RESOLUTION NO. 82-48
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA APPROVING
CONDITIONAL USE PERMIT NO. 81-25 AND
VARIANCE NO. 81-36 TO ALLOW AN OFF-
PREMISE ADVERTISING SIGN ON PROPERTY
LOCATED AT 1501 S. TROTTER STREET
WHEREAS, this Council held a public hearing on
April 5, 1982 on Conditional Use Permit Application No. 81-
25, to allow construction of an off-premise advertising sign
at 1501 S. Trotter Street in the M1 District, and on
Variance Application 81-36, to allow the said sign to be
constructed within 1000 feet of a freeway and in excess of
35 feet high; and
WHEREAS, prior to taking action on the said
applications, this Council has reviewed the negative
declaration (I.S. No. 81-193) prepared for the project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
(a) As conditioned hereinbelow, the subject
sign is consistent with a policy of providing a
moderate amount of outdoor advertising space in
appropriate locations in the City, which service
contributes to the general well-being of the
community.
(b) The subject sign will not have a significant
adverse effect on persons or property in the vicinity,
due to the circumstances of its location and sur-
roundings and the conditions of approval hereinbelow.
(c) The subject sign will be in compliance
with all relevant zoning regulations and conditions
other than those from which a variance is herein
approved.
(d) As conditioned hereinbelow, the subject
sign will not have a significant adverse effect on
the future development of the surrounding area in
accordance with the General Plan of the City.

(e) The strict application of the zoning
ordinance's restrictions on height and construction
of signs within the vicinity of a freeway would
deprive the subject property of privileges not
otherwise at variance with the intent and purpose
of the said ordinance, due to the special
circumstances of the subject property's location
and surroundings.
(f) The approval of the subject variance is
necessary to preserve the right of the owner of
the subject property to preserve and enjoy a
substantial property right.
(g) The negative declaration prepared for
this project, with its finding that the project
will not have a significant effect on the environ-
ment, is hereby approved.
2. Conditional Use Permit 81-25 and Variance 81-36
are hereby approved, subject to the following limitations,
requirements, and conditions:
(a) The said Conditional Use Permit and
Variance shall terminate five (5) years from and
after the date of this resolution, unless extended
for an additional period, not to exceed five (5)
years, by this City Council upon its determination
that the findings justifying this approval continue
to apply.
(b) By accepting the benefits of the sign
installation hereby authorized, the owner of the
subject property consents and agrees that,
in the event the said sign is not removed within
sixty (60) days of termination of the said Con-
ditional Use Permit and Variance, the agents or
employees of the City of Santa Ana may enter
upon the subject property and remove the said
sign, and the said owner shall reimburse the City
of Santa Ana for the costs thereby incurred.
(c) The sign shall be located in accordance
with the plot plan submitted to this Council at
the abovesaid hearing, except for minor modifications
approved by the Planning Department.

(d) Prior to issuance of a building permit
for installation of the sign, the Department of
Public Works shall be furnished proof that such
installation will not interfere with existing
underground utilities.
(e) The height of the sign shall not
exceed thirty-five (35) feet above the freeway level.
