RESOLUTION NO. 81-211
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA OVERRULING THE ZONING
ADMINISTRATOR'S DENIAL OF MINOR EXECEPTION
APPLICATION 81-20, GRANTING APPEAL, NO.452
AND APPROVING MINOR EXCEPTION NO. 81-20
FOR PROPERTY LOCATED AT 1340 WEST FIRST STREET
WHEREAS, a public hearing was duly held before the
City Council on December 7, 1981, on the action taken by the
Zoning Administrator in denying Minor Exception Application
NO. 81-20, which application seeks to allow sale of beer and
wine for off-site consumption in an existing market in a
retail center at 1340 West First Street in the C1 District.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Santa Ana as follows:
1. That based on such public hearing and the
oral and documentary evidence submitted therein, the City
Council does hereby reverse the action of the Zoning
Administrator, grant Appeal No. 452, and approve Minor
Exception No. 81-20.
2. That the City Council adopts as its findings
of fact for the approval of the said Minor Exception that
certain report entitled "Finding of Fact, Minor Exception 81-
20," submitted by the Zoning Administrator and on file in
the office of the Clerk of the Council with the exception
that "Reason for Decisfon" (a) therein is amen~'ed Go read as
follows:
"The proposed use is desirable as
contributing to the general well-being
of the neighborhood, as existing establish-
ments in the area do not make up a very
heavy concentration of liquor licenses."
and "Reason for Decision" (b) therein is amended to read as
follows;
"The surrounding area is such that
the proposed use will not be detrimental
to the health, safety, or general welfare
of persons or injurious to property or
improvements."

3. The said Minor Exception is approved subject
to the requirements set forth in the said report, and
subject to an additional requirement as follows:
"The applicant shall submit a revised site
plan showing a minimum of three (3) trash
enclosures to be developed to standards
approved by the Director of Planning and
Development Services. All trash enclosures
shall be constructed within sixty (60) days
of City Council approval of Minor Exception
81-20."
