Hubbard, Stanley C. Gould, Jr., Dale H. Heinly, Bob Brewer, A. A. Hall Absent: Councilmen None The Pledge of Allegiance was given. Invocatio~ was given by Reverend Daniel G. Rider, First Baptist Church. Each member of the City Council having received copies of the Minutes of January 16, 1961, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Heinly and carried. Bids The Mayor announced this is the time and place Improve Golden West Avenue, et al Assess .Dist .No. 204 fixed for the opening of bids for the improvement in Golden West Avenue and other streets (Assessment District No. 204) in the City of Santa Ana~ California, as described in Resolution of Intention No. 60-249. The Clerk announced she had received four bids, whereupon all bids were publicly opened, eEamined and declared from the following bidders, to-wit: Sully-Miller Contracting R. J. The Director of Public Works reported to the Council that he desired more time to ex-m!ne the various bids submitted, and suggested to the Council that further consideration of the award- ing of the ~ntract for the improvement in Golden West Avenue and other streets in Assessment District No. 204 be continued to the next meeting of the Council. On motion of Councilman Heinly, seconded by Hubbard and carried, further consid- eration of the bids for said improvement was continued to the next regular meet- ing of the Council~ and the Director of Public Works and Attorney to make their Bid acceptance Remodel portion City Hall report and recommendation at that time. This being the date set for hearing on Amendment Application No. 334, filed by Ray McCoy, amending Sectional District Map ll-5-10, Exhibit AA 334 A, to reclassify from the C-1 to the C-2 District property described as that area on the north Side of First Street beau*sen Forest and Western Avenues; no protests were received and the hearing was closed. It was moved by Councilman Heinly that the Ordinance be changed to include 200 feet east from the center line of Rristol Street. Motion lost for lack of a second. It was moved by Councilman Gould, and seconded by Heinly, that the Ordinance be placed on file for second reading, excepting therefrom the easterly 387 feet on Memory Lane. After discussion, Counc~ 1-~u Heinly withdrew his second and Councilman Gould withdrew his motion. It was moved by CO~llc~lman Heinly, secouded by Hubbard and carried, that the matter be continued until the next meeting, and the Ordinance rewritten to stat~ "excepting therefrom the easterly 387 feet o~ Memory Lane," and the property owner so notified. This being the date set for hearing on Amendment Application No. 339, initiated by the Planning Co..~,~'tssion, proposing to amend Sectional District Map ~-5-9, Exhibit AA 339 A, to reclassify from the "BP" District (a County classification) to the "P" District (City classification), property located at the northwest corner of Mest Seventeenth and Deodar Streets; ~o protests were received and the hearing was closed. On motion of Councilman Gould, seconded by Hubbard and carried, the following Ordi- nance entitled: "Ordinance prezoning property within the proposed 'Deodar and Seventeenth N. W. Annex' in accordance with Amendment 3B9" was introduced, considered and placed on file for second reading. This being the date set for hearing ou Amendment Application No. 3~0, initiated by the Planning Cc~mission, proposing to amend Sectional District Map 2-5-10, Exhibit AA 340 A, to reclassify frcm the R-1 to the C-5 District, property described as area consisting of the southeast corner of Trask Avenue and Berrydale Street, and a parcel approztmately 200 feet by 260 feet, located on the east side of Berrydale Street, approximately 790 feet south of the center tine of Trask ~venue; no protests were received and the hearing was Closed. On motion of Councilman Gould, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Aua Municipal Code to change district classification on Amendment Application No. 340, and amending Sectional District Map 2-5-10 (Exhibit .~, 340 .~)" was introduced~ considered and placed on file for second reading. This being the date set for hearing to vacate that portion of Sugar Avenue lying within proposed Tract No. 3713, Thomas Rodney, 629 Harper Street, objected to the closing of a portion of Sugar Avenue, as he has used this road for ma~ years and would have to travel out of his wa~. ~d Rodney, 621 Harper Street, stated that closing off that small road would create a dead-end road and the valuation of the property wc~ld be lowered. The hearing was closed. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Heinly and carried, the following Resolution entitled: Resolution No. 61-20 ordering vacation of that portion of Sugar Avenue lying within proposed TraCt Number 3713" was considered and passed by the following vote: Ayes~ Councilmen Royal E. Annex'" was introduced, considered and placed on file for second reading. Appeal ApplicatiOn No. 9 of Jesse and Lillian OJeda was presented on Variance Appl~ cation No. 1425, wherein Planning Commaission stated it is of the opinion that the matter is of such magnitude as to be c~ special interest to the people of the City and requested a hearing before the Council, to erect a six-story (54,foot) apart- ment house with a six-foot projection into .the required front yard, on property at 1321-1329 Spurgeon Street, in the R-3 District. Communications were presented frc~ Mr. and Mrs. Ernest Ellestad, owners of the first property on the north of the proposed apartment building, explaining how it concerns neighboring properties and what effect the proceedings will have on future considerations; from Frank F. LoftJ property owner within the 300-foot radius of the OJeda property~ favoring the con- struction of the apartment house. On motion of Councilman G6uld, seconded by Hein~ and carried, the communications were received and filed. Ernest Wm. Gommel, llOB Orange. West Chapman Avenue,/r~p~esenting Mr. and Mrs. Ellestad, stated the proposed proJe¢ will have a six-foot encroachment into a 20-foot front yard setback, no five-foot wall setback, and the residents within the SOO-foot radius are concerned about the 850 square feet per dwelling units, in an R-3 District, where the Zoning Ordinance requires 1200 square feet per dwelling, and also questioned the car parking area in the basement and rear of the property. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Gould, seconded by Heinly and carried, the following Resolution entitled: "Resolution No. 61-21 affirming the Zoning Administrator but modifying conditions and granting Variance Application No. 1~25 filed by Jesse and Lillian OJeda" was considered and passed by the following vote: Ayes, Councilmen Royal E. Hall Noes, Councilmen None Absent, Councilmen None Appeal Application No. 9 of Foodmaker Company was again presented on Variance Appl~ cation No. 1401, where Planning Commission recommended denial, to erect an adver- tising sign 47 feet above ground level, which is 12 feet above the height limita- tion of the C-2 District, on property at 1406 East First Street. Commmmication ws 1!9, Appeal Appl.No.8 G. B. Miller Co. (Go-Cart Race Track) ~resented from Toastmasters International, advising they are owners of a 175-front foot lot 'on East First Street, which will be financially adversely affected if the additic~al ~2 feet above the permitted maximum sign height is allowed~an~n motion of CounciLman Brewer, seconded by Heinly and carried, the commmmication was and filed. Lydia Davis, 1402 W. Pine Street, a member of the Civic Beautification Con~n~ttee, again stated the City has a good Ordinance governing the height of signs which should be enforced, and the regulation of signs does add to the good appear- ance of a City. Mr. W. K. Hillyard, 1809 Bush Street, stated the proposed sign height would detract from the appearance of the City. Dave Delano, 3233 Kurtz Street, San Diego, a partner in the Foodmaker Company, advise they operate ~6 in restaurants in Southern California and Arizoaa, and purchased this property in May, although it did not clear escrow until July, 1960. Further, in September, when they applied for a buildi~ permit, they were advised of the recently adopted Zoning Ordinance ]fm!ting the sign height to 35 feet, which would adversely affect their type of impulse-buying business. Ed Agnew, Santa Aha Neon Company, favored the 47-foot sign height and stated an 85-foot sign was being erected at a skating rink in Anaheim. ~irs. Weston Walker, 919 No. Olive Street, favored the enforcement of the .Ordinance, reference the sign height, as it now stands. The Council having unanimously waived the reading of the Resolution, on motion of Councilman B~ewer, seconded by Heinly and carried, the following Resolution entitled: "Resolution No. 61-22 overruling the Planning Commission and granting Variance Application No. l~O1 filed by Foodmaker Company" was considered and passed by the following vote: Ayes, Councilmen Dale H. Miller Company, operators of Town & Country Villa (Trailer Park), 3929 W. Fifth Street, was again presented, appealing the Planning C~mmtssion's confirmation of an action by the Planning Director, which permitted location at 606 Harbor Boulevard to be used as a Go-Cart (Race) Track by F. L. Ross Attorney Dennis D. Hayden, 207 No. Broadway, representing the applicant, appealed the determination of the Planning DirectOr reference the permitted use by a race track in a C-2 Zone, stating the Trailer Park, which contains 135 trailer units representing a $300,000.00 investment, were given assurance that the zone would not be changed when the area was annexed to the City. The racing cars operate within forty feet of the residences, and there have been a number of vacancies and the frequency of the vacancies is increasing since this operation was started. A peti- tion containing approximately 200 signatures, and communications from W. C. Fox, Mr. and Mrs. H. C. Austin, Zola and Scott Raymer, Mrs. I. E. Love, and Helen R. Templeton, residents of the Trailer Park, protesting the operation of the gasoline- powered Go-Cart Race Track were presented; from Attorney Dennis D. Hayden, setting forth the position of the applicant regarding this Appeal, and from Kart-O-Rama, Inc 606 No. Harbor Boulevard', outlining their observations reference this type of busi- ness. On motion of Councilman Brewer, seconded by Hubbard and carried, the and communications were received and filed. Mr. W. C. Fox, 3929 W. Fifth Street, stated his trailer residence is located 100 feet from the track, and they are an- noyed by considerable fumes, the yelling and screaming by onlookers, as well as spot-lights that shine directly into the trailers in the Park, and requested recon- 120 4ideration by the Council of the use c~ this area as a ~ace track in a C-2 Zone. Mr. H. A. Crowell and MarJorie ~k~es, residents of the Trailer Park, protested the noise and yelling, and the dirt frOm the cars that skid off the blacktop. Mayor Hall stated a written opinion had been submitted by the Deputy Attorney stating there is no violation of the "go-cart" recreational facility within a C-2 Zone are but restrictions on the basis of the noise, dust, fumes and operation of the cars can be c~Felled to be controlled, and the annoyance from the spotlights can be corrected. Betty Miller, part owner, Manager and resident of the Trailer Park, stated there was a similar type of operation at Newport Dunes, which was removed by the County, and that permission w~s granted to the Go-Cart Race Track before the residents of the Trailer Park had an opportunity to protest this operation. Also, the trespassing signs on the adjoining property are not observed, and the cars are driven over said property and create dust storms. Waggy, creating two lots located 1, BO0 feet north of Sugar Avenue, on the west side of Newhope Street, subject to conditic Attorney Delbert Larsh, First Western Bank Building, representi~ the applicant, stated the conditions are inequitable, and his client is willing to dedicate prop- erty, improve the street, and install curbs, and gutters within five years, or when the adjacent property is required to be improved, whichever occurs first. Motion withdrawn. The applicant that the requirement for sidewalks be omitted, as the area is unimproved and used for agriculture and manufacturing. On motion of Councilman Heinly, seconded by Hubbard and carried, Tentative Tract Map No. 4076, filed by Jess D. On motion of Councilman Hubbard, seconded by Gould and carried, proper officials were authorized to execute agreement with Richard V.
