HomeMy WebLinkAbout82-079REL:adg 6/7/82 RESOLUTION NO. 82-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA CERTIFYING THE COMPLETION OF A FINAL ENVIRONMENTAL IMPACT REPORT FOR THE PROPOSED SANTA ANA NORTH HARBOR BOULEVARD REDEVELOPMENT PROJECT WHEREAS, an environmental impact report on the proposed Redevelopment Plan for the Santa Ana North Harbor Boulevard Redevelopment Project, was prepared by and for the Community Redevelopment Commission of the City of Santa Ana, the Community Redevelopment Agency of the City of Santa Ana and the City of Santa Ana, pursuant to the California Environmental Quality Act (Public Resources Code Section 21000 et seq.), the Guidelines for Implementation of the California Environmental Quality Act (14 Cal. Adm. Code Section 15000 et seq., hereafter the "State CEQA Guidelines") and environmental procedures adopted pursuant thereto by the Agency; and WHEREAS, notice to interested public agencies and members of the general public inviting participation at a public meeting held on October 30, 1981 to discuss the scope of the Environmental Impact Report ("EIR") for the Redevelopment Plan was published in The Register on October 22, 1981; and WHEREAS, notice to all interested parties and agencies inviting comments on the Draft EIR for the Redevelopment Plan was published in The Register on March 19, 1982; and WHEREAS, a duly notice public hearing on the Draft EIR for the Redevelopment Plan was conducted by the City Council and the Commission on June 15, 1982; and WHEREAS, the Draft EIR was revised and supplemented to adopt changes suggested, incorporate comments received, and the Commission's response to said comments, and as so revised and supplemented, a Final EIR was prepared by the Commission; and WHEREAS, the Final EIR consists of the Draft EIR, as revised and supplemented, made a part of the Commission's Report to the City Council on the Redevelopment Plan, incorporating all comments received and the response thereto as of the date hereof. RESOLUTION NO. 82- 79 PAGE TWO NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES RESOLVE AS FOLLOWS: Section 1. The Council hereby certifies that the Final Environmental Impact Report for the Santa Ana North Harbor Boulevard Redevelopment Project has been completed in compliance with the California Environmental Quality Act, the State CEQA Guidelines and local procedures, and that the Council has reviewed and considered the information contained in the Final Environmental Impact Report. Section 2. The Council hereby finds on the basis of the Final EIR that the proposed Project will not have significant effects on the natural or biological environment and that changes or alterations have been required in, or incorporated into, the Project which mitigate or avoid the potentially significant effects on the man-made and physical environment identified in the Final EIR and listed below: (1) Land Use Impact; (2) Traffic Impact; (3) Air Quality Impact; (4) Noise Impact; (5) Energy Impact; (6) Relocation Impact; (7) General Housing Market Impact; (8) Municipal Fiscal Impact; (9) Impact on Historical Resources; (10) Resources Impact; and (11) Growth-inducing Impact. This finding is based upon information contained in the Final EIR and by the following statement of facts: (a) The purpose of the proposed Redevelopment Plan represents an intensification of development in the Project Area and the elimination of blighting and undesirable land uses. This impact cannot be pre- vented without preventing development in the Project Area. The proposed Redevelopment Plan is consistent with the General Plan for the City of Santa Ana and is a mechanism permitting the implementation of portions of the General Plan. (b) The public improvements contained in the proposed Redevelopment Plan mitigate certain potential specific traffic impacts stemming from implementation of the proposed Project and are also intended to alleviate certain existing traffic problems within the Project Area. However, other existing traffic conditions within and without the Project Area and the jurisdic- tion of the City of Santa Ana preclude the Commission's and the City's ability to assure that some adverse traffic impacts will not occur as a result of the Project. This is so given the regional nature of these RESOLUTION NO. 82-79 PAGE THREE problems as they relate to already adverse conditions concerning the Newport and Santa Ana Freeways and the fact that certain potential mitigating measures are within the responsibility of the State of California rather than the City of Santa Ana. Because of the long implementation period of the Project, City-wide mitigation measures can be implemented before un- acceptable levels of service are reached in the regular course of providing City-wide traffic circulation improvements. (c) With the exception of certain traffic improvements and facilities noted above, needed public facilities, utilities and other services identified in the Final EIR will be provided either by the City, the Agency, by the developer or normal provider of such improve- ments and services during the design review and implementation phase of the proposed Redevelopment Project. (d) Although the proposed Redevelopment Project itself is not expected to contribute significantly to regional air pollution levels, the total of other developments constructed in the South Coast Air Basin during the next 10 tO 20 years has the potential to adversely affect air quality. To the extent the public improvements contained in the proposed Re- development Plan alleviate traffic congestion and the resultant air emissions therefrom, local air quality impacts will be mitigated. Due to the regional nature of the local air quality problems, mitigation measures identified in the Final EIR to reduce potential impacts on local or regional air quality cannot be assured at this time. Application of specific measures depends on several variables including the nature and operation of specific developments as well as regional air pollution control policies outside the jurisdiction of the Commission, the Agency or the City. To the extent feasible and practical the City and Agency will as necessary review Agency-assisted developments to incorporate any viable measures to address significant potential impacts on air quality related thereto. (e) Projected traffic increases stemming from the proposed Project will result in noise increases of less than 1.0 decibels. While this increase should not be considered a significant adverse impact, when RESOLUTION NO. 82-79 PAGE FOUR coupled with existing adverse noise levels and those projected from other traffic increases generated by development activity in other areas, certain streets and adjoining properties will experience higher noise levels. These levels are normally unacceptable for residential uses and application of the noise measures provided for in the City's existing building code will mitigate a substantial portion of these impacts on new or rehabilitated residential uses. No feasible mit- igation measures to reduce noise impact on existing residences are available. (f) The proposed Project will increase the use of electricity and natural gas. While this is not ex- pected to be a significant increment of regional energy usage, mitigation measures include application of the California Energy Commission's standards for energy-conserving construction techniques in all new construction. (g) Persons and businesses required to move as a result of an Agency action in the implementation of the Redevelopment Project will be afforded relocation benefits and assistance in the manner prescribed in the Redevelopment Plan and by the California Community Redevelopment Law ("CRL"). (h) Whenever dwelling units housing persons and families of low or moderate income are destroyed or removed from the low and moderate income housing market as part of the Redevelopment Project, the Agency shall, within four years of such destruction or removal, rehabilitate, develop or construct, or cause to be rehabilitated, developed or constructed, for rental or sale to persons and families of low or moderate income an equal number of replacement dwelling units at affordable housing costs within the Project Area or within the territorial juris- diction of the Agency. Further, such housing will be provided in a manner prescribed in the Redevelop- ment Plan and the California CRL. (i) While no specific mitigation measures for the indirect social impacts of the proposed project are included as a part of the Project, the City of Santa Ana's ongoing programs to improve housing availability for low and moderate income persons are intended to mitigate such potential Project impacts. Further, RESOLUTION NO. 82-79 PAGE FIVE the Agency is required by the California CRL to insure that not less than 20% of all taxes which are allocated to the Agency pursuant to S33670 of the CRL shall be used by the Agency for the purposes of increasing and improving the community's supply of low and moderate income and very low income households, un- less certain findings are made. (j) Potential adverse municipal fiscal impact of new development will be mitigated through: (1) the allocation of tax increment revenues to pay for costs of public and other improvements which cannot be provided from any other source; (2) the limitation of Agency land acquisition to projects with immediate development potential; and (3) the phasing of develop- ment to insure that municipal costs do not exceed municipal revenues. (k) Potential adverse effects to structures of historic value will be avoided or mitigated by: (1) requiring a survey and report prior to any Agency involvement with the development of any site in the Project Area to determine if the site has structures of historic value; and (2) requiring a supplemental EIR for any Agency activity which would involve the loss of any structure of historic value to determine the nature and extent of the adverse impact and feasible mitigation measures and alternatives. (1) Under the proposed Redevelopment Plan, a high level of material and labor resources will be com- mitted to the development of industrial, commercial facilities and the public and other improvements over the duration of the Plan. Substantial quan- tities of building materials and fuel will be utilized in this construction. These commitments of resources are not significant when compared to other similar developments ongoing elsewhere in the region and are considered justified in order to revitalize the Project Area in accordance with the objectives of the Redevelopment Plan and to conserve existing uses. (m) The proposed Redevelopment is specifically intended to provide for the orderly growth of Santa Ana in accordance with the City's General Plan. Mitigation measures are provided in the City's RESOLUTION NO. 82- 79 PAGE SIX development ordinances to insure that development occurs in the manner and at the time it can be accommodated. The Project's role in promoting regional growth is relatively small in a regional context. This growth is consistent with regional growth forecasts for the area. Section 3. The Council has evaluated all comments, written and oral, received from persons who have reviewed the Draft EIR. Comments and responses concerning the Draft EIR, including those made by the public and the Council and Commission at the public hearing, are incorporated herein as part of the record and the Final EIR. Section 4. The Council hereby finds that significant environmental effects have been reduced to an acceptable level in that all significant environmental effects have been eliminated or substantially lessened. Based on the foregoing, the Commission finds and determines that the Santa Ana North Harbor Boulevard Redevelopment Project will not have an adverse effect upon the environment. Section 5. The Council hereby finds that, based on the Final EIR and/or other information contained in the record, its action to approve and carry out the Redevelopment Plan is supported for the following reasons. The Redevelopment Plan will result in the: (1) Elimination of blight. (2) Creation of new employment opportunities. (3) Encouragement of uniform and consistent land use patterns. (4) Encouragement of private commercial/ industrial rehabilitation, development and capital investment. (5) Implementation of the updated General Plan. (6) Encouragement of highest and best use of available land consistent with the updated General Plan. (7) Improvement of market potential through creation of a uniform commercial character along Harbor Boulevard. RESOLUTION NO. 82-79 PAGE SEVEN (8) Development of a major business park bordering the existing Willowick Golf Course. (9) Development of vacant or under utilized industrial land. (10) Provision or replacement of public streets, alleys, parks, sidewalks, sewers, storm drains, traffic signals, lighting systems and other public facilities and improve- ments as necessary. Section 6. Upon approval and adoption of the Redevelopment Plan by the City Council, the Executive Director of the Agency is hereby directed to file a Notice of Determination with the County Clerk of Los Angeles County and the Secretary of Resources Agency pursuant to the provisions of Section 21152 of the Public Resources Code and the State CEQA Guidelines adopted pursuant thereto.
