HomeMy WebLinkAbout81-095REL:adg 6/8/81 RESOLUTION NO. 81- 95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA RECOMMENDING LEGISLATION TO INCREASE PARENTAL RESPONSIBILITY FOR THE MISCONDUCT OF MINOR CHILDREN WHEREAS, although the intentional misconduct of minors may have been a problem of civilization throughout the ages, it has been exacerbated in recent years by the generally permissive attitude of our society, the courts, and parents; by the disintegration of the role of the family as the fundamental societal unit and the concomitant decline in parental supervision of their children; by the increased mobility of minors; and by the widespread accessibility and use of a variety of drugs; and WHEREAS, the amount of the damages sustained by the victims of such misconduct appear to have increased dramatically in recent years; and WHEREAS, existing common law doctrines and statutory provisions do not seem to provide either an adequate remedy to the victims for the damages which they incur as a result thereof or sufficient financial incentive for parents to exert greater control and supervision over the activities of their minor children, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA HEREBY DOES RESOLVE THAT: Section 1. The Legislature of the State of California hereby is urged to give favorable consideration to legislation which would expand the scope of parental financial responsibility for the misconduct of minor children. Such legislation might include, but need not be limited to, increasing the $5,000.00 limit of parental liability for the intentional misconduct of minor children which is presently provided for in Civil Code Section 1714.1, imposing a higher level of financial responsibility upon any parent whose minor child has been previously determined to have intentionally harmed other persons or property, and requiring restitution for damages as part of the juvenile justice system. Section 2. The City Clerk hereby is authorized and directed to transmit copies of this resolution to the City Council of the other cities within Orange County requesting their support for such legislation and to the Orange County members of the State Legislature.
