RESOLUTION NO. 82-140
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AUTHORIZING A CONTRACT
WITH VICCO CONSTRUCTION, INC. FOR THE
RELOCATION OF A SEWER IN AN ALLEY BETWEEN
SYCAMORE AND MAIN STREETS SOUTH OF FOURTH
STREET AS AN URGENCY MEASURE WITHOUT
ADVERTISEMENT FOR BIDS
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SANTA ANA AS FOLLOWS:
1. The City Council finds and determines that the
relocation of a sewer in an alley located between Sycamore
and Main Streets south of Fourth Street is of urgent
necessity for the preservation of life, health, and property
for the following reasons:
(a) The sewer must be relocated prior to
construction of a pedestrian overcrossing between the
Downtown Parking Garage and certain commercial/office
buildings to the north thereof.
(b) The expeditious completion of the pedestrian
overcrossing is necessary to avoid severe financial hardship
to the owners of the said commercial/office buildings.
(c) The use of formal
procedures for relocation of the
construction to the detriment of
competitive bidding
sewer would delay
said properties.
2. The City Council further finds that informal
offers for the said sewer relocation project have been
obtained from three contractors, and that the offer of Vicco
Construction, Inc. is the lowest offer and is less than the
City Engineer's estimate of the cost of said project.
3. That certain contract entitled "Project No. 7093B,
Relocation of Sewer in Alley between Sycamore and Main
Streets South of Fourth Street," on file in the office of

the Clerk of the Council, is hereby authorized without
advertising for bids and approved, and the Mayor is
authorized to execute the same on behalf of the City.
