RESOLUTION NO. 82- 161
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA EXTENDING FOR ONE YEAR
THE TIME FOR INSTALLATION OF REQUIRED
IMPROVEMENTS FOR SUBDIVISION TRACT NO. 11374
WHEREAS, this Council, on February 17, 1982,
approved a final subdivision map for Tract No. 11374 to
authorize the conversion of a 256-unit apartment complex to
condominiums, and likewise entered into an "Agreement for
Installation of Improvements: Tract 11374" with the
subdivider, Sunflower Creek Development Co., Inc., whereby
said subdivider agreed to complete required improvements
within one year of said map approval, subject to such
extension as may be approved by the City Council; and
WHEREAS, said subdivider is currently involved in
litigation contesting the validity of the said conversion of
apartments to condominiums, and desires to defer said
conversion and installation of improvements pending final
resolution of said litigation, and has therefore requested a
one-year extension of the time for completion of said
improvements; and
WHEREAS, this Council considers such request to be
reasonable in the circumstances;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
That the time for installation of required
improvements pursuant to that certain "Agreement for
Installation of Improvements: Tract 11374," dated February
17, 1982, between the City of Santa Ana and Sunflower Creek
Development Co., Inc., is hereby extended for one year, to
February 17, 1984.
