RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA REDUCING THE ASSESS-
MENTS HERETOFORE CONFIRMED WITHIN
ASSESSMENT DISTRICT NO. 246
WHEREAS, this City Council, by its Resolution No.
81-141 adopted on September 21, 1981, confirmed the assess-
ments levied within Assessment District No. 246, ordered
certain improvements to be made, and designated the City
Treasurer to collect the assessments; and
WHEREAS, subsequent to the confirmation, a bid for the
construction of the improvements so ordered has been re-
ceived in an amount less than previously estimated; and
WHEREAS, also subsequent to the confirmation, a bid
for the purchase of the bonds to be issued pursuant to the
Improvement Bond Act of 1915 to represent the unpaid assess-
ment has been received in an amount less than previously
estimated; and
WHEREAS, as a result of these cost decreases it is
necessary to reduce the amount of all assessments previously
confirmed to accurately reflect the cost of the improvements
so ordered; and
WHEREAS, there has been submitted to the City Council a
revised Engineer's Report setting forth the reduced assess-
ments;
NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY
COUNCIL OF THE CITY OF SANTA ANA, STATE OF CALIFORNIA, as
follows:
1. The City Council hereby reduces the assessments to
the amounts set forth in the Engineer's Report, as revised.
2. The City Clerk shall transmit to the Superinten-
dent of Streets of the City of Santa Ana the reduced Assess-
ment, and the Superintendent is hereby directed to record
the reduced Assessment in a substantial book kept for
that purpose in his office.
3. The City Treasurer is hereby authorized and
directed to return to any assessees who paid assessments
against their property subsequent to confirmation of the
initial Assessment, the amount which is in excess of the
assessments confirmed herein.
4. The City Treasurer is further directed to set
forth in the "List of Unpaid Assessments" the revised
assessments confirmed herein.
