Meeting called to order by the Mayor. ~bsent: Councilmen Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., Dale H. Heinly, Bob Brewer, A. A. Hall None The Pledge of Allegiance was given. Invocation was given by Reverend Richard Bush, First United Presbyterian Church. Each member of the City Council having received copies of the Minutes of September 6, 1960, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Gould and carried. Bid acceptance Construct Sanitary Sewer Susan Street i Project S-27 tabulation of bids was presented for the construction of a sanitary sewer in Susan ~treet, between Talbert Avenue and Segerstrom Avenue~ Project 8-27~ as loll( West Coast Sewer Company Plumbing Contractors, Inc. Orange County Construction Co. de Leon Construction Company Total Bond $1~,655.96 lO~ ~,746.~o lO% 15,230.40 10% B4,699.B6 18,318.76 10% On motion of CounciLman Gould, seconded by Brewer and csrried, the lowest and best bid of Plumbing Contractors, Inc. was accepted at the unit prices and ~n the total "Tustin and Seventeenth N. E. Annex" Ordinance amount of $12,7~6.20, and all other bids rejected. This being the date set for hearing on the annexation of property consisting of approximately 37 acres located at the northeast corner of Seventeenth Street and Tustin Avenue; protest was read from Tustin Water Works, protesting annexation of real property consisting of 7200 square feet more or less and assessed at $3~180.0( upon the value of the land and improvements thereon. On motion of Cotuncilman Hubbard, seconded by Heinly and carried, the protest was received and filed. The Director of ~Public Works orally stated the protest is apprOXimately 2-1/2% of the total assessed valuation, or less than 50% required by Statute. The hearing was closed. On motion of Councilman Hubbard, seconded by Heinly and carried, the Council finds there are insufficient protests, and the following Ordinance entitle~ "Ordinance declaring the annexation of that certain territory designated 'Tustin and Seventeenth N. E. Annex'" was introduced, considered and placed on file for second reading. Annex'" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment of Street and Highway Element of Master Plan to consist of redesignating Grand Avenue from a four-lane to a slx- lane primary street between Santiago Creek and Delhi Road; and Bristol Street from a four-lane to s six-lane primary street between Memory Lane and. Delhi Road; no protests were received and the hearing was closed. On motion of Councilman seconded by Gould and carried, the Affidavit of Publication of Public Hearing was received and filed. On motion of Councilman Hubbard, seconded by Gould and carrie the fol.lowing Ordinance entitled: "Ordinance amending the M~ster Plan of Streets and Highways to affect Bristol Street between Memory Lane and De]hi Road" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. 316, initiated by the Planning Cmmnission, amending Sectional District Map ll-5-10, Exhibit 316-A, t reclassify from M-1 and C-1 Districts to C-2 District, property bounded on the by To~nsend Street, on the south by First Street, on the west by a line 610o56 east of the center line of Sullivan Street, and on the north by a line 602.32 feet north of the center line of First Street; no protests were received and the ~s closed. On motion of Councilman Gould, seconded by Hubbard and carried, the following Ordinance entitled: "ordinance amending Article ~X of the Santa Ana Municipal Code to change district classification on Amendment Appli- cation No. 317 snd amending Sectional District Map 14-5-10 (Exhibit 317-A)" was introduced, considered and placed on file for second reading. On motion of Councilman Gould, seconded by Hubbard and carried~ the following Ordinance entitle~ "Ordinance amending Article IX of the Santa Ana Municipal Code to change district classification on Amendment Application No. 318 and ~mending Sectional District Map 30-5-9 (Exhibit 318-A)" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. 319, initiated by the Planning Commission, amending Sectional District Maps 27-5-10 and Exhibit 319-A and B19-B, respectively, to reclassify from R-1 to the M-1 Districts property bounded on the north by Segerstrom Avenue, on the south by Huntzinger Avenue, on the east by proposed Fairview Street, and on the west by Harbor Bouleva no protests were received and the hearing was closed. On motion of Councilman Hubbard, seconded by Heinly and carried, the following Ordinance entitled: "Ordinance amending Article IX of the S~%uta Ana Municipal Code to change district classification on A~endment Application No. 31g and amending Sectional District Maps 27-5-10 and 3h-5-10 (Exhibits 319-A and 319-B)" was introduced, considered and placed on file for second reading. Appeal ApPlication No. i of Harry P. Jackson was presented on Variance Applicatio~ NO. 1B7h, for the off sale of beer and wine at 1206 South Standard Avenue~ in the Palm Shopping Center~ located on the southwest corner of Standard and McFadden Avenues~ wherein Planning Commission recommended denial for the off sale of beer and wine. Attorney John Cochran, 601 First Western Bank Building, stated the real party in interest is his client, Mr. ;~. J. Miller, owner of Tiny Tim Markets, who leased the property fr°m Edward M. Hall, and the hardship has been caused through the change in ownership by Harry P. Jackson. Attorney Cochran requested that his client's supermarket be permitted the off sale of beer and wine as is generally sold by supermarkets. Bert Ryssman, 903 E. McFadden Avenue, spokesman for four persons who stood in protest, objected to the sale of beer and wine at this market as this would create the littering of cans'and Jugs in the neighborhood, and stated when the construction of the store was proposed, there was no mention of the off sale of beer and wine~ also there is a school and a church nearby~ and the residen' wish to retain a good appearance of their property. Major Clyde Stamps~ Marine Co~ 825 E. Harvard Place, stated there would be a change in the character of this resi. dential community if the appeal is approved, as it will result in an increase in the auto traffic by drinking drivers. Also, there are many multiple dwellings in this area, and the resultant littering problem will further degrade this neighbor- hood. He further stated that this type of business should be in a business area other than the one selected. Attorney Cochran remarked that with respect to the market selling beer and wine, and the traffic disturbance of people making such purchases, the Tiny Tim Market at 1302~ Newport Avenue experiences no problem in the sale of beer and wine. Orange Cotunty Law Building property, orally requested consideration of Variance Application No. 12hO, continued for a period of six months at meeting of February l, 1960, insofar as it pertains to the extension of an existing law and accounting office building at 812-815 No. Birch Street. ~ttorney Dahl stated it now appears they will not be to acquire the property to the west, and asked that the Variance be granted to con- struct the building ~5 feet from the existing north edge of the building. He their present building is located h5 feet back, in accordance with setback require- merits, and by attaching to the building~ five or six more parking places will be provided; it will be a two-story structure and a small basement. It was moved by Councilman Gould and seconded by Hubbard that the Variance be granted, subject to conditions, except the dedication of the fifty feet. Motion not voted on. It WRS moved by CounciLman Heinly, seconded bY Gould and carried, that the matter be tabled for five minutes. Attorney Dahl requested continuation of the matter. It was moved by Councilman Gould, seconded by Heinly and carrie.d, that the matter be taken off the table and continued to the meeting of October 3, 1960. On motion of Councilman Gould, seconded by Hel nly and carried, the following Pre- liminary Record of Survey Maps and Tentative Tract Maps were approved: Preliminary Record of Survey No. 173, filed by Garden Grove Hospital, creating two parcels located 660 feet north of 17th Street, on the east side of Berrydale Street, approved by City Council on August l, 1960, subject to certain conditions; and approving recc~mmendation of Planning Department to modify condition (b) chang- ing required dedication from 59 to 52 feet; Preliminary Record of Survey No. 179, filed by Edward ~. Hall, creating three parcels located between Edinger Street and Occidental Street ou the west side of Standard Avenue~ subject to conditions; Revised Tentative Tract Map No. 3915, filed by McFadden Homes, creating 401 lots located at the northwest corner of Fair,Jew Street and McFadden ~venue, con- sisting of approximately 86 acres, subject to conditions; and Tentative Tract Map No. 3943, filed by R. Communication ~s presented from the Planning Department recommending approval of Preliminary Record of Survey Map No. 180~ filed by ~. F. Croddy, creating four parcels located on the southeast corner of McClay and First Streets, subject to conditions. Clarence Walton, 1311 Deborah Drive, Tustin~ representing the stated the conditions imposed were satisfactory~ with exception of condition (c) that McClay Street be improved east of the center line~ and requested that this improvement be postponed until the corner parcel is ~nproved. It was moved by Councilman Heinly, seconded by Hubbard and carried~ that Preliminary Record of Map No. 180 be approved~ subject to all of the conditions~ with exception of con- dition (c), and that condition (c) be imposed as follows: McClay Street be east of center line prior to issuance of a Building per~it and/or Utility Permit on the westernmost lot, and agreement be entered into between the applicant ~nd the City. Burrows, Architect, dated September 19, 1960, for architectural services in planning for and Construction of FireStation No. 8, to be located at the northeast corner 'of Fifth and New, ope Streets; and With Orange County Peace Officers Association, Inc., dated September 1, 1960, for one year, for use of the target range at the training center located on Struck Avenue, Just east of the Santa Ana River, by llO members of the Police Department, at a consideration of $1,320.O0. It was moved by Councilman Hubbard, seconded by Brewer and carried, that escrow instructions No. h5268-C, dated September 6, 1960~ be approved and signed with Albert A. and Helen Madzoeff, for property on the east side of Flower Street, south of Eighth Street, in the su~ of $25,200.00~ for Civic Center site. Communication was presented from the Department of Public Works, reference petitioz signed by approximately ten property owners requesting thzt action be taken to acquire and improve the east half of Harper Street from Sugar Avenue to a point 119 feet north, and recon~ending that the owners on the east side of Harper Street contact the developer of Tract 3713 and determine what the cost to the o~rners .~ould be for improving the east side of Harper Street, at the same time as the developer improves the west half of Harper Street; also advising that before the City would accept the east half of Harper Street for maintenance, the property o~ners would have to dedicate, as well as improve, this half of the street. On motion of Counci man Hubbard, seconded by Heinly and carried, the communication was received~ filed and the Manager directed to contact the petitioners relative to the improvements of ~rit salary increases said street. On motion of Councilman Hubbard, seconded by Gould and carrfed~ the written recom- mendation of the Manager, dated September 15, 1960, was approved~ for salary step ~lication to Funds ~?/ increases for five emPloyees~ effective October 1~ 1960. On motion of Councilman Hubbard, seconded by Brewer and carried, the application of Suzan Perrault Auxiliary~ City of Hope, was granted to solicit funds October 1, 196, to January 31~ 1961, to help finance patient care and research at the City of Hope Board; .icle Parking No. i Center in Duarte, California. Ball Noes, CounciLmen None Absent~ Councilmen None The Manager orally reported reference the survey made in regard to the petition of James Requarth, 920 Cypress ;.venue, and signed by seven residents in the 900 block Cypress Avenue, requesting the removal of a "No Parking" sign on Cypress Avenue, and presented an opinion survey, conducted by the Manager's office, of all persons residing in the entire restricted parking, area. The Manager orally recommended that final decision and determination to remove the No Parking restrictions be delayed until the meeting of October 17, 1960, for the area north of Cubbon Street to gi~e the Curb Usage Committee an opportunity to survey the area while school is in session. James Requarth, 920 Cypress Avenue, stated the residents north of Cubbon Street desire the sign removed with the exception of one owner whose proper~ is only 98 feet wide, and inquired if a pickup truck or trailer has special privi- leges of parking where there is a "No Parking" sign during the prohibited hours, and questioned why cars are allowed to park on the south side of Cubbon Street, but not on the north side? On motion of Councilman Gould, seconded by Hubbard and carried, further action on the matter ~s continued to November 7, 1960. On moti on of CounciLman Hubbard, seconded by Gould and carried, the following r~- quests for limited parking were denied: Norman H, Sbott~ E1 Tobrito, 418 N~ Bristol Street and John Duffy, Laundro,Lux hlO N. Barry, Pontiac Dealer, 117 No. Sycamore Street requesting reconsideration of the value of Sycamore Street as a one-way street, and urging the establishment to a two-way street, and on motion of CounciLman Gould~ seconded by Brewer and carried, the communication was received and filed. The Council having unanimously waived the reading of the Resolution~ on motion of Councilman Brewer, seconded by Gould and carried, the following Resolution entitled "Resolution No. 60-188 declaring intention to eliminate one-way traffic on Sycamore Street and directing the City Manager to take necessary action" to establish the two-way traffic pattern in said area within sixty days, was con- sidered and passed by the following vote: Councilman Heinly stated he is opposed t¢ the change to two-%~y traffic on-Sycamore Street, and pointed out that Bush Street is handling the one-wa~ traffic adequately. On motion of Councilman Hubbard, seconded by Gould and carried, proper officials were authorized to renew the lease with Allison Honer Company, for one year from Se tember 19, 19~0, at the increased rental of $159.50.per month, of the property on t]~e west side of Bush Street, 'between 2nd and ~rd Streets, for parking facilities. Extension~of time Widen 5th St. btn Pacific Electric RR and West City Limits !~Project 119 PPROV~D: Director of Public Works was approved, and an extension of time granted from Augus~i 5~ 1960 to September ~6, 1960~ to allow Edison Company and Pacific Telephone Company to move their utilities, reference the Widening of FiFth Street, 'between the Pacific Electric Railroad and the West City Limits, Project 119.
