This being the date set for hearing on Amendment Application No. 309, filed by
Wm. D. Greschner Company, amending Sectional District Map ll-5-10, to reclassify
from the M-1 District to the C-2-PE District, a parcel of land on the north side
of First Street, beginning at a point 539.19 feet west of center line of Townsend
Street, with approximately 210-foot frontage on First Street, and depth of 60~ feeti
no protests were received and the heari~ was closed. On motion of Councilman
Gould, seconded by Hubbard and carried, the following Ordinance entitled:

was introduced, considered and placed on file for second reading.
This being the date set for hearing on Amendment Application No. 310, initiated by
the Planning Commission, to amend Sectional District Map !l-5-10, to reclassify
from the R-2 District to the R-1 District~ one parcel of land (approximately 50
feet by 1BO feet in size), situated at the northwesterly corner of Art~sia and
Fifteenth Streets~ pl~inning %ommisslon recommended denial. Communication was pre-
sented from James E. Carlson, dated March 29, 1960, requesting that no action be
taken on this Amendment Application. On motion of Councilman Hubbard, seconded by
Heinly and carried, the recon~endation of the Planning Commission was approved,
amd f~mendment Application No. 310 denied.
On motion of CounciLman Hubbard, se~nded by Brewer and carried, the following
Variance Applications were granted, as recOnmended by the Planning C~issiou:
Variance Applicatiou No. 1~82, filed by Lewis A. Bittle, to add a two-bedroom
dwelling unit on the rear part of the lot, on property at 2131 Cypress Avenue, in
the R-~ District~ subject to one condition.
Variance Application No. 128~ filed by the Land Acquisition Service, to convert
an ex~sting dwelling to a general business office to be used by the Land Acquisition
Service, a right-of-way firm perf6rming land appraisal and right-of-way acquisition

Variance Application No. 1285, filed by Dike & Colegrove, Inc., to construct

from center line of the street, on property on the north side of Lorenzo Street,
beginning at a point approximately 200 feet west of Shelton Street, in the R-1

Variance Application No. 1286, filed by Alfonso L. Morales, to build a new
house next to existing house, without attaching the units, on property at 1128 W.

Cu,~a~nicetion was read from the Planning Co~lssion reference Variance Application
No. 1287~ filed by Nick Padilla, to build a new one-bedroom duplex on the rear part
of the lot which contains one existing dwelling unit, on property at 1329 W. 2nd
Street, in the R-2 Distriotl Planning Co~nnission recommended that Variance be
granted to permit construction of one single-family dwelling on rear part of lot,
instead of duplex, subject to conditions. Mr. M. GraJeda, 9hl W. Fifth Street,
representing the applicant, stated that this property is adjoined by C-1 zoning and
questioned why a duplex could not be built instead of a single-family dwelling.
On motion of Councilman Gould, seconded by Heinly and carried, the recommendation

Attorney Milford W. Dahl, representing the applicant, stated his client, Wm. D.
Greschner Company, has a 99-year lease on this property, and one of the conditions
require a grant of easement along the southerly line of this property for drainage
purposes. Prior to the construction of this building, the problem of drainage was

discussed with an Engineer, when I represented Dr. Robert Davis, and I was asked to
advise the City that the use of this pipeline for drainage is at his will and he
does not consider it to be an easement. The Variance is for the rear lmlf of the
property and not the front half where the depressie~ Or Swale, is located~ an~ n~t
wish to tear up the surfacing. Also, the depression creates a problem for a parkingl
lot. On motion of Councilman Hubbard, seconded by Heinly and carried, the matter
was continued until the next meeting.
On motion of Councilman Gould, seconded by Heinly and carried, action was postponed~
until the next meeting on Variance Applicatinn No. 1281, filed by George W. Gellatl~,
to construct an adAitional single-family dwelling on a lot with one existing single~

family dwelling, on property at 1908 Orange Avenue, in the R-1 District.
Communication was again read from the Planning C~.lission rec~muending denial of
Variance Application No. 12hB, filed by ~nna P. Jensen, to establish parking lots
property at 1813 and 1817 W. 16th Street~ in the R-2 District, and to waive the
ten-foot rear-yard requirement on property at 1832 W. 17th Street, in the C-1-PK
District. William Campbell, representing the applicant, stated there is a parking
lot adjoining this property and agreed to the construction of any type of fence
required so there would be uo access on 16th Street. CounciLman Hubbard disquali-
fied himself on this matter. Warren Sikora, 401 W. 8th Street, representing Mrs.
Kirkpatrlck, protested the area is not C~,m,ercial and the church property and park-
ing therefor is considered R-1 construction. Leroy Brackman stated the proposed
parking lot is directly across the street from his property and did not feel that
a parking lot, even though fenced, would improve the area, and cars were seldom
parked all day in the church parking lot. It was moved by Councilman Eeinly and
seconded by Gould, that a Resolution be adopted overruling the recommendation of
the Planning Co~,,ission and granting Variance Application No. 1243, subject to
conditions; and that the rights of ingress and egress to 16th Street be granted to
the City and it being understood that there will not be any granting back of the
rights of ingress and egress; that a 6-foot solid cement fence shall be constructed!
along the setback line and the applicant be required to plant and maintain the areali
between the sidewalk and setback line; a six-foot block wall fence shall be construe-
ted on the west side of the lot, and the area completely blacktopped; the owner
shall dedicate to the City a street easement for the full width of the property
involved along l?th Street, a strip of land 52 feet in width measured south of and
at right angles to the center line of 17th Street for street purposes, and all
other conditions as recommended by the Department of Public Works; that a drive not
less than ten feet be provided along the west line of the 17th Street lot so that
there will be better access to the parking lots~ an8 that a bumper be placedslong
the south line so that the cars will not ove~-hang on the siSewalk.

On motion of CounciLman Heinly, seconded by Brewer and carried, the action was
continued until the next regular meeting.
Commmmication was presented from J. William Smith requesting withdrawal, for furthe~
study, of their Variance Application No. 12k8, filed by Pacific Investments, Ltd.,
to construct an apartment hotel of six stories, with professional uses on the first
floor, on property at 120 E. Washington Avenue, 121 E. 12th Street, and the south-
west corner of Bush Street and Washington Avenue, in the R-B District.
Communication ~as again read from the Planniug Commission rec~,~ending denial of
Variance Application No. 1266, filed by Ed M. Rosenbaum, et al, to extend the facil,
ities of an existing used car lot to include the southeast corner of Sycamore and
Pine Streets, on property at BO1 So. Sycamore Street, in the R-3 District. Attorney
Ridley Smith, 1002 No. Broadway, representing the applicant, stated his client would
prefer to have the exit on Pine Street and is willing to comply with the conditions
of the Department of Public Works. There would be some selling and storage of cars
and an improvement would be made of the property. Mr. Clancey, BO5 So. Sycamore
Street, said he would not oppose the lighting or a wall being constructed on the
property line. Ray McCoy, 300 So. Main Street, stated the type of lighting would
be a continuation of what is now ther~ and asked for an exit on Pine Street~ and
that a wall be constructed on Sycamore Street. The Council having unanimously
waived the reading oft~mResolutton, on motion of Councilman Heinly~ seconded by
Gould and carried, the following Resolution entitled:

Application No. 1273, filed by James A. Freeman, to construct a building to be used
for a wheel alignment, tire balancing, and brake service shop, on property on the
east side of Bristol Street, between 17th and 18th Streets, in the R-1 DJstrlct.
Mr. Robert Betts, 12SS-hO W. 18th Street, representing ten property owners, who
stood in protest, stated that when business was established on 17th Street, a 78-
foot buffer strip was provided to serve as off-street parking on 17th Street and
parking is not allowed on Bristol Street. We feel there has been no change in the
conditions to warrant this Variance Application, and conditions relative to parking
are more acute now than in the past. Earl Jabs, owner of property at 123~ W. 18th
Street, advised the proposed building would create a traffic hazard, as it is so
close to the intersection of Bristol and 17th Streets. Mr. David Gross, 1725 No.
Bristol Street, representing the applicant, protested that there was nothing in
writing that a buffer strip would be provided for off-street parking at 17th Street.
and advised that this property is separate, with separate taxes, is a business
property, and is zoned R-2. The proposed business operation would not be noisy an~
the building would be attractive. On motion of Councilman Brewer, seconded by
Gould and carried, the recon~endation of the Planning Co~mnis~ion was approved, smd
Variance Application No. 127B denied.

Application No. 1289, filed by Sophia Waldman, to build a two-story, 14-unit apart-
ment buildin~ with 18 parking spaces on property at lOlO No. Parton Street~ in the
R-2 District. Attorney Sam Dreizen, 711 W. lOth Street, representing six property
o~ners, who stood in protest, and the Samerico Holding Corporation, 711 W. loth
Street, stated this is an R-2 District end there are several duplexes in the area
that is not an apartment zone} this being an atte~pb to spot zone. Also, there is
a serious parking problem now as No. Parton Street is very narrow. The proposed
property provides for 18 parking stalls and the plans do not comply with City's re-
quirements. Woody Reagans 2027 No. Main Streets representing the applicants stated
the plans were changed providing for 13 units and 17 parking stalls. Red Paulin,
120~2 Browning Avenue, Tustin, cc~mnented that the proposed building would provide
one-bedroom apartments for people who worked in the area. Paul Bodnar, 8~2 No.
Parton Street, objected, to the one-bedro~n apartments, stating working couples
living there would require two automobiles, and that t8 parking stalls for l~ units
would mean at least six cars would be parked on the street. The applicant advised
there was no parking problem when she lived on Parton Street. Mrs. Sharpe, 1027 No.
Patton Street, said most of the lots are 250 feet deep and there is no parking diff~
culty with the nine units she owns on Parton Street. It was moved by Councilman
Gould that a Resolution be adopted overruling the recommendation of the Planning
Commission and granting the Variance to construct ten units on propertys the plot
plan be redrawn to provide for ten units, and usable, accessible parking stalls as
required by the Building Code. Motion lost for lack of a second. It was moved by
Councilman Brewer that Variance Application No. 1289 be denied for the reason that
the property is already a problem because of the parking situation. Motion lost foz~
lack of a second. It was moved by Councilman Heinly that a Resolution be adopted
parking stallss and that the apartments be constructed according to plot plan.
Motion lost for lack of a second. It was moved by Councilman Heinly, seconded by
Gould end carried, that action on the matter be continued until the next regular
meeting.
On motion of Counci~m~. Hubbard, seconded by Heinly and carried, the recommendation
of the Planning Commission was approveds and a ninety-day extension of time granted
on Variance Application No. 1122~ filed by Edward M. Hall, to permit the use of
property at the southwest corner of McFadden and Standard Avenues, in the R-1 Dis-
trict, for the operation of a market and six small shops.
On motic~ of Councilman Hubbard, seconded by Heinly and carried, the commanication
from the Planning C~m~ission was received and filed recommending approval of pro-
posed annexation to the City of territory designated "Santa ~na Southwest ~Jmex No.
5", consisting of approximately 890 acres, and located west of Main Street between
Delhi Road and Baker Avenue.

.Courts 67~8 has r~led that the constitutional rights gives anyone the privilege of
speaking if they desire to speak; the right of using my loud speaker has been
authorized by the Supreme Court in New York, providing the loud speaker is con-
trolled by City Ordinances of every City, to be heard within a 500-foot radius and
I b-ye attempted to comply with the rules; I am sorry if I have offended anyone or!
annoyed the merchants. The Mayor stated there is no quarrel with the right of
free speech, or the right to worship, but complaints have been registered that you
are using the loud speaker system to make derogatory and salacious remarks and
turning it up to the annoyance of the people in that particular area. Counci~m~au
Gould asked the Reverend Wilson if the Manager of ~,llen & Bluett had requested ~
that the speaker be turned down. Reverend Wilson replied that he was requested to!
do so. Councilman Gould stated that it had been reported that you called a merchant
a sinner. The Reverend Wilson stated the merchant swore at him and he rebuked himi

noyanc~the loud speaker and the Preacher's voice can be heard beyoud 500 feet.!~"
The Preacher was asked if he entered an automobile, not owned by him, and moved ~
it to park his car there, and he replied he had; also he had met the owner of the i
car and told him he had ~moved the car. The Mayor asked if he had adjusted his '
loud speaker after receiving so many complaints and the Preacher said he had turne.

feres with the conduct of business. Mrs. Ferguson Wilson spoke on behalf of her
husband, stating she knows he meant no harm to aayone and was trying to get people
who are not church members, to listen to the word of God, and said she had been on,
the street corner durin~ the services, and requested that his license not be re-
voked. It was moved by Councilman Gould and seconded by Hubbard, that this CounciJ
finds the Reverend Wilson, by his methods, has created a public nuisance, and has
been disturbing the peace and quiet of the neighborhood, and that said Street Use
Permit be revoked, without prejudice, and to file a new application for another
location.

portion of our City Code, pertaining to the procedure for the investigation and
hearing regarding the operation of taxicabs, provides for a particular Board to
hear these matters, and this is not possible as the Board no longer exists. We find
that the application as filed is in conformance with the intent and proceedings of
the Cede sections, and we know of no reason why the permit should not be issued.

parties concerning this matter and expressed a desire to be heard; also the permit
should not be granted uhless public necessity or convenience requires it. Attorne~I

existing Ordinance provides for a hearing and it seems understandable that Mr.
Powell should oppose the hearing, although I do not believe that the taxicab busi-
