Hubbard, Stanley C. Gould. Jro, Dale H. Heinly, Bob Brewer. A. A. Hall Absent: Councilmen None The Pledge of Allegiance was given. Invocation was given by Reverend Robert Martz, First Presbyterian Church. Retirement Dale Griggs Mayor Hall announced that Dale Griggs, Director of Recreation and Parks is retiring June BO, 1960, after 28 years of service to the City. Mr. Griggs expressed his appreciation for the excellent support he had received from this Council and the many previous Councils. Councilman Heinly praised Mr. Griggs for his dedication to the Parks and Recreation Program and wished him well in his retirement. Each member of the City Council having received copies of the Minutes of June 6, 1960, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Heinly and carried. Bid acceptance Truck Chassis with Cab A tabulation of bids was presented for the furnishing of One (1) Right-Hand Control Truck Chassis with Cab, Specification No. 621-25, and the Manager stated only one bid was received, from the International Harvester. Co.~ in the total amount of $2,907.67. On motion of Councilman Gould, seconded by Heinly and carried, the bid o f Bid acceptance Pickup ts~e Trucks International Harvester Company was accepted in the total amount of $2,907.67. A tabulation of bids was presented for the furnishing of Two (2) One-half ton current model Pickup type Trucks, with flareside or stepside type bodies, Specifi- cation No. 621-27, as follows: International Harvester Co. A tabulation of bids was presented for the furnishing of One (1) Mobile Circulating Library~ Specification No. 621-26, and t~e Manager stated only one bid was received, from The Gerstenslager Company, in the total amount-of $15,761~89, and bond in the amount of $17, OO0.00. No. 1332 Mark Andrews Councilman Brewer disqualified himself on the following matter. As the two bids on legal advertising for the fiscal year July 1, 1960 to June 30, 1961, were opened at the previous meeting and referred to the Attorney for determina- tion and opinion, the Attorney orally reported there was a Court Judgment declaring the Santa Ana Independent to be a newspaper of general circulation which judgment has never been modified or set aside as provided for in Government Code Section 6024 so that any publication made in the newspaper would satisfy the Government Code re- quirement. On motion of Councilman Gould, seconded byHubbard and carried, the oral report was accepted and the Attorney instructed to submit a written opinion on the matter. On motion of CounciLman Gould, seconded by Heinly and carried, the low bid of the Santa Ana Independent, for legal advertising, was accepted and the other bid rejected. On motion of Councilman Gould, seconded by Hubbard and carried, the recommendations of the Planning Com~ission were approved, and the following Variance Applications granted: Variance Application No. 1329, filed by Temple Beth Sholom, to construct 12 fou~plexes, consisting of 40 two-bedroom and eight one-bedroom units, with off-street parking for 72 vehicles, on property north of Memory Lane and east of Bristol Street~ in R-1 District, subject to conditions, Variance Application No. 1331, filed by Henry C. Cox, to place temporary signs on property southwest of the intersection of Delhi Road and Raitt Street, consisting of 26 acres, use the garages of two model homes for temporary sales offices for the sale of a subdivision of 112 single-family homes, and use five lots for temporary off-street parking for customers, in R-1 District, subject to conditions, Variance Application No. 1333, filed by Fairlane Homes, Inc., to reduce front- yard setbacks from 60 feet to 50 feet from center line of street, with an eave en- croachment not to exceed 36 inches into front and rear yards, and an eave encroach- ment not to exceed 30 inches into the five-foot side yards, on property consisting of 3.72 acres, east of Newhope Street, beginning at a point approximately 850 feet south of Sugar Avenue and approximately 300 feet east of Newhope Street, in R-1 District, subject to conditions, Variance Application No. 1334, filed by Elizabeth J. Communication was presented from the Planning Commission recommending approval of Variance Application No. 1332, filed by Mark and Juanita Andrews, to build a two- story, 16-unit apartment house~ on property at 1709 No. Greenleaf Street, in R-2 District, subject to conditions. On motion of Councilman Gould, seconded by Hubbard and carried, the recommendation of the Planning Commission was approved and Variance Application No. 1332 granted, subject to conditions. Councilman Heinly stated the proposed parking was not adequate, and the Assistant Planner replied the parking provisions are in conformance with the minimum standards and mathematically feasible. Beltran, to build an addition to existing building that projects 7 feet into the h2-foot street setback line (fUture right-of-way line) on West First Street, said addition to include two offices and incidental storage, on property at 1201 W. First Street, in C-i-PK District, subject to conditions. The Attorney orally reported the matter had been with reference to the loan discussed with William Penn of the California Bank/and the Director of Public Works, and was informed that the Bank suggested to Mrs. Beltran that she secure an agree- ment frem the City regarding the cost of paving the sidewalk, also to dedicate the property, with the City to pay for the removal of building. The applicant stated she was not desirous of dedicating any property unless other property' owners in the area did likewise. On motion of Councilman Gould, seconded by Hubbard and carried, the recommendation of the Planning Cu~m~ission was approved, and Variance Application No. 1320 granted, subject to conditions. Lane, Jr., to build an addi- tional single-family house, with carport, on rear part of the lot, remove existing garage and add a carport to existing house, on property at 1245 So. Van Ness Avenue, in R-1 District, Variance Application No. 1337, filed by Marie B. Williams, to establish a one- operator beauty shop in existing residence, on property at 702 No. Daisy Avenue, in R-2 District, and Variance Application No. 1341, filed by L. J. Holmberg, to build an additional single-family h~ne and garage, on property at 331 Grant Street, in R-1 District. Communication was presented from the Planning Commission recommending denial of Variance Application No. 1330, filed by Artht%r M. Blanding~ to use the property at 12~9 So~ Sycamore Street, in R-2 District, for the storage of new and used cars Adelbert B. Trayner, 1229 So. Sycamore Street, read a petition signed by 20 property owners objecting to granting the Variance, and nine persons stood in protest. On motion of Councilman Hubbard, seconded by Heinly and carried, the petition was re- ceived and filed. Mr. Trayner stated the property was formerly used as a nursery by Mr. Blanding but is now occupied by Ward S. Lee, as a used car lot, and has created an unsightly appearance in the area. Also, the silt remaining from the use of the property as a nursery had been spread over the surface and on windy days causes a dust bowl. Further, that the cars are parked to the edge of the sidewalk, cutting off the view of traffic at the intersection of Wilshire Avenue and Sycamore Street. The applicant stated only three yards of silt had remained on about 12,500 square feet of ground and did not believe this would cause a dust bowl; the cars on ~-~ the lot are driven in an orderly fashion, and he had requested a No Parking zone at Wilshire Avenue and Sycamore Street to protect drivers at that corner. Also, the wall would be set back to specification and he would landscape; there is 'a buffer strip and a hedge on the north side of the property which would cut off any view. The general area is no longer residential, having various businesses, a church and a school, and the alley in back of the property would be used by customers of the car lot. Sycamore Street, stated there are homes on the east side of the 1200 block~!! of South Sycamore Street, north of Wllshire Avenue, except at the corner, and pre- sented photographs of the proposed parking lot. Mrs. Sidney Fisher, 1318 So. Sycamore Street, said she has a picture window from which one can see only cans and barrels since the advent of the car lot and objected to the Variance. Harry Ol~0n, 1230 So. Sycamore Street, objected to the granting of this Variance as it would depreciate the value of his property, but would not object to another type of busi- ness. Harold H. Porter said he has lived at 1214 So. Sycamore Street for the past 17 years and at one time was refused a permit for a very few feet in front of his house, and permitting a used car lot in this block automatically rezones this resi- dential district. Councilman Gould returned to the meeting at 9:05 P.M. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Brewer, seconded by Hubbard and carried,the following Resolution entitled: "Resolution No. 60-117 granting Variance Application No. 1330 filed by Arthur M. Wesley Smith, to expand professional office, build additional driveway entrance, and utilize the front portion of lot for parking, on property at ll2-11h East Berkeley Street, in R-2 District. Curtis S. Burrow, 316 So. Main Street, on behalf of the applicant, stated this property has a parking area at the rear which is paved, and as the loca- tion is an expanding business area, there are adequate parking facilities nearby. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Heinly, seconded by Hubbard and carried, the following Resolution entitled: "Resolution No. 60-118 granting Variance Application No. 1321 filed by J. Herb Phillips, Action Engineering Compan~ 11501 Brookhurst Avenue, Garden Grove, representing the applicant, stated the conditions were satisfactory except Condition (c) regarding the drainage run-off study over a ten-year period for the entire area. On motion of Councilman Heinly and seconded by Hubbard, Revised Tentative Tract Map No. 3652 was approved, subject to conditions. Councilman Heinly withdrew his motion with the consent of the second. Mr. Phillips requested postpone- ment of the matter to further discuss the drainage requirement with the applicant, and on motion of Councilman Heinly, seconded by Hubbard and carried, the matter was continued until the next meeting° On motion of Councilman Heinly, seconded by Hubbard and carried, Map of Tract No. 3679, filed by Henry C. Cox, for the dedication of Delhi Road, Raitt Street, Ray Circle, Flora Street, wood Street, Hall Avenue, Artesia Street, Central Avenue and Douglas Street for public use for street purposes; also easements as shown on map for the uses described thereon; also dedicate all vehicular access rights to Delhi Road and Raitt Street, except street intersections, and bond in the sum of $141,500.00 were approved; license fee in the sum of $5,600.00 accepted, and agree- ment covering improvements ordered signed. On motion of Councilman Hubbard, seconded by Gould and carried, proper officials were authorized to execute the following lease and agreement: Lease with the County dated June 20, 1960, for rental of the Newhope Fire Station, Project 819, located on Figueroa Street, west of the Santa Ana River, and Agreement with the County dated June 20, 1960, to perform soil tests, material control and recommendations for pavement design for the City during the fiscal year 1960-61. It was moved by Councilman Hubbard, seconded by Brewer and carried, that escrow instructions be approved and signed for certain properties and with the following persons: Escrow Instructions dated June 9, 1960, with Robert E. and Angeline Snelgrove, for property on the west side of Garnsey Street, the sixth lot north of Sixth Street, and is known and numbered as 622-624 and 626 North Garnsey Street, in the sum of $24,500.O0, Escrow Instructions dated June 2, 1960, with Walter L. and Ruth T. Hall Noes, Councilmeu None Absent, Councilmen None It was moved by Councilman Gould, seconded by Hubbard and carried, that a hearing date be set on July 18, 1960, to amend Municipal Code provisions regulating dancing and to remove the requirement that a Public Dancing Place must be a place holding an "On-Sale" General License permitting the sale of alcoholic beverages On motion of Counci]mmn Gould, seconded by Hubbard and carried, action on the request of Maximino Preciado, owner of the La Paloma Cafe, 900 E. hth Street, for permit to use the property at the rear of the Cafe to construct a patio and use said patio for dining and dancing was postponed to July 18, 1960.
