HomeMy WebLinkAbout82-003REL:adg 1/6/82 RESOLUTION NO. 82-3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REVERSING THE ACTION OF THE PLANNING COMMISSION ON CONDITIONAL USE PERMIT APPLICATION NO. 81-13, APPROVING SAID CONDITIONAL USE PERMIT, AND GRANTING APPEAL NO. 459 FOR PROPERTY LOCATED AT 1111 SOUTH HARBOR BOULEVARD WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana on January 4, 1982, on the action taken by the Planning Commission in denying Conditional Use Permit Application No. 81-13, which application seeks to allow construction of an outdoor advertising sign (billboard) at 1111 South Harbor Boulevard in the C2 District; and WHEREAS, prior to taking action on said Conditional Use Permit Application, this Council has reviewed and considered the Negative Declaration for the project, including Initial Study No. IS 81-110; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. That based on such public hearing and the oral and documentary evidence submitted therein, the City Council does hereby reverse the action of the Planning Commission denying said Conditional Use Permit Application No. 81-13, and does hereby approve said Conditional Use Permit and grant Appeal No. 459. 2. That the City Council hereby adopts, as its findings of fact for the approval of Conditional Use Permit No. 81-13, the following: (a) As conditoned hereinbelow, the subject sign is consistent with a policy of providing a moderate amount of outdoor advertising space in appropriate locations in the City, which service contributes to the general well-being of the community. (b) The subject sign will not have a significant adverse effect on persons or property in the vicinity, due to the circumstances of its locations and surroundings, and the conditions of approval hereinbelow. (c) The subject sign will be in compliance with all relevant zoning regulations and conditions. RESOLUTION NO. 82-3 PAGE TWO (d) As conditioned hereinbelow, the subject sign will not have a significant adverse effect on the future development of the surrounding area in accordance with the General Plan of the City. 3. For the reasons set forth in the Negative Declaration prepared for this project, the Council approves and adopts the said Negative Declaration and its finding that the project will not have a significant effect on the environment. 4. The said Conditional Use Permit is approved subject to the requirements and limitations set forth in the report of the Planning Commission for the said Conditional Use Permit, a copy of which is on file in the office of the Clerk of the Council, and subject to the following additional conditions: (a) That this Conditional Use Permit shall terminate at the end of a four-year period; provided, however, that the applicant shall remove the sign without cost to the City of Santa Ana upon thirty days written notice from the City Council, if, at any time, the City Council determines that removal of the sign is necessary or appropriate for purposes of widening the Harbor Boulevard right-of-way adjacent to the subject site. (b) The sign shall not be lighted after twelve midnight. ADOPTED this 18th day of January · 1982.
