RESOLUTION NO. 81- 24
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA OVERRULING THE
ZONING ADMINISTRATOR'S DENIAL OF
MINOR EXCEPTION APPLICATION 80-60,
GRANTING APPEAL NO. 432 AND APPROVING
MINOR EXCEPTION NO. 80-60.
WHEREAS, a public hearing was duly held before the
City Council on February 2, 1981, on the action taken by the
Zoning Administrator in denying Minor Exception Application
No. 80-60, which application seeks to allow sale of beer and
wine for off-site consumption in an existing market at 1120
South Bristol Street in the C1 District;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Santa Ana as follows:
1. That based on such public hearing and the
oral and documentary evidence submitted therein, the City
Council does hereby reverse the action of the Zoning
Administrator, grant Appeal No. 432, and approve Minor
Exception No. 80-60.
2. That the City Council adopts as its findings
of fact and conditions of approval for the approval of the
said Minor Exception that certain report entitled "Finding
of Fact, Minor Exception 80-60," submitted by the Zoning
Administrator and on file in the office of the Clerk of the
Council with the exception that "Finding" (a) therein is
amended to read as follows:
"The proposed use is desirable as contributing
to the general well-being of the neighborhood,
as existing establishment in the area do not
make up a very heavy concentration of liquor
licenses."
and Finding (b) is amended to read as follows:
"The circumstances of this case indicate
that such use will not be detrimental to
the health, safety or welfare of persons
residing or working in the vicinity or
injurious to property or improvements in
the vicinity."
