RESOLUTION NO. 81- 153
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA REVERSING THE ACTION OF THE
PLANNING COMMISSION ON CONDITIONAL USE PERMIT
APPLICATION NO. 81-8, APPROVING SAID CONDITIONAL USE
PERMIT, AND GRANTING APPEAL NO. 450, FOR PROPERTY
LOCATED AT 510 FAIRHAVEN AVENUE
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on September 8, 1981,
on the action taken by the Planning Commission in denying
Conditional Use Permit Application No. 81-8, which applica-
tion seeks to allow development of a mobile home park at 510
Fairhaven Avenue in the A1 District; and
WHEREAS, prior to taking action on said Condi-
tional Use Permit Application, this Council has reviewed and
considered the Negative Declaration for the project, includ-
ing Initial Study No. IS-81-46;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and the oral
and documentary evidence submitted therein, the City Council
does hereby reverse the action of the Planning Commission
denying said Conditional Use Permit Application 81-8, and
does hereby approve said Conditional Use Permit and grant
Appeal No. 450.
2. That the City Council hereby adopts as its
findings of fact for the approval of Conditional Use Permit
No. 81-8, the following:
(a) The proposed mobile home park is
desirable to provide attractive, affordable
housing for people of moderate income, which
contribut.es to the,w~llbeing of the community.
(b).~The~deveiopment and maintenance of
an attractive and well-designed mobile home
park, as permitted and restricted by this Con-
ditional Use Permit, will not have any signifi-
cant adverse effect on surrounding property
values, nor otherwise be detrimental to persons
residing or working in the vicinity, nor to
property or improvements in the vicinity.
(c) The proposed mobile home park will
be designed to comply with the zoning regula-
tions of the city, as duly modified by Variance
No. 81-12.
(d) The development of the proposed mobile
home park will promote the General Plan goal of
providing housing in the city for all economic
segments of the community; it complies with General
Plan land use and density designations for the
subject site; and it will not otherwise adversely
affect use and development of surrounding property
pursuant to the General Plan.

3. For the reasons set forth in the Negative
Declaration prepared for this project, the Council approves
and adopts the said Negative Declaration and its finding
that the project will not have a significant effect on the
environment.
4. The said Conditional Use Permit is approved,
subject to the requirements and conditions set forth as
recommended requirements in that certain "Finding of Fact,
Conditional Use Permit No. 81-8," submitted by the Planning
Commission and on file in the office of the Clerk of the
Council, except as modified hereinbelow.
(a) That requirement designated 7.A.(1)
is deleted.
(b) That requirement designated 7.A.(2) is
amended to read, "That each homesite shall have
a carport."
(c) That requirement designated 7.A.(9)
is deleted.
(d) That requirement designated 7.C.(5) is
amended by adding the words, "unless an alternative
plan for drainage of private access ways is approved
by the Director of Transportation, in which case
such access ways must be improved in accordance
with such approved plan."
