RESOLUTION NO. 81-130
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA REVERSING THE ACTION
OF THE PLANNING COMMISSION ON CONDITIONAL
USE PERMIT APPLICATION NO. 80-22, APPROVING
SAID CONDITIONAL USE PERMIT, AND GRANTING
APPEAL NO. 448 FOR PROPERTY LOCATED AT
1222 EAST FIRST STREET
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on August 3, 1981, on
the action taken by the Planning Commission in denying
Conditional Use Permit Application No. 80-22, which
application seeks to allow modification of an existing
service station to include a retail market at 1222 East
First Street in the M1 District; and
WHEREAS, prior to taking action on said
Conditional Use Permit Application, this Council has
reviewed and considered the Negative Declaration for
project, including Initial Study No. IS-80-230;
the
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and the
oral and documentary evidence submitted therein, the City
Council does hereby reverse the action of the Planning
Commission denying said Conditional Use Permit Application
No. 80-22, and does hereby approve said Conditional Use
Permit and grant Appeal No. 448.
2. That the City Council hereby adopts, as its
findings of fact for the approval of Conditional Use Permit
No. 80-22, the following:
(a) The subject use provides a desirable
service to the neighborhood.
(b) The subject use will not have a
significant adverse effect on persons or
property in the vicinity, due to the cir-
cumstances of its location and surroundings.
(c) The subject use will be in compliance
with all relevant zoning regulations and
conditions.
(d) The subject use will not have a sig-
nificant adverse effect on the future
development of the surrounding area in
accordance with the General Plan of the City.
3. For the reasons set forth in the Negative
Declaration prepared for this project, the Council approves
and adopts the said Negative Declaration and its finding
that the project will not have a significant effect on the
environment.
4. The said Conditional Use Permit is approved
subject to the requirements and conditions set forth as
recommended requirements in that certain "Finding of Fact,

Conditional Use Permit No. 80-22," submitted by the Planning
Commission, on file in the Office of the Clerk of the
Council, incorporated herein by reference, except that
requirement 7.A.4. therein is deleted.
