A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA VACATING AN EXCESS
RIGHT-OF-WAY PORTION OF FIFTH STREET
EAST OF WRIGHT STREET

WHEREAS, this Council finds and determines that a
certain portion of Fifth Street, east of Wright Street, in
the City of Santa Ana, more specifically described
hereinbelow, is unnecessary for present or prospective
public use, for the following reasons:
(1) The said portion of Fifth Street is not now
used for vehicular traffic and is not necessary for the
smooth flow of vehicular traffic;
(2) The said portion of Fifth Street is not
necessary for pedestrian travel along or across Fifth
Street;
(3) The said portion of Fifth Street is not
necessary to provide access to abutting property owners; and
WHEREAS, for the above reasons, this Council
further finds and determines that the said portion of Fifth
Street is excess right-of-way of a street not required for
street purposes; and
WHEREAS, pursuant to the provisions of S 2381 of
the Streets and Highways Code of the State of California,
this Council does find and determine that no part of the
abovesaid portion of Fifth Street is useful as a
nonmotorized transportation facility, as defined in S 156 of
said Code; and
WHEREAS, this Council finds and determines that
there are no in-place public utility facilities in the
abovesaid dedicated portion of Fifth Street; and
WHEREAS, this Council has reviewed and considered
the information contained in the "Initial Study" (I.S. #82-
128) and "Negative Declaration" based thereon, prepared in
accordance with the California Environmental Quality Act for
the proposed vacation of said portion of Fifth Street, and
does hereby approve said "Negative Declaration;"
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:

1. Pursuant to the provisions of Chapter 4 of Part 3
of Division 9 of the Streets and Highways Code of the State
of California, and, in particular, § 8334 thereof, that
portion of "Fifth Street" in the City of Santa Ana specified
in Exhibit A, attached hereto and incorporated herein, is,
under the facts hereinabove recited, hereby vacated and,
from the date this resolution is recorded in the office of
the Recorder of Orange County, shall no longer constitute a
street or any portion thereof.
2. The Clerk of the Council is hereby directed to
cause a certified copy hereof, attested by her under seal,
to be recorded forthwith in the office of the Recorder of
Orange County.

East of Wright Street
Beginning at the Southeast corner of Tract No. 2719 as shown
on that certain map recorded in Book 115, pages 32 and 33 of
Miscellaneous Maps of Oranqe County, California; thence
Northerly 15.0 feet along the East line of said Tract No. 2719;
thence Westerly 3.0 feet along a line parallel with and dis-
tant Southerly 9.0 feet, measured at right angles, from the
Centerline of Fifth Street as shown on said map of Tract No.
2719; thence Southerly 9.5 feet along a line parallel with and
distant Westerly 3.0 feet, measured at right angles, from said
East line of Tract No. 2719; thence Westerly 127.0 feet along
a line parallel with and distant Southerly 18.5 feet, measured
at right angles, from said centerline of Fifth Street; thence
Southerly 11.5 feet along a line parallel with and distant
Westerly 130.0 feet, measured at right angles, from said East
line of Tract No. 2719 to a point in the South line of Parcel 1
of that certain real property granted to the City of Santa Ana
by deed recorded in Book 10319, pages 936, 937, and 938, Records
