A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA VACATING PORTIONS OF
EIGHTH STREET LOCATED BETWEEN EUCLID
STREET AND ROSITA STREET

WHEREAS, prior to the annexation by the City of
Santa Ana of the area bounded by Euclid Street, Hazard
Avenue, Rosita Street and Seventh Street, certain portions
of said area had been dedicated for a proposed extension of
Eighth Street between Euclid Street and Rosita Street, which
dedicated portions are specifically described in Exhibit A,
attached hereto and incorporated herein; and
WHEREAS, this Council finds and determines that,
due to the incomplete,°fragmented and scattered nature of
the dedications for the abovesaid proposed extension of
Eighth Street and the total lack of street improvements
therein:
(a) For a period of more than five consecutive
years, said dedicated portions of Eighth Street have been
impassable for vehicular traffic; and
(b) No public money has been expended for
maintenance on said dedicated portions of Eighth Street
during such period; and
WHEREAS, this Council also finds and determines
that said dedicated portions of Eighth Street are
unnecessary for present or prospective public use, for the
following reasons:
(a) Due to private developments constructed in or
approved for the area, there is no realistic possibility of
completing the dedication and improvement of Eighth Street
between Euclid Street and Rosita Street.
(b) The vacation of the said dedicated portions
of Eighth Street will not affect the access rights of
abutting property owners, since such dedicated portions do
not in fact provide any effective means of access; and
WHEREAS, pursuant to the provisions of 5 2381 of
the Streets and Highways Code of the State of California,
this Council does find and determine that no part of the
abovesaid dedicated portions of Eighth Street are useful as
a nonmotorized transportation facility, as defined in § 156
of said Code; and

WHEREAS, this Council finds and determines that
there are no in-place public utility facilities in any of
the abovesaid dedicated portions of Eighth Street; and
WHEREAS, this Council has reviewed and considered
the information contained in the "Initial Study" (I.S. #82-
128) and "Negative Declaration" based thereon, prepared in
accordance with the California Environmental Quality Act for
the proposed vacation of said dedicated portions of Eighth
Street, and does hereby approve said "Negative Declaration;"
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Pursuant to the provisions of Chapter 4 of Part 3
of Division 9 of the Streets and Highways Code of the State
of California, and, in particular, g 8331 thereof, those
portions of "Eighth Street" in the City of Santa Ana
specified in Exhibit A, attached hereto and incorporated
herein, are, under the facts hereinabove recited, hereby
vacated and, from the date this resolution is recorded in
the office of the Recorder of Orange County, shall no longer
constitute a street or any portion thereof.
2. The Clerk of the Council is hereby directed to
cause a certified copy hereof, attested by her under seal,
to be recorded forthwith in the office of the Recorder of
Orange County.

LEGAL DESCRIPTION
PARCEL 1:
The Northerly 30.00 feet of Lots 4,5,9 and 19 of Tract No. 969
in the City of Santa Ana, County of Orange, State of California,
as per that certain Map recorded in Book 33, page 47,
Miscellaneous Maps, Records of said Orange County.
PARCEL 2:
The Southerly 30.00 feet of Lots 21, 22, 29, 30, 32, and 33 of
Tract No. 969 in the City of Santa Ana, County of Orange, State
of California, as per that certain Map recorded in Book 33, page
47, Miscellaneous Maps, Records of said Orange County.
PARCEL 3:
That certain portion of Lot 21 of Tract No.. 969 in the City of
Santa Ana, County of Orange, State of California, as per that
certain map recorded in Book 33, page 47, Miscellanequs Maps,
Records of said Orange County, described as follows:
A spandrel shaped parcel bounded Easterly by the easterly line
of said Lot 21; bounded Southerly by the North line of the
southerly 30.00 feet, measured at right angles, of said Lot 21
and bounded Northwesterly by the arc of a curve concave North-
westerly having a radius of 15.00 feet, said curve being tangent
to said Easterly and Southerly boundaries.
PARCEL 4:
The Southerly 30.00 feet of that portion of Lot 1 of Tract 841,
in the City of Santa Ana, County of Orange, State of California,
as ger that certain map recorded in Book 32, Page 26, Miscellaneous
Maps, Records of said County, described as follows:

Beqinning at a point in the *forth line of said Lot 1, distant
thereon 378 feet easterly from the northwest corner of said
Lot 1; thence southerly parallel with the west line of said
Lot 1 a distance of 300.15 feet; thence easterly parallel with
the north line of said Lot 1 a distance of 63 feet; thence
northerly parallel with the west line of said Lot 1 a distance
of 300.15 feet to the north line of said Lot 1; thence westerly
along said north line 63 feet to the point of beginning.
PARCEL 5:
The southerly 30.00 feet of that portion of Lot 1 of Tract No.
841, in the City of Santa Ana, County of Orange, State of
California, as per that certain Map recorded in Book 32, page
26, Miscellaneous Maps, Records of said County, described as
follows:
Beginning at a point in the North line of said Lot 1, distant
thereon 189.00 feet easterly of the northwest corner of said
Lot 1; thence southerly parallel with the west line of said
Lot 1 a distance of 300.15 feet; thence easterly parallel with
the North line of said Lot 1 a distance of 126.00 feet; thence
northerly parallel with the west line of said Lot 1 a distance
of 300.15 feet to the north line of said Lot 1; thence westerly
along said north line 126.00 feet to the point of beginning.
