Gould~ Jr In re The Mayor stated the matters to be considered are: (1) The consideration Santa Ana Municipal Bowl emergency repairs to the Santa Ana Municipal Bowl and the letting of a con 'act to make safe the seating facilities at said Bowl to protect human life and pr~ erve property; and (2) The consideration of the purchase of lan8 by the City. Communication Cc~%munication was presented from Floyd E. Weaver~ Structural Engineer, ref~ fence Floyd E. Weaver ~ .~/'~ corrective measures and cost necessary to reconstruct the Municipal Bowl~ ~d on motion of Councilman Mubbard, seconded by Heinly and carried, the communic ion was received and f~led. Councilmau G~ld arrived at 12:12 Noon· CounciLman Heinly asked that it be made a matter of record whether or not e Council intends to enter into some type of operational agreement regardin~ the ex- penses for the Bowl for a continued period of two years. It was moved by ouncilman Gould that Council go on record declaring if adequate improvements and rep irs are made to the Bowl, as suggested by Mr. Weaver~ and the City operates the Bo~ for a period of two years, that proper authorities be authorized to execute an a~ cement with the School Board to defer one-half of the net loss~ if any is sustaine for the two-year period, not to exceed ~7~500.O0. Motion withdrawn for lack o~ a second. It was moved by Councilman Heinly, and seconded by Gould~ that COL cil indicate they are willing to reopen the Municipal Bowl for rental to the pL lic generally, pursuant to policies heretofore had and adopted on the conditiors: (1) That the structure of said Bowl be made safe for use by the public generally at a cost not to exceed $15~000.00, to be borne by the City~ one-half of which is to be reimbursed out of increased prices to the events by the schools usir the Bowl; and (2) That adequate insurance coverage be obtained, together with certi- ficate by the structural engineer, as to it being safe for public use. Hubbard Absent Councilmen None Counci~an Hein]y requested the record to show that we have had an offer f~om The Oallegos Corporation to supervise the repairs to the Bowl at no charge, on condition that the City would pay up to ~15~000.00 for materials to be used, with ali labor to be donated, The Gallegos Corporation to carry the necessary insurance, ~nd to hold the City harmless for any injuries which may occur in the course of th re- pairs.. Councilman Hefnly stated that we would like to have a report from the Manager with respect to the safety of the Bowl for public use. The Manager stated that as a result of a letter received from Floyd E. Weaver, a licensed Structural Engineer, employed by the City for the purpose of making a survey as to the safety of the Bowl for such live loads in normal use, I have determined that the Bowl, as it presently stands, is unsafe and that it is not possible for the City to undertake the responsibility for permitting public use of the Bowl w4thout adequate rehabilitation work. At the present time the Bowl is closed and is not being permitted for use by anyone. Councilman Heinly asked the Manager if he would say it is of sufficient emergency in the preservation of life, health, and property that an emergency be declared at this time, in order to reopen the Bowl for the August use thereof and subsequently. The Manager re- plied it is absolutely ~mpossible for us to follow normal Char~er procedUres; reference the drawing of plans and the advertising of bids~to perform the required work in time to permit the Bowl to be used any time earlier than October of this year. Councilman Heinly asked the Manager if he would say it is of sufficient urgency, for the protection of public safety and healt~ that we dispense with bid procedures, and the Manager replied "Yes." It ~as moved by Councilman Gould, seconded by Brewer and carried, that the oral report of the Manager and subsequent answers be incorporated into the Minutes. It was moved by Councilman Reinly, and seconded by Gould, that proper authorities be authorized to enter into an agreement with The Gallegos Corporation for the repair of the Santa Ana Municipal Bowl, as has heretofore been offered to be done, at the maximum cost of $15,OOO.OO, and finds it shall be deemed necessary for the preservation of life~ health and property to the citizens of the City. Boll Call Ayes, Counc~ lmen Noes, Councilmen Absent, Councilmen CounciLman Gould requested the Mayor to exercise his Stanley C. Gould, Jr., Dale H. Heinly, Bob Brewer, A.A. Hall Royal E. Hubbard None prerogative and appoint a Co~aittee of Councilmen Brewer, Heinly and GOUld, to work with the M~nager in the acquisition of property, heretofore recommended to be purchased by the City, for possible use as a Bowl site, in the south part of the City, and to make a report back to this Council as to whether or not a bond issue is desirable and would be necessary, setting a date for same after they so find. And further,to make a report back to the Council, whereby a Bowl could be constructed in a site to be ac- quired, or the present site of the Bowl, in order to provide the City with adequate and modern facilities for the recreation of the public. The Mayor appointed Coun- cilmen Brewer, Heinly and Gould to that Committee, to come back with a report. It was moved by Councilman Heinly and seconded by Gould, that proper authorities be authorized to enter %nfo Escrow Instructions for the purchase of said property as heretofore authorized by the Council.
