HomeMy WebLinkAbout82-091EJC:jd 6/14/82 RESOLUTION NO. 82-91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA RECOGNIZING THAT A PROBLEM EXISTS WITHIN THE CITY OF SANTA ANA IN THE LACK OF CONCERN EXHIBITED TOWARD THE PUBLIC SAFETY, HEALTH AND MORALS IN THE OPERATION OF CERTAIN PUBLIC BARS AND RESTAURANTS WHEREAS, during the first three months of 1982 there have been thirteen (13) traffic deaths within the City of Santa Ana, of which seventy-seven percent (77%) have been alcohol related involving blood-alcohol contents greatly in excess of the state presumptive level for intoxication; and WHEREAS, statistics for citations issued by the Santa Ana Police Department indicate that several businesses within the City of Santa Aha engage in the regular violation of state and local laws regulating the conduct of such bus- inesses and their patrons; including, without limitation, the sale of alcoholic beverages to minors and intoxicated persons; and WHEREAS, in light of the foregoing the City Council of the City of Santa Ana recognizes that a problem exists within the City of Santa Ana in the lack of concern on the part of some bars and restaurants exhibited toward the public safety, health and morals in the continued serving of alco- holic beverages to minors and intoxicated persons; and WHEREAS, the City Council is aware of community concern regarding the problem described herein as evidenced by the endorsement of this resolution by citizens representing schools, churches, neighborhoods, and community organizations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA that the City Council directs the City Manager to cause the Santa Ana Police Department to use its best efforts to correct these problems, to address the regular violation of state and local laws regulating the operation of public bars and restaurants and to take appro- priate action when violations are found to exist. THE CITY COUNCIL FURTHER DIRECTS the City Manager to cause the Santa Ana Police Department to continue their strict enforcement of drinking driver laws. RESOLUTION NO. Page two 82-91 BE IT FURTHER RESOLVED that the City Council im- plores the State of California Department of Alcoholic Bev- erage Control to recognize that the above described problem exists; and to assist in the protection of the public safety, health and morals by considering each violation of state or local laws relating to such businesses individually for the purpose of assessing fines or penalties, and to assess such fines and penalties at the maximum allowed by law.
