Co. was accepted for Items 1 and 2, in the total Hearing "Seventeenth and Wright N.E.No.2 Annex" amount of $3,792.00, all other bids were rejected, and four checks ordered returned This being the date set for hearing on the anuexation of property consisting of approximately 110.415 acres and lOcated between Seventeanth Street and Santa Clara Avenue, extending from Wright Street on the west to Tustin Avenue on the east, designated "Seventeenth and Wright N.E. No. 2 Annex." On motion of Councilman Hubbard, seconded by Gould and carried, the Affidavits of Publicatien were received: and filed. The Clerk stated written protests were received from Annie M., Ernie A. !, and Robert F. Bushheim, Mrs. Charles H. Meier, Carl Jo Klatt and Royal J. V. Muelle~, protesting the annexation of their property to the City of Santa Aha. On motion of Colulei3m~n Hubbard, seconded by Brewer and carried, the protests were received and filed. The Director of Public Works orally stated that the area has a total assesse value of land and improvements totalling $141,550.00; the assessed value of the lan~ represented by the protestants w~s found to be $96,200.O0, and from these figures 67.96% of the property owners have protested against the annexation. It was moved by Councilman Hubbard, seconded by Gould and carried, that the City Council finds there is more than a majority protest in this annexation and further proceedings shal~ not be taken. This being the date set for hearing on Amendment Application No. 322, initiated by the planning Commission, amending Sectional District Map 2-5-10, Exhibit 322-A, to reclassify from C-1 to R-1 District, property described as that area on the east side of Berrydale Street 1050.90 feet north of 17th Street, said parcel having 276 feet of frontage on Berrydale Street and 659.49 feet of depth; no protests were received and the hearing was closed. On motion of Counci!m~n Gould, seconded by Hubbard and carried, the following Ordinance entitled "Ordinance amending Article IX of the Santa Aha Municipal Code to change district classification on ~mendment Application No. 324 and amending Sectional District Map 9-5-10 (Exhibit Appeal Appl.No.2 Variance Appl.No.1316 J. W. Lenney was lntroduced~ considered and placed on file for second reading. Appeal Application No. 2 of J. W. Lenney was presented on Variance Application No. 1316, filed by Porter Edmunds, wherein Planning C~ission granted a Variance to the Church of the Messiah~ to construct, maintain and use R-1 zoned property for the purpose of a Church, ASm~uistration Building, Chapel, hall, school, sacristy and youth activity center. Applicant's Appeal states immediately west of the prop-i erty is a new tract of homes that w-ill suffer immeasurably if Planning Co~nission's decision is upheld and requests reversal of same. The Clerk read a communication fr~n Attorney Fred Forgy, Jr., 416 First Western Bank Building, representing Mr. and Mrs. P. C. Edmunds, owmer of approximately five acres located at 1828 Fruit Street, advising Mr. and Mrs. Edmunds have resided on the property since shortly after the turn of the century, and stating the presence of a Church upon their prop~ erty would not Jeopardize contiguous real property values; further, they intend to reside in their present house which will be bound on two sides by the Church prop- erty. ~n motion of CounciLman Hubbard, seconded by Brewer and carried, the com- munication was received and filed. Attorney William Denner, 1867 Park Avenue, Costa Mesa, representing the Appelant, stated the new tract of h~es is immediately across Sherry Lane from the proposed Church site, and would decrease the property value if the Church site is constructed; also the inadequate parking facilities of the Church site would necessitate street parking, and objected to the increased traffic and noise. F~ther, m~ client consulted with Voorhies, Trindle & Nelson, Engineers, who investigated the drainage problem on the proposed Church site, and read their letter wherein'it was stated the drainage would not be proper and the box culvert cannot be expanded to handle the extra runoff, Attorney Denner requested an opinion from the Director of Public Works in regard to the impracticability of the Church site on this property due to the drainage problem. The Director of representing the Church of the Messiah, stated a great deal of time was spent in search of adequate property and the present site is sufficient for their 500 member~ There will be twenty rooms for a Sunday School, Administration Building, etc. but n~ parochial ~chool. Also, the services are held on Sundays and the evening traffic would be light. There is a ten-foot easement, and a large drainage system could be installed; further, Mabury Homes, in the immediate vicinity~ have offered no objection to the construction of the Church. On motion of Councilman Brewer, secon. ded by Hubbard and carried, the decision of the Planning C~mnission was upheld, and Appeal Appl.No.3 Variance Appl.No.1373 Ruth B. Harmer Reso.No.60-189 granting Appeal Appeal Application No. 2, filed by J. W. Lenney, denied. Appeal Application No. 3 of Ruth B. Harmer was presented on Variance Application No. 1373, wherein Planning Commission recommended denial, to build a six bachelOr-unit apartment house that would project 14 feet into the required front yard and seven f~et into the required side yard, on property at 412 Vance Street, in R-3 District. Public Works stated investigation reveals the present culvert will adequately handle both the subdivision and the Church site. Attorney Willis Clemens, 1415 So. BroadWay, Variance Appl.No .1240 Orange County Law Bldg. Communication Planning Commission Vacate portion Riverine Street ~he Appelant, Mrs. Ruth B. Harmer, 412 Vance Street, stated court proceedings were court started in April to get/approval to encumber her husband's interest in the property~ which has been owned by them for 33 years, and permission was Just received from the courts to proceed on the basis of the six-unit apartment house only. Chris Marsh, 412 Vance Street, stated he had checked with the Planning Department prior to the adoption of the Land Use Ordinance and was advised the setback and side yard requirements were acceptable, and consequently the property went into escrow in April, 1960. He presented pictures of a SOO-foot area depicting the established setbacks on Vance and Lacy Streets; also an alternate plan of the proposed property~ which has 9,600 square feet, and Exhibit "A" indicating the 80-feet rights-of-way on Vance and Lacy Streets, stating most of the streets are sixty feet in width, including any new subdivisions. Further, if the court decision had been received prior to the ch~uge in the Land Use Ordinance, an appeal would not have been ne- cessary for the constraction of this six-unit apartment house. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Gould, seconded by Hubbard and carried, the following Resolution entitled: "Resolution No. 60-189 granting Variance Application No. on Appeal Application No. was considered and passed by the following vote: Ayes, Councilmen Royal E. Dahl, representing the Orange County Law Building property, aga$ orally requested Council consideration of Variance Application No. 12~O, insofar as it pertains to the extension of an existing law and accounting office building at 812 No. Birch Street, which matter was continued from the previous meeting. Attorne~ Dahl reiterated his client's objection to the further dedication of five feet for setback purposes, inasmuch as eight fee~ had already been dedicated, but stated that on conferring with his clients they have agreed to the further dedication of five fe~t which would be in sidewalk area. It was moved by Councilman Gould, seconded by Hubbard and carried, that Variance Application No. 1240 be granted, insofar as it pertains to the extension of an existing law and accounting office building at 812 No. Birch Street, subject to all conditions as imposed by the Planning Department a~ the Department of Public Works, and the further condition of the dedication of 30 feet from the center line of Eighth Street Comm~uication was presented from the Planning C~mmfssion recommending approval of proposed vacation and abandonment of all that portion of Riverine Street lying be- tween Tenth Street and 150 feet north of Eighth Street, except at the southerly end of the portion to be abandoned, the County construct a cul-de-sac to City standards, so as to provide adequate turn-around maneuvering space for vehicles used in conjunc- tion with business on the parcels fronting on the remaining portions of Riverine Street, immediately south of the proposed abandonment · Further, it is noted that there is apprcximately 150 feet of frontage under private ownership on both sides Riverine Street, Immediately north of Eighth Street. These privately owned parcels would be on a stubbed street with inadequate turn-around space for emergency fire- fighting equipment, etc., if the cul-de-sac were not constructed. Heinly On motion of Councilman Hubbard, seconded by Gould and carried, the communication from the Planning Commission recommending approval of proposed annexation to the City of territory designated "Delhi and Raitt - S.E. Annex," located on the south side of Delhi Road, approximately 201 feet west of the flood control channel, and consisting of 19.304 acres, was received, filed, and the matter continued until October 17, 1960. On motion of Councilm~n Eubbard, seconded by Brewer and carried, the communication frnm the Planning Commission recommending approval to vacate a strip of land four- teen feet wide running northerly from First Street, west of Townsend Street, which has been a public sewer easement, was received and filed. On motion of Councilman Hubbard, seconded by Gould and carried, the following Pre- liminary Record of Survey Maps were approved: Preliminary Record of Survey No. 182, filed by Supreme Investment Company, creating two parcels located north of the extension of Wisteria Place and along th~ west side of the S.P.R.R., subject to conditions; and Preliminary Record of Survey No. 184, filed by King Medical Group, creating two parcels located 620 feet east of Bristol Street, on the south side of Delhi Road, subject to conditions.
