RESOLUTION NO. 82-9
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA APPROVING THE
DESTRUCTION OF CERTAIN RECORDINGS OF
TELEPHONE AND RADIO COMMUNICATIONS
PURSUANT TO SECTION 34090.6 OF THE
GOVERNMENT CODE OF THE STATE OF
CALIFORNIA (POLICE DEPARTMENT)
WHEREAS, the Chief of Police has submitted a
request for authority to destroy certain recordings of
telephone and radio communications; and
WHEREAS, said request has been approved by the
City Attorney and is recommended for approval by the City
Manager, and is in accordance with the procedures and
requirements of the City and Section 34090.6 of the
California Government Code; and
WHEREAS, said request is to destroy the original
recordings which are more than 100 days old and are made in
the routine daily taping and recording of telephone
communications to and from the police Department of the City
of Santa Ana and all radio communications relating to the
operations of said department;
NOW, THEREFORE BE IT RESOLVED by the City Council
of the City of Santa Ana as follows:
1. Subject to the conditions and exceptions
hereinafter set forth, the Chief of Police is hereby
authorized to destroy all tape recordings over 100 days old
of the following:
a. Daily telephone communications.
Radio communications relating to Police
Department operations.
2. The recordings specified in paragraph 1 of this
Resolution shall not include any recordings of citizen
complaints, or investigations in response to citizen
complaints, relating to members of the Police Department,
nor to Internal Investigation files, unless a reproduction
of the original has been made on a suitable magnetic device.

3. Recordings which are evidence in any claim filed
or any pending litigation shall be preserved until the claim
or pending litigation is resolved.
4. This Resolution shall be effective upon adoption
and remain in full force and effect, applying to all named
recordings reaching the requisite age, until rescinded.
