HomeMy WebLinkAbout82-054EJC:ar 4/21/82 RESOLUTION NO. 82-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA; URGING THE STATE BOARD OF PRISON TERMS TO RESCIND THE EARLY RELEASE DATE FOR GREGORY ULAS POWELL, THE CONVICTED MURDERER OF POLICE OFFICER IAN CAMPBELL WHEREAS, on March 9, 1963, Gregory U. Powell shot Police Officer Ian Campbell in an onion field near Bakers- field, in the presence of Officer Campbell's partner, Police Officer Karl Hettinzer; and WHEREAS, Powell and James Lee Smith were found guilty of the murder of Officer Campbell and sentenced to die in the gas chamber; and WHEREAS, upon retrial after an appeal, Powell and Smith were once again found guilty of the murder of Officer Campbell and Powell was again sentenced to die; and WHEREAS, the California Supreme Court subsequently held the death penalty unconstitutional, and Powell was resentenced to life in prison; and WHEREASt of June 18, 1982, sentence; and Powell was given a tentative release date after only serving 19 years of a life WHEREAS, lenient treatment of murderers and attempted murderers of police officers will discourage qualified people from seeking employment as police officers, and will create disrespect for the legal process. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Santa Ana respectfully urges that the State Board of Prison Terms rescind Gregory U. Powell's early release date, and ensure that he remain incar- cerated for as long a period of time as is permitted by law. BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the State Board of Prison Terms, to the Governor of the State of California, to the Cali- fornia State Supreme Court, to the California Legislature, and to the various cities in Orange County. RESOLUTION NO. 82, 54 PAGE TWO BE IT FURTHER RESOLVED that other governmental agencies throughout the State, as well as private organiza- tions, be urged to take a similar position on Gregory U. Powell's release, and.communicate their concern to the State Board of Prison Terms. ADOPTED this 19th day of April , 1982.
