RESOLUTION NO. 80-211
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AFFIRMING WITH MOD-
IFICATIONS THE PLANNING COMMISSION'S
APPROVAL OF VARIANCE NO. 80-15 AND
DENYING APPEAL NO. 422
WHEREAS, On November 17, 1980, a public hearing
was duly held before the City Council of the City of Santa
Ana on Variance Application No. 80-15, which seeks to allow
construction of an office building with less than required
parking and required setback from residentially zoned
properties at 1801 E. Fourth Street in the LP, HDI District;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and on the
oral and documentary evidence submitted therein, the City
Council does hereby affirm the Planning Commission's action
in approving Variance No. 80-15, subject to certain
modifications as hereinafter set forth, and does deny Appeal
No. 422, filed thereon.
2. That the City Council hereby adopts as its
findings of fact for approval of said Variance, that certain
report entitled "Variance Application No. 80-15," submitted
by the Planning Commission and on file in the office of the
Clerk of the Council.
3. That prior to approving the said Variance,
this Council reviewed and considered the information
contained in the Negative Declaration prepared for the
project, and does approve and affirm the same.
4. That the said Variance is approved subject to
the same requirements as set forth in the abovesaid report
of the Planning Commission, except as follows:
(a) That requirement in the said report
numbered 7.A(1)(b) is deleted.
(b) That requirement in the said report
numbered 7.A(1)(c) is amended by changing phrase (1)
thereof to read: "a minimum 20-foot, bermed landscaped
setback on Parkcourt Place, unless an acceptable
alternative is approved by the Director of Planning."
(c) In addition to the requirements in the
said report, this approval of the said Variance is
also subject to the following requirement:

"The developer shall be required to prepare plans,
specifications, and e~'timates (PS&E), and bear all costs
associated with installation of a two-phase traffic signal
at the intersection of Fruit Street and Cabrillo Park
Drive."
