HomeMy WebLinkAbout82-160REL:adg 11/23/82 RESOLUTION NO. 82-160 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DECLARING THE RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON NOVEMBER 2, 1982 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. That a special municipal election was duly and regularly held in the City of Santa Ana, California on the 2nd day of November, 1982, at which election there were submitted to the qualified voters of said city the following propositions, to wit: PROPOSITION P - CHARTER LANGUAGE: Shall the Charter be amended to bring Charter provisions into conformance with state law, deleting superfluous language and revise regulation of political activity including: - Providing for infraction prosecutions; - Adjusting competitive bidding amount; - Requiring Constitutional oath of office as the only required oath; - Deleting reference to nonexistent Wards 8 and 9; - Deleting certain Charter implementation provisions which are no longer required? (Sections amended: 401.1, 420, 421, 703, 904, 1105. Sections deleted: 104, 105, 107, 108, 109). PROPOSITION Q - CITY EMPLOYEES: Shall the Charter be amended to provide that the powers, duties and qualifications of the Director of Public Works and the Director of Recreation and Parks be by resolution of the City Council? (Sections deleted: 705, 705). PROPOSITION R - BOARDS AND COMMISSIONS: Shall the Charter be amended to modify provisions for service on the city's boards and commissions, including: - Increasing reporting responsibility of chairpersons; - Increasing responsibility of the Board of Recreation and Parks; RESOLUTION NO. 82- 160 PAGE TWO - Deleting reference to sex status of members on the Board of Recreation and Parks; - Providing greater autonomy for the Personnel Board; - Increasing responsibility of the Personnel Board? (Sections amended: 904, 907, 908, 911, 912). PROPOSITION S - PERSONNEL PROCEDURES: Shall the Charter be amended to revise rules for selection, compensation, promotion and retention of City Personnel, including: - Allowing the City Council more flexibility in setting rules for employee selection; - Allowing the City Council more flexibility in setting suspension, demotion and layoff procedures? (Sections amended: 1000, 1002, 1004. Sections deleted: 1001, 1003, 1005, 1006, 1007, 1008, 1009). PROPOSITION T - ELECTIONS: Shall the amended so that the general municipal election same date as the State's general election? Charter be is set on the Sections amended: 400, 401.1, 1201). 2. That the returns of said election have been duly and regularly canvassed as provided by law, and all absentee ballots returned, if any, have been canvassed as provided by law, with said certification of canvass attached hereto as "Exhibit A" and made a part hereof as if set forth at length herein, and the results of said election are hereby declared by the City Council pursuant to Section 17111 of the Elections Code of the State of California. 3. That the total votes cast at said election for and against said propositions are set forth in said "Exhibit A." 4. That the votes of a majority of all of the voters voting at said election upon Proposition P were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have been carried at said election. That the votes of a majority of all of the voters voting at said election upon Proposition Q were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have been carried at said election. 6. That the votes of a majority of all of the voters voting at said election upon Proposition R were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have been carried at said election. 7. That the votes of a majority of all of the voters voting at said election upon Proposition S were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have been carried at said election. 8. That the votes of a majority of all of the voters voting at said election upon Proposition T were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have been carried at said election. 9. The filing by the Clerk of the Council of this resolution in the records of this City Council shall constitute the entry by the Clerk of the Council of the statement of the results of said election pursuant to section 22933 of the Elections Code of the State of California.
