Present: Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., Bob Brewer, A. A. Hall Absent: Councilmen Dale H. Heinly The Pledge of Allegiance was given. Invocation was given by Major Carl Andreason, The Salvation Arm~. Each member of the City Council having received copies of the Minutes of January 3, January 9, January lO and January LI, 1961, rea~ing of the Minutes was dispensed with and approved on motion of Counci]m-n Hubbard, seconded by Brewer and carried. Bid acceptance Widen Fairview St. north of First St. Project C-64 A tabulation of bids was presented for the widening First Street, approximately 670 feet, Project C-64, as follows: Total Sully-Miller Contracting Ccaxpany $ 12,~5.00 Griffith Company 14, 00~.00 R. J. Noble Comparw 12,094.00 of Fairview Street, north of Bid Bond On motion of Councilman Hubbard, seconded by Brewer and carried, the lowest and best bid of R. J. Noble Company was accepted at the unit prices and in the total amount of $12,09~.00, all other bids rejected, and a portion of the cost will be paid by A1 and Blanche M. Bruning, in the amount of $1,934.42, as their share of Bid acceptance Cc~binat ion Pumping. Engine the cost for the construction of the street abutting their property. A tabulation of bids was presented for One 1,000 G.P.N. This being the date set for hearing to vacate a portion of North Garnsey Street south of Seventeenth Street; no protests were received and the hearing was closed. The Council having unanimously waived the reading of the Resolution, on motion of Councilm~n Hubbard, seconded by Gould and carried, the following Resolution "Resolution No. 61-12 ordering vacation of a portion of North Garnsey Street south of Seventeenth Street" and the ownens of property abutting the portion of North Garnsey Street in agreed with the City of Santa Aha that they would pay to said City the amount of $516.00, which is the determ!ned value of the municipal water line leading from the water main in Seventeenth Street to and into said portion of North Garnsey Street, and further agreed that said owners would construct sidewalk, curb and gutter across Garnsey Street at its intersection on the south side of Seventeenth Street to line up with present in place construction and would provide for necessary Hearing Amend.Appl.No.333 ~Conrad Schultz 10rdinance age, was considered and passed by the following vote: Ayes, councilmen Noes, Councilmen Absent, Councilmen Royal E. Ordinance was introduced, considered and placed on file for second rending. This being the date set for hearing on Amendment Applicatic~ No. 335, initiated b2 the Planning C~w, issien, proposing to prezone territory in the "Fairhaven and Esplanade West ~mmex" and the "Vanderlip and Newport Northwest Annex", which areas are generally known as the North Tustin Area, bounded by the proposed east-west Garden Grove Freeway and Fairhaven Avenue east of Yorha Street o~ the north, New- port Boulevard on the east, First Street and Santa Clara Avenue west of Yorba Street en the south and Santiago on the west; no protests were received and the hearing wes closed. On motiou of Councilman Hubbard, seconded by Gould and carrie~ the following Ordinance entitled: "Ordinance prezoning all property within the proposed 'Fairhaven and Esplanade West Annex' and the 'Vanderlip and Newport Northwest Annexation' in accordance with Amendment 335" Hearing Amend.Appl.No.332 Mary Josephine McKenzie Ordinance was intrc~luced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. 332, filed by Mary Josephine McKenzie, amending Sectional District Map 2-5-10, Exhibit 332-A, to reclassify from the R-1 to the C-5 District property described as that area bounde~ on the north by a line 250 feet south of Trask Avenue, c~ the south by a line 769 feet south of the center line of Trask Avenue, on the east by a line 283 feet east of the center line of Berrydale Street, and on the west by the center line of Berrydale Street; no protests were received and the hearing was closed. On motion of Councilman Gould, seconded by Hubbard and carried, the following Ordinance en- titled: "Ordinance amending Article IX of the Santa Ana Municipal Code to change district classificatiou on Amen~m~ut Application No. 332 and amending Sectional District Map 2-~-10 ( EEhibit Ordinance No.NS-~93 County Administra- tive Electrical Code - 1959 was introduced, considered and placed on file for second reading. This being the date set for hearing to adopt by reference an Administrative Elec- trical Code known as "Orange County A~m!uistrative Electrical Code - 1959"; letters were submitted by Orange County Builders Association, Inc., Electrical Industry Depository, and National Electrical Contractors Association, favoring the adoption of the Orange County A&m~nistrative Electrical Code - 1959, and on motion of Councilman Hubbard, seconded by Gould and carried, the commmmications were receive, and filed. No protests were received and the hearing was closed. The Cotmcil having unanimously waived the reading of the Ordinance, on motic~ of C0uncil~an Gould, secouded by Hubbard and carried, the following Ordinance entitled: "Ordinance No. NS-493 adopttnE by reference an administrative electrical code known as 'Orange County Administrative Electrical Code - 1959'; requiring pemits for and prescribing rules and regulations governing electrical installations and wiring; adopting by reference those certain regulations entitled 'Electrical Safety Orders of the State of California', effective Fehruary~ 1955, issued hy the State of California Department of Industrial Relations, Division of Industrial Safety; providing penalties for the violatiou thereof, and amending Section 8300; enacting Sections 8301, 8302, 8303; and repealing Sections 8305, 8306, 8309, 8310 and 8311 of Chapter 3, Artic.le VIII of the Santa Ana Municipal Code" was cousidered and passed by the following vote: Ayes, Councilmen Noes, Councilmen ,Absent, Councilmen Royal E. Dave De~, 3233 Kurtz Street, San Diego, stated he is a partner in the Foodmaker Company, op- erating ~6 drive-ins throughout Southern California, ~ixteen of which are Oscar Drive-ins havtng 47-foot signs, located in San Diego, Buena Park and several locations in Los Angeles County. He stated that when the property was purchased in May, they were informed there were no sign restrictions at that time and were not aware of the new Zoning Ordinance ltmfting the height of signs to 35 feet in the C-2 District, until they applied for a huilding.permit. Further, there is an existing 67-fOot sign in the area, and as the drive-ins are an impulse type of business, the requested sign height is necessary to the success of the drive-in restaurant. L. Ross, and on motion of Councilman Hubbard, seconded by Gould and carried, the matter was continued to February 6, 1961. Attorney Delhert Larmh~ First Western Bank Building, representing the applicant, stated his client desires to divide the property which is 130 feet wide by BOO feet deep, along the westerly side of Newhope Street, into two 65-foot lots, and objected to the condition of the plannin~Department for a proposed cul-de-sac rather than another driveway, stat~wE it would be econ~-~ cally unfeasible for his client to use this lot and the expense and waste of space would prevent it. At the southerly 65 feet there is now a residence with a driveway, which has been there for many years; and, further, his client purchased the property for development and has no objec- tion to the dedicati~ of the 42 feet, but objects to Conditions 1, 2, 7, 8 and 10 of the Planning Director's Addendum dated January 16, 1961. John N. Hoy, 844 North Birch Street, stated this Map supersedes Preliminary Record of Survey Map No. 166, filed by S.P.I. Development Corporation, for the same property, which was approved by the City Council, May 2, 1960, subject to conditions~ except that no sidewalks be required on Hathaway Street and Anahurst Place, as this is industrial property. Mr. Hoy stated that Preliminary Record of Survey Map No. 198 eliminates the improv, ment of sidewalks on Anahurst Plaee~ and requested the further elimination of side. walks on Hathaway Street~ as this will be developed as c~ercial property. On motion of Councilman Hubbard, seconded by Gould and carried, Preliminary Record of Survey Map No. 198 wes approved, eliminating the sidewalk requirement on Hathaway Street, and subject to all other conditions. Communication was presented from Boyle Engineering, dated December 30, 1960, re- questing Council consideration to delete requirement by pl~nBing C~.~t ssion, for the construction of a turn-around at the northerly end of Acacia Place, reference Tentative Tract Map No. 3374, on property located between Memory Lane, Flower Street, and the Santa Aha Freeway, creating ~7 residential lots and one large site and submitting plot plan for the development of LOt ~8, as proposed by the Farmers Insurance Cempany. Cc~manication was presented from the Planning Director, dated January 16, 1961, stating that if the cul-de-sac were to be eliminated, it would result in a better street layout, if a knuckle were required at proposed Acacia Place and Farmers Drive, so that a standard drive approach and sidewalks could be placed. On motion of Councilman Gould, seconded by HUbbard and carried, the com- munication fron the Planning Director was received and filed. It was moved by Councilman Gould, seconded by Hubbard and carried, that no action be taken, a n d the Planning Director so notify Boyle Engineering. Communication Pablic Works Dept.
