the meeting was opened with a silent prayer.
~JEach member of the City Council having received copies of the Minutes
of February 1, 1960, it was moved by Councilman Hubbard, seconded by
Brewer and carried, that the Minutes of February 1, 1960, in Record
Book 20, Page 368, with reference to Variance Application No. 1246,
filed by Ray B. Price, and Resolution No. 60-17 granting Variance on
said application, where one condition is modified, be corrected to
read "to provide that McFadden Avenue shall be the northerly boundary
of the area mentioned in modified, condition (e) in place of the
Atchison, Tnpeka & Santa Fe right-of-way, and owner is to complete the
street work within 120 days fr~m completion of any such work in the
area so bounded north of the property to McFadden Avenue," and said
Minutes, as corrected, were approved.

This being the date set for hearing on Amendment Application No. 304, initiated by
the Planning Commission, amending Sectional District Map 2h-5-10, to reclassify
from the C District to the C-1-PK District, property at the northeast corner of
Edinger Street and Bristol Street, or more precisely described as that area bounded
on the south by Edinger Street~ on the west by Bristol Street, on the east by an
alley approximately 175 feet east of Bristol Street, and on the north by a line ~l
feet north of the center line of Edinger Street (Lot 12h through Lot 1280 of Tract
l~lS); no protests were received and the hearing was closed. On motion of Counc~l-
man Gould, seconded by Brewer and carried, the following Ordinance entitled~
"Ordinance amending hrticle IX of the S~.nta Aha Municipal Code
to change district classificati~ on Amendment ~pplication No.
304 and amending Sectional District Map 2h-5-10"
was introduced, considered and placed on file for second reading.
This being the date set for hearing to establish future right-of-way lines on
Bristol Street, south of Delhi Road, from present Talbert Avenue to De]hi Road, on
both sides, measured 50 feet from and at right angles to the construction center
line; no protests were received and the hearing was closed. On motion of Council-
man Gould, seconded by Hubbard and carried, the following Ordinance entitled:
"Ordinance establishing future right-of-way lines along
portions of Bristol Street
was introduced, considered and placed on file for second reading.
This being the date set for hearing to change Ritchey Street, between the easterly
extension of Edinger Street and Delhi Road, from a secondary highway (84-foot
right-of-way) to a local street (60-foot right-of-way); no protests were received
and the hearing was closed. The Council having unanimously waived the reading of
the Resolution, on motion of Councilman Hubbard, seconded by Reinly and carried,
the following Resolution entitled:
"Resolution No. 60-27 changing a portion of Bitchey Street from a
secondary highway to a lccal street"
was considered and passed by the following vote:

Communication was again read from the Planning Commission recommending denial of
Variance Application No. 1243, filed by Anna P. Jensen, to establish parking lots
on property at 1813 and 1817 West 16th Street, in the R-2 District, and to waive
the ten-foot rear-yard requirement on property at 1832 West 17th Street, in the
C-I-PK District. Warren Sikora, 401 W. Eighth Street, again protested the granting
of the Variance for a parking lot on 16th Street, stating this would benefit an
isolated i~dividual case and permit spot zoning, at the expense of the balance of
the property within the area, which is in the R-2 District; further, the Variance
would permit parking up to the front line of the sidewalk, and requested that the
Variance be denied. Leroy Brackman, 1806 W. 16th Street, again stated this is a
newly-developed area consisting of attractive duplexes and triplexes, and the owners
could not expect a reasonable return on their property if the proposed parking lot
is allowed. The hearing was closed. It was moved by Councilman Gould that the
Variance be denied. M o t ion lost for lack of a second. Councilman Hubbard
disqualified himself on this matter. It was moved by Councilman Heinly, and
seconded by Brewer, that a Resolution be adopted overruling the actdon of the
Planning Commission, and grant the Variance on condition that a concrete wall

of not less than five feet be placed c~ the west line of Lot 17, said wall to end
at the setback line, and that a temporary wood fence be constructed along 16th

vegetation and maintain same for a period of not less than two years; dedicate all
rights of access to 16th Street, and consent under a deed that all ingress and
egress be through l?th Street; that the parking lot be black-topped and marked

It was moved by Councilman Gould and seconded by Brewer, that action be postponed
until such time as the Planning Co,~fssion and Planning Department make a compre-
hensive study and report as to the ulttmate use of the property generally bounded
on the east by College Avenue, on the north by 17th Street, on the south by 16th
Street, and on the west hy King Street.

Communication was again read from the Planning C~mmission recommendiB~ denial of
Variance Application No. 12~, filed by Joe Montano, to convert front house to a
duplex and construct an apartment over garages in the rear, on property at 633 East
Central Aveau~, in the R-1 District. Alberto Rios, 629 E. Central ~enue, (M~b~b~l*
of several property owners, stated the applicant does not have sufficient parking
facilities for the tenants, a driveway is not provided, nor space for parking at
rear of the property; his house is adjacent to this recently moved-in house and his
property has depreciated in value. Also, a fence was constructed of discarded lumber
which is insubstantial and is a hazard to the children. Attorney Russell Behrens,
208 Spurgeon Building, representing the applicant, advised his client wishes to
rescind the application for an R-3 District and file applicatio~ for the R-2 Dis-
trict. He stated the yard consists of 7,850 feet, is 157by50 feet; the buildings
comprise 2,180 square feet, leaving a r-mainder of 5,670 sq,,~e feet, which can
accommodate two familieS, with a play area for the children, ,1lowing for a 9-1/2
foot driveway from the street to the rear of the premises, a ~d 17 feet between the

On motion of Councilman Hubbard, seconded by Heiuly and carried, the recommendation
of the Planning Commission was approved and Variance Application No. 1250, filed by
Ruby Jewell Fouts, to continue operating a boarding hmme for six elderly men, on
property at 510 Cypress Avenue, in the R-2 Distr~ct, was granted, subject to
conditions imposed by the Department of Public Works.
On motion of Councilman Gould, seconded by Hubbard and carried, the recommendation
of the Plem~ning Commission was approved and Variance Application No. 1252, filed by
Joe Villalobos, to construct second unattached dwelling, on property at 443 Adams
Street, in the R-1 District, was granted, subject to one condition.
On motion of Councilman Gould, seconded by Hubbard and carried, the recommendation
of the Planning Commission was approved and Variance Application No. 1253, filed by
Herbert O. Hyatt, to construct a building, approximately 138 feet by 82 feet, to
house two offices and a sales warehouse, on property at ll3~ East 17th Street, in
the R-2 District, was granted, subject to conditions.
On motion of Councilman Gould~ seconded by Hubbard snd carried, the recommendation
of the Planning Cce~nission was approved and Variance Application No. 125~, f~led
by ~etropolitau Savings & Loan Association~ to reduce the required front setback
frOm 60 to 50 feet~ on Lots i - Rh, Tract 3505, on property situated on both sides
of Eastslde Avenue (Tract 3505) between Washington Avenue and ~Tth Street, in the
R-1 District, was granted.
On motion of Councilman Gould, seceded by Hubbard and carried, the recommendation
of the Plauning Department was approved and Variance Application No. 1255, filed by
Southern Pacific Company, to construct a sign directing traffic to a residential
subdivision located at Fairhaven and Esplanade Streets~ in Orange, on property situ-
ated in the 400 block south side of East 17th Street, e~st of Southern Pacific
Railroad tracks, in the C-1-PK District~ was granted, subject to conditions.

Zoning to R-B District would have a degrading and devaluating effect on their pro-
perry, as it is directl,v across the street; further, pictures were taken to point
out the de preciat i on of the outer walls of the buildings and the garbage
problem, and the two-story buildings would deter from the privacy in the patios of
the single-story, medium-priced homes. Attorney Harry Knisely, on behalf of the
applicant, remarked his client has no definite plans to build and were concerned
with the 121-foot strip only, not zoned R-S and which is a part of the entire
parcel purchased for the develupment of Tract 3533 being developed as R-B lots.
Re stated they were not aware the 12cl.-foot strip, or 7 lots, was not in the R-3
District whe~ this parcel was purchased, and if retained as R-1 would represent a
hardship; the property to the east is now M-l; the north property has already been
zoned C-1. The hearin~ was closed. It was moved by Councilman Brewer, seconded by

a period of one year, beginning Jttly 1, 1960, at a rental of $100.00 per month,
said lease to be subject to termination by either party upon ninety days written
notice, and in the event extensions are requested, such extensions be denied.
It was moved by Councilman Hubbard, seconded by Brewer and carried, that escrow
instructions No. ~4326-C, dated January 19, 1960, be approved and signed with
Hubert Melton and Eena Melton, conveying property located on the north side of
Fairview Avenue and Edinger Street, and for improvements on Sullivan Street, in
consideration of $20,000.00.

William E. Groom, Jr., 6182 Chickasaw Drive~ Westminster.. reportdng alleged damage
to his car on January 12, 1960, by a fallen tree, as he was driving southeast on
Poinsettia Street approaching the intersection at Fruit Street, was referred to the
City Attorney and Insurance Carrier.

ized to execute the following Change Orders, with the Gallegos Corporation, for the
Santa Aha Public Library, as follows:

American National Red Cross was denied to display flags from light standards through-
