On motion of Councilman Gould, seconded by Brewer and carried, the lowest and best
bid of Sully-Miller Contracting Company, was accepted in the total amount of
$31,888.50, and all other bids rejected.
On motion of Councilman Gould, seconded by Brewer and carried, action was postponed
to June 6, 1960, on the award of the bid for Public Liability Insurance for the City
of Santa Aha, for a three-year period starting July 1, 1960, Specification No.522-1,
and the matter referred to the Manager and Attorney for study and report.
On motion of Councilman Gould, seconded by Brewer and carried, the recc~mendations
of the Planning Commission were approved, and the following Variance Applications

Cu,~aanication was presented from the Planning C.-~aission recommending denial of
Variance Application No. 1291, filed by Alfred Carney and David E. Ascher, to con-
vert the front apartment to an office for The Burton Detective Agency, on property
at 713 Spurgeon Street, in the R-3 District. Sidney Berlin stated he owns The
Burton Detective Agency, and had lived at 713 Spurgeon Street for three years prior
to converting the front apartment to an office; that the owner of the apartment has
no objection to the office use which would be conducted primarily through telephone
calls; there are parking spaces for approximately twelve cars, although only about
six cars are parked there daily, and requested approval of the Variance Application.
It was moved by Councilman Gould that a Resolution be adopted over-ruling the Plan-
ning C~ission and granting the Variance for two years, for the purpose of a detec-
tive agency only, and no exterior signs be placed away from the building. Motion

Communication was presented from the Planning Department recommending approval of
Preliminary Record of Survey No. 168, filed by Donald L. Coleman and Jacoba V.
Obispo, creating two parcels located at the southeast corner of Sugar Avenue and
Verano Street, subject to conditions. Ray }4ercado, 1301 Euclid Avemue, Garden
Grove, stated the conditions were acceptable to his client, except condition "e"
requiring improvement of Verano Street, including Service Road and Sugar Avenue,
as shown on the Record of Survey; also that condition "g" provide for any adequate
storm drain structure approved by the Department of Public Works, rather than the

On motion of Councilman Gould, seconded by Brewer and carried, Preliminary Record

and "h'~ as recorm~ended by the Planning Department, and that condition "e" be com-
plied with and the owner enter into an agreement with the City to improve the west
~00 feet of Sugar Avenue and Verano Street, if and when the same are ready to be
occupied ~nd prior to issuance of Building permits; and that condition "g" be com-
plied with and the 36-inch reinforced concrete pipe be substituted for any pipe as
hereinai%er approved by the Department of Public Works.
On motion of Councilman Gould, seconded by Heinly and carried, proper ~ficials
were authorized to execute agreement dated May 16, 1960, with the Southern Pacific
Company for recovery of cost for off-site sewer along westerly side of Birch Street,
south of Delhi Road; and renewal of lease No. DA-O~-S76-NG-251, dated July l, 1960,
with the California Air National Guard, for rental of certain facilities at the
Community Center, for a period of one year beginning July l, 1960, at a rental of
$100.00 per month.
It was moved by Councilman Gould, seconded by Brewer and carried, that escrow
instructions dated May 9, 1960, and amended escrow instructions dated May ll, 1960,
be approved and signed with William C. and Mignonne Borland, for property on the
east side of Garnsey Street, north of Sixth Street, for the Civic Center site, in
the su~ of $12,750.00.
The Council having unanimously waived the reading of the Resolution, on motion of

It was moved by Councilman Gould, seconded by Heinly and carried, that a hearing
date be set on June 6, 1960, for consideration of the final draft of the proposed
Revised Land-Use Ordinance, as prepared by the Planning Department, which said
Ordinance does not make any change in the classification of any property within the
City, but provides for eight new Districts and provides changes in the regulations
of existing Districts.
On motion Of Councilman Gould, seconded by Brewer and carried, the following Ordi-
nance entitled:
"Ordinance emending Santa Aha Municipal Code by adding two Sections
thereto regulating occupancy and use of places of public accommo-
dation''
and that Part 3 of Chapter 2 of Article IV of the Santa Aha Municipal Cede is hereby
emended by adding thereto two new Sections in words and figures as f o llows:
Section No. 4231. Unlawful Occupancy.
Persons of the opposite sex, except husband and wife or parent and minor
child or adult and related minor child with the exact relationship shown,
shall not Jointly register and occupy an~ roc~ in anyhotel, motel, lodging
house, rooming house, trailer park or other place where transients are accom-
modated in the City.
Section No. ~232. Unlawm~ul Renting.
(a) No proprietor, manager, or other person in charge of any building or
place where transients are accommodated shall register, rent or assign any
room, space, or place for Joint occupancy by persons of the opposite sex, un-
less such persons shall be registered as husband and wife or as parent and
minor child or adult and related mfnor child with the exact relationship show~.
(b) No proprietor, manager, or other person in charge of any hotel,
motel, lodging house, rooming house, trailer or other place where transients
are acc~maodated for sleeping or lodging purposes shall rent or let any room,
rooms, or trailer more than once to the seme person or persons between the
hours of 6:00 P.M. and 6:00 A.M. of the next day.
(c) No proprietor, manager, or other person in charge of any hotel,
motel, lodging house, rooming house, trailer or other place where transients
are accommodated for sleepf~ or lodging pu_wposes shall rent or assign any
room, space, or place to two or more persons without first requiring said per-
son to register, excepting therefrom minor children under the age of sixteen
years.
(d) No proprietor, manager, or other person in charge of any hote4 motel,
lodging house, rooming house, trailer or other place where transients are
com~odated for sleeping or lodging purposes shall knowingly rent, let, or
assign any room, space, or place to any person or persons for the purpose of
prostitution.

This being the date set for hearing to consider the final draft of the proposed
Revised Land-Use Ordinance, as prepared by the Planning Department, Dr. Daniel F.
Gordon, 8~3 N. Broadway, asked if the Ordinance would be read, and the Mayor replY(
it would not as it would take considerable time due to its length, and it t~d been
read to the Chamber of Co~nerce Civic Affairs Com~ittee, B~rd of Realtors, Edison
officials and other interested agencies. Dr. Gordon stated that members of the
medical profession objected to the parking requirements of one parking space for
150 square feet of gross floor area in a P-PK District, and requested reconsiderati~
of this restriction. Planning Director James Toepfer explained many excellent sour,
were used in planning the parking requirements, and cited several local restriction~
not as favorable. Forrest Moody, 318 W. 17th Street, stated his office is used for
medical and dental services and one parking stall for 225 square feet of area has
been adequate for the past ten years, protesting that any greater restriction would
create a hardship. Reverend Bob Shuler, First Methodist Church, protested that on
the basis of one parking space for each three fixed seats provisions ~ould have to
made for parking spaces for 400 members, for one hour only on Sunday, as there are
no evening services, and that a ratio of one to five would be more reasonable. The
hearing was closed. It w~s moved by CounciLman Hubbard that the Ordinance be

Communication was presented from the Planning Commission recommending approval of
Variance Application No. 1327, filed by Gerald M. Weitzman, to build a two-story,
20-unit apartment house, with 16 one-bedroom and four two-bedroom units~ on property
at 1Bll No. Ross Street, in the R-2 District, subject to conditions. The applicant
stated their plans had been modified to include 25 parking stalls, and that 26
stalls would require a subterraneanarea in front of the building which would create
an undue hardship. The Plauning Director stated the recommendation of 26 parking
stalls was in conformance with the proposed Ordinance and the need to avoid setting

Ccemaunication was presented from the Planning Comission recommending denial of
Variance Application No. 1314, filed by Francis Shoen, to move a two-story, four-
unit apartment house onto property at the northwest corner of Myrtle and Franklin
Streets, in the R-1 District. The applicant requested reconsideration of the
Variance Application and presented pictures of the building and area. Councilman
Brewer questioned the single-family residence shown in the pictures, and the appli-
cant stated there were larger, older dwellings in the Immediate vicinity. The

R-2 District. Dr. P. E. Staum stated he occupies an office at 114 E. Berkeley
Street and objected to the requirement of two more parking spaces in addition to
the present three, for his chiropractic practice, as he seldom has more than three

Councilman Heinly, seconded by Hubbard and carried, the matter was continued until
the next regular meeting.
Communication was presented from the Planning Commission recommending denial of
Variance Application No. 1325, filed by Oran D. and Irene R.Murray, to build a
duplex and two-car garage in addition to an existing duplex and two-car garage on
the lot, on property a t 14 0 3 Cypress Avenue, in the R-1 District. Farnum D.
Tar, 329 E. 17th Street, representing the applicant, requested reconsideration of
the Variance Application, as the area is well situated for additional property and
has street al~proaches from Cypress and Orange. On motion of Councilman Heinly,
seconded by Nubbard and carried, the recommendation of the Planning Commission was
approved and Variance Application No. 1325 denied.
Communication was again presented from the Planning Commission recommending denial
of Variance Application No. 1291, filed by Alfred Carney and David E. Ascher, to
convert the front apartment to an office for The Burton Detective Agency, on property
at 713 Spurgeon Street, in the R-3 District. The applicant presented pictures of
the parking area and building, and stated there are at least eight spaces for park-

Street, and advising that after a report by the Planning Director, the Con~nission
recommended that the site be approved, subject to conditions. On motion of Council-
man Hubbard, seconded by Brewer and carried, the recommendation of the Planning
Con~aission was approved for the proposed school site, subject to conditions.

Petitions were presented containing approximately 1686 signatures of residents of
the various school districts, requesting the City Council to adopt a dog leash law,
and representin~ the group, Joseph Sawaya~ 2729 W. Carlton Place~ Chairman of
Juvenile Protection Committee, John Adams P.T.A., stated the Committee was bombarded
with requests from parents~ both by letters and oral requests, that something be
done about a dog leash law in Santa Aha. At this time the PTA of John Adams Elem-
entary School voted to cooperate in whatever way they could to encourage the City
Council to legislate an Ordinance for the passage of a dog leash law. The Santa
Ana Council of the PTA also voted they would cooperate fully on this issue, and I
would now like to read a few of the many letters I have received on behalf of a dog
leash law. Mr. Sawaya read portions of letters from Mr. A. C. Kraft, disabled war
veteran~ who was almost attacked, on several occasions, by nomadic dogs while he
tried to work from his wheel chair in his garage, and from Joe S. Keith, who stated
his children are exposed to the dogs and that his landscaping has been menaced; also
quoted an item from the Santa Ana Independent outlining reasons for keeping wandering
dogs off the streets~ g lying statistics on the number of dogs in the City, the
number of persons who had been bitten in 1959, and urging the passage of such a law.
Mr. Sawaya called upon Cham Hensley, 20261 S. W. Birch Street, whose son had re-
cently been attacked by a vicious dog. Mr. Hensley stated his two-year old son is
still in the hospital and will need extensive plastic surgery, and protested that
if there had been a dog leash law this tragedy would not have occurred. Robert Evans~
2102 Orchard Drive, stated this same dog had severely attacked his daughter, who will
also need plastic surgery, and he knows of seven other people who had been bitteu by
the same animal. Mr. Sawaya stated there are many other incidents of dog bites which
have not been reported~ and as this is now the rabies season, he urged Council's
immediate support of a dog leash law. On motion of Councilman Gould, seconded by
Hubbard and carried, the petitions and letters were received and filed. The Council

age covering City area east of the Santa Ana River, and proper officials were author-
ized to execute said agreement.

Department of Public Works was approved for preparation of an agreement with Voor-
heis, Trindle and Nelson, Inc., dated June]6, 1960, in the sum of $3,000.00, for a
Master Plan of drainage covering City area west of the Santa Ana River, and proper
officials were authorized to execute said agreement.
On motion of Councilman Hubbard, seconded by Heinly and carried, the resignations
of James G. Hourke, as a member of the Planning Commission; Samuel E. Lyons, as a
member of the Personnel Board; Mrs. Chloe M. Staton and A. H. Allen, as members of
the Charles W. Bowers Memorial Museum Board, were received, filed and the Mayor
directed to write letters of commendation and appreciation for their services.
On motion of Councilman Hubbard, seconded by Heinly and carried, the Mayor was author-
ized to sign Change Order No. 2, dated May 31, 1960, with R.L. Steinmetz, for the
construction of the Recreation Building at E1 Salvador Park involving change of
design in colored concrete for the patio and providing for increase in payment to the

tion of the Manager was approved, and an extension of completion date until June
1960 was granted to the Boyle Engineering, to submit their appraisal of the Dyke
Water Company holdings within the City.
On motion of Councilman Hubbard, seconded by Heinly and carried, the following
Ordinance entitled:

was introduced, considered and placed on file for second reading.

Conmmmications were presented from Ramberg & Lowrey to The Gallegos Corporation,
reference installation of doors in the Police Facilities Building, not in confor-
mance with their agreement, and from Attorney Martell Thompson, representing G. F.
Warde, dba Orange Cabinet Shop, subcontractor on the Police Facilities Building,
advising his client had been notified by The Gallegos Corporation, general contrac-
tor, that the doors to be installed in the Police Facilities Building do not meet
the requirements of the plans and specifications, and urging that the Council con-
sider this matter. It wes moved by Councilman Hubbard, seconded by Heinly and
carried, that the communications be received and filed.
On motion of Council-~n Gould, seconded by Hubbard and carried, permission was
granted to City Attorney John K. Colwell and Deputy City Attorney Bernard Lambert,
to attend a school course given by the University of California and State Bar of
California, Los Angeles, on June 10, 1960, at their own expense; and for the City
Attorney to attend a course given by the University of California Extension Service,
San Francisco, from June 24 through June 27, 1960, at his own expense.
The Council having unanimously waived the reading of the Resolution, on motion of
Councilman Hubbard, seconded by Heinly and carried, the following Resolution entitled:

Commmanication was presented from Joseph W. Kennedy, 7l~1½ Barris Drive, Fullerton,
advising of "two-way fender wrinkling contest" due to extreme difficulty in turning
left onto Grand Avenue from Fruit Street and the partially blind corner at this
intersection, and the Manager orally reported the property owner had been contacted
and the obstruction would be cut hack to the standard of the City. On motion of
Councilman Heinly, seconded by Hubbard and carried, the communication wes received
and filed.
The Manager orally reported reference the request from Maximino Preciado, owner of
La Paloma Cafe, 900 E. ~th Street, for a permit to use the property at the rear of
the Cafe to construct a patio and use said patio for dining and dancing, and advised

ments~ and that a report would be necessary from the Police Department in regard to
