RESOLUTION NO. 84-19
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA AMENDING RESOLUTION NO. 83-91 TO
ESTABLISH A SURCHARGE FOR PERMITS ISSUED FOR
CORRECTION OF MAJOR CODE VIOLATIONS
WHEREAS, the City Council of the City of Santa Ana
established and regulated fees and charges for the administration
and enforcement of Chapter 8 of the Santa Ana Municipal Code under
Resolution 83-91; and
WHEREAS, the City Council of the City of Santa Ana finds
and determines that the fees and charges hereinafter set forth are
established in amounts sufficient to provide revenue equal to the
costs of administration and enforcement of the provisions of
Chapter 8 of the Santa Ana Municipal Code, and are reasonable and
fairly allocated on the basis of burdens imposed and benefits
received by the persons required to pay such fees and charges;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Santa Ana that Resolution No. 83-91, establishing and
regulating fees and charges for the administration and enforcement
of Chapter 8 of the Santa Aha Municipal Code, is hereby amended by
adding subsection (1) to Section 1. thereof, said subsection to
read as follows:
"(1) SURCHARGE FOR PERMITS ISSUED FOR
CORRECTION OF MAJOR CODE VIOLATIONS
For any building as to which a notice and order has been
issued pursuant to Section 401 of the Dangerous Buildings Code or
Section 1101 of the Housing Code, there shall be a surcharge in the
amount of one hundred fifty dollars ($150.00) on the permit re-
quired to comply with such notice and order, in addition to any and
all other fees and charges established in this resolution. If

more than one permit is required for such compliance,
surcharge shall be imposed on the first such permit."

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA APROVING MINOR EXCEPTION NO. 83-47
TO ALLOW THE SALE OF BEER AND WINE FOR OFF-SITE
CONSUMPTION ON PROPERTY LOCATED AT 2239 WEST
FIRST STREET
WHEREAS, this Council held a public hearing on
February 21, 1984, on Minor Exception Application No. 83-47,
to allow the sale of beer and wine in an existing mini-market
located on property located at 2239 West First Street in the

WHEREAS, prior to taking action on the said applica-

NOW~ THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
(a) The sale of beer and wine in package form for
off-site consumption is a service which is commonly provided
by neighborhood convenience markets and expected by their
customers. This minor exception is therefore desirable to
provide a service which will contribute to the general well-
being of the community by promoting shopping convenience.
(b) The provision of beer and wine for sale for off-
site consumption in the neighborhood convenience market will not
create any excessive concentration of establishments selling
alcoholic beverages in the vicinity and will not adversely
impact the crime rate in the vicinity or otherwise create any
nuisance to nearby residents and businesses. Therefore, this
minor exception will not be detrimental to the health, safety
or general welfare of persons residing or working in the vicinity,
or injurious to property or improvements in the vicinity.
(c) The sale of beer and wine for off-site consumption
at the proposed market pursuant to this minor exception will not
violate any regulations or conditions of the zoning chapter of
the municipal code nor adversely affect the general plan of the
city.

(d) For the reasons set forth in Initial Study No.
I.S. 83-155, the negative declaration prepared for this project,
with its finding that the project will not have a significant
effect on the environment, is hereby approved.
2. Minor Exception No. 83-47 is approved to allow the
sale of beer and wine for off-site consumption at a neighbor-
hood convenience market to be constructed on the subject
property, subject to the following limitations, requirements,
and conditions set forth in Exhibit A, attached hereto and
incorporated herein by reference.
(a) That development be according to the approved
site plan, except for minor modifications approved by the
Director of Planning and Development Services.
(b) That any trash areas be enclosed in accordance
with the standards of the Planning and DeveloDment Service
Department.
(c) That development be in accordance with all
building safety and fire protection code requirements.
(d) That there be compliance with all the limita-
tions, requirements and conditions set forth in Exhibit A,
attached hereto and incorporated herein.

Planning:

a) Wall sign at First Street elevation shall not exceed
30 sq. ft.
b} Wall sign at west elevation shall not exceed 20% of
surface of building facade or ! ]/2 sq. ft. per
lineal foot of business frontage whichever is greater.
r) Obtain permit for any new signage.
Hours of operation shall not be extended beyond 6:00 a.m,
opening and 11:00 p.m. closing.
3) Remove wooden freestanding signs if applicable. No freestanding
sign shall be located closer than 300 feet from any other
freestanding sign on the same parcel.

There shall be no signs advertising the sale of beer and
wine. :

Remove trash and debris from rear of ~etatl center. Area
at rear was developed for partial satisfaction of off-
street parking requirements and shall remain accessible
and usable.
Police

Security Lighting requirements:~
a) Exterior doorways shall be equipped with a lighting
device capable of providing a minimum maintained one
footcandle of light at the base of the door.
b) Open parking lots shall be provided with a minimum
maintained one footcandle of light on parking surface
from dusk til dawn.
c) All exterior lights must be eqgtpped with vandal
resistant covers. Light shall,pot shine away from
)ubject property.
d} All walkways shall be equipped with a lighting device
capable of providing a minimum maintained one footcandle
of light between lights.

The following security weaknesses should be corrected in
order to satisfy the requirements of the Building Security
Ordinance, and the requirements of the Santa Ana Police
Department.

Special emphasis should be given to the rear exit door
opening to the alley. There are numberous locking devices
which must be removed for your own safety, should an
emergency exit be required. This door should be outfitted
with a single cylinder deadbolt locking device. Since
the hinges on this door are on the exterior, they should
be pinned to preclude liftiqg.
Because of the absence of any type of lighting in the
alley to the rear, the use of a Mercury Vapor or high ·
pressure sodium fixture should be considered for installation
at the corner of the building or directly above the rear
door.
C. Transportation
1) Remove and replace three sections of sidewalk as follows:
a) a five square feet section adjacent to the gas meters
near the east end of the property.
NOTE: This is currently a hazard.
b) A thirteen square feet section at the west corner of
the east driveway approach.
c) ~ thirty square feet section just east of the westerly
'drive approach.

1) Pay sewer connection fees if additional fixture units for
plumbing are involved.
