made by mailing a
copy of this resolution, together with a copy of said Santa Ana Municipal Code
Sections 37-1 to 37-13 to all affected property owners as such are shown on
the last equalized assessment roll and to the affected utilities.
4. That the City Council of the City of Santa Ana hereby finds and
determines as follows, upon the basis of the evidence presented at said hearing;
that the public necessity, health, safety and welfare require the removal of
poles, overhead wires and associated overhead structures within said area of
the City, and the underground installation of wires and facilities for sup-
plying electric, communication, and similar or associated service, so as to
eliminate hazards caused by fallen lines and poles and to improve visibility
of pedestrian traffic to vehicle drivers.
