Present: Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., Dale H. Heinly, Bob Brewer, A. A. Hall Absent: Councilmen None The Pledge of Allegiance was given. Invocation was given by Reverend James Carr, St. Peter's Lutheran Church. Each member of the City Council having received copies of the Minutes of February 6, 1961, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Heinly and carried. The Manager reported that the Director of Public Works had checked all of the bids Bid acceptance Improve Golden West Avenue, et al Assess.Dist.No.204 Reso.No. 61-37 Awarding contract received, and further reported that the bid of R. J. Noble Company was the lowest regular responsible bid received, and recv~aended that the contract be awarded to s~id low bidder, at the unit prices in their bid proposal and in the total amount of $21,179.12, for the improvement in Golden West Avenue and other streets (Assess ment District No. 2Ok) inthe City ofSanta Ana. The Council having unanimously waived the reading of the Resolution, on motion of CounciLman Gould, seconded by Hubbard and carried, the following Resolution entitled: "Resolution No. 61-37 of the City Council of the City of Santa Arm, California, awarding the contract for the construction of certain improvements in Golden West Avenue and other streets (Assessment District No. 204) in said City, as described in Resolution of Intention No. 60-249" a nd the City Council of the City of Santa ^na hereby reJect~ all of said proposal or bids except that herein mentioned, and awards the contract for doing said work and making said improvements to the lowest responsible bidder, R. No Bid No Bid 3,875.09 On motion of Councilman Gould, seconded by Smith-Booth-Usher Cempany was accepted for Steer Hydraulic Crane, in the total amount of McCoy Motor Company, Tractor Division, Tractor with Front-End Loader and Scraper $3,579.00, pursuant to the oral report of Hubbard and carried, the only bid of Item 1, One Four-Wheel Drive, of $20,170.00; the lowest and best bid was accepted for Item 2, One 35 h.p. Attachment, in the total amount of the Manager; and the lowest and best of George Dunton Inc. was accepted for Item 3, One 19,000 G.V.W. Truck Chassis Cab, in the total amount of $3,~01.28, and all other bids were rejected. On motion of Councilman Heinly, seconded by Hubbard and carried, the award was poned until the next meeting for the reconstruction of Grand Avenue, between Avenue and Delhi Road, Project No. 12~; and for the reconstruction of Chestnut between Grand Avenue and a point approximately 780 feet west. This beiDg the date set for hearing on Amendment Application No. 336, filed by W. Schtveley, amending Sectional District Map 9-5-10, to reclassify fram the R-2 to the C-5 District, property at the northeast corner of Fifth and Verano Streets; no protests were received and the hearing was closed. On motion of Councilman Gould, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code to change district classification on Amendment Application No. 336 and Amending Sectional District Map 9-5-10 (Exhibit AA 336 B)" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. 341, initiated by the Planning Ccmmission, amending Sectional District Maps lO-5-10 and ll-5-10, Exhibit AA 341 A, to reclassify from the C-1 and R-1 Districts to the C-2 District, property described as that area conslstin~ of a triangle of land formed by S Street on the north, the Santa Ana River on the southeast and Berrydale Street as extended to the River from Seventeenth Street, including the west side of Berrydale Street; no protests were received and the hearing was closed. On motion of man Hubbard, seconded by Brewer and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code to change the district classification on Amendment Application No. 3~1 and amending Sectional District Maps lO-5-10 and ll-5-10 (Exhibit AA 3Nl A)" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. 342, filed by Lawrence Kokx, amending Sectional District Map 17-5-9~ to reclassify from the R-1 t¢ the M-1 District, a 75-foot strip cf land bounded on the east by LYon Street, on south by McFadden Avenue, on the north by the S.P.R.R., and on the west by a line approximately 75 feet west of the center line of Lyon Street; no protests were re- ceived and the hearing was closed. Hunter "Ordinance amending Article IX of the Santa Ana ~unicipal Code to change district classification ~n Amendment Application No. S~2 and amending Sectional District Map 17-5-9 (Exhibit AA 3~2 A)" was introduced, considered and placed on file for second reading. Appeal Application No. ll of James Talley was presented on Variance Application No 1~2, wherein Planning Commission recommended denial, to build four one-bedroom additions to existing apartment house, and be exempt from the required ten-foot rear yard and three-foot side yard, on property at the northeast corner of Broad~ and Buffalo Street, in the "P" District. Bernice G. Cronan~ 515 W. First Street, Tustin, representing the applicant, stated the proposed additions would be constr~ ted without structural changes, in c~mpliance with the Code, a~i requested exemp- tion from the required side yard in order to cover the unsightly green wall of the building adjacent to this property~ also five additional parking stalls would be provided, or a total of 20 spaces. Dr. Robert E. Casey, 2215 North Broadway, owner of property Immediately to the north~ objected to the minimum parking re- quirements of the proposed additions, stating when his building was constructed a minimum of 59 parking spaces was required and 52 provided, and unwarranted peop~ are parking on the premises; further, other property owners in the area have ex- pressed similar views with reference to the minimal parking area of the proposed additions. Attorney 'Fred Forgy, Jr., First Western Bank Building, representing Fred Forgy, Sr. and Dorothy Travis, 2127 No. Broadway, requested that denial be mustained on this Appeal, as there are issues of the side yard~ the square footage per unit, and the parking requirements, of which spaces 2, B and 4 are inadequate for even compact cars. On motion of Councilman Hubbard, seconded by Brewer and carried, the recommendation of the Planning Commission was apprOvedandAppeal Appli cation No. ll, filed by James Talley on Variance Application No. 1442, denied. Appeal ~pplication No. 12 of Loucius P. Hunter was presented on Variance Applica- tion No. l~S9, wherein Planning C~mmission recommended denial, to add a second single-family dwelling on an R-1 lot, located at 1510 ~est Seventh Street~ in the R-1 District. Dick Rohrhaas, 2~S2 Newport Boulevard, representing the applicant, stated that six parcels to the east of this property a duplex was constructed in an R-1 Zone, and this has added to the attractiveness of the area. ~r. Hunter's dwelling is on the rear of the property, and by placing another unit in the front area, this will add to the appearan, ce of the locale, and the setbacks would be mcr than adequate. The applicant stated the adjacent property is unattractive as it has not been maintained. There are duplexes to the north, south and the east, and the residents of the area favor the construction of this additional dwelling. It was moved by Councilman Gould, and seconded by Brewer, that a Resolution be adopte overruling the Planning Commission and the Variance granted subject to conditions and the further condition that the rear building be improved and brought up to Code. Councilman Gould withdrew his motion with consent of the second. On motio: of Councilman Gould, seconded by Heinly and carried~ the matter was referred to the Planning Con~nission and Department of Public Works, to submit to the Council, at the next meeting, the conditions to be imposed relative to granting this Var- lance, and consideration be given to rezoning this area to the R-2 Zone. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Brewer and carried, the following Resolution en- titled: "Resolution No. 61-38 changing the name of a portion of Twenty-First Street, between Lewis Street and a point 130 feet west of the center line of Cotter Street, to Edna Drive" was considered and passed by the following vote: Ayes, Councilmen Royal E. Hall Noes, Councilmen None Absent, Councilmen None Communication was presented from the Planning Department recca~nending denial of Preliminary Record of Survey Map No. 203, filed by W. J. Gage, et al, creating three parcels located 1,200 feet north of 17th Street on the east side of Tustin Avenue. Donald B. Christeson, 2036 No. Main Street, representing the applicant, requested clarification of Conditions (f) That an easement be provided for Tustin: Avenue for a width of 52 feet, center line to property line for street purposes and vehicular access rights except at street intersections; and (h) That street "A" be named Catalina Avenue, and his questions were satisfactorily answered by Councilman Heinly and the Director of Public Works. Mr. Christeson Objected to Condition (e) That the owner pay a drainage assessment fee of not more than $1,000.00 per acre. That all drainage easements shall conform in width and align- ment to City design standards as determined by the approved runoff study; and in- quired if the assessment could be paid when the services are connected. Heinly answered the question. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Heinly, seconded by Hubbard and carried the following Resolution entitled: "Resolution No. 61-39 approving Preliminary Record of Survey Map No. 203, where rec~ended Condition "E" is modified providing payment before utility release" was considered and passed by the following vote: Ayes, Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., Dale H. Heinly, Bob Brewer, A. A. Hall Noes, Councilmen None Absent, Councilmen None Attorney Phillip J. Reilly, 401 W. Eighth Street, presented a petition signed by approximately forty persons, objecting to the proposed painted traffic island on North Broadway and 17th Street, at the south end, because most of the buildings occupied by Doctors and Dentists, who depend upon street parking for patients, and wheel chair and fracture cases would be greatly inconvenienced if denied parking in front of the Doctors" offices. On motion of Councilman GOUld, seconded by Hubbard and carried, the protest petition and cummnnication from Pacific Mutual Life Insur- ance Company, on behalf of the medical profession, requesting full consideration tc the proposed plan for making a third lane for left-ha~dturns at the 17th Street Broadway intersections, were received and filed. It was moved by Councilman Heinly seconded by Hubbard and carried, that the signs which were installed be temporarily removed for two weeks, and provisions for the left-turn lane be postponed until the next regular meeting. Corporation, for dedication as public high- ways, Hazard Avenue, Mountain View Street and Celeste Street, and all vehicular access rights to Hazard Avenue except street intersection, and bond in the sum of $20,000.00 were approved; license fee in the amount of $650.00 accepted, and agree- ment covering improvements ordered signed; and Tract No. 3998, filed by Kolko Construction Company, for dedication of Artesi~ and Tenth Streets for public use for highway purposes and easement as shown, and bond in the sum of $12,000.00 were approved; license fee in the amount of Sho0.o0 accepted, and agreement covering improvements ordered signed. On motion of Councilman Hubbard, seconded by Brewer and carried, proper officials were authorized to execute agreement with Co-Ordinated Construction Inc., dated February 20, 1961, for a 12-inch sanitary sewer connection on each side of Green- ville Street, from Talhert Avenue south to a point 821 feet from the center line of said Talbert Avenue, excepting the 157-foot frontage of said lot, in the sum of $5.66 per frontage foot. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Brewer and carried, the following Resolution en- titled: "Resolution No. 61-20 approving Agreement with the State of California covering portions of the Newport Freeway" nominated "VII - Ora-~3-SA between Santa Ana CL at Delhi Road and Tustin CL at McFadden Street, was considered and passed by the following vote: Ayes, Councilmen Royal E.
