HomeMy WebLinkAbout2003-024 - Approving Tentative Parcel Map No. 2003-02RESOLUTION NO. 2003-024 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING TENTATIVE PARCEL MAP NO. 2003-02 FOR THE 8.75 ACRES OF PROPERTY LOCATED AT THE WESTERN TERMINUS OF GARRY AVENUE BETWEEN THE SANTA ANA RIVER AND SHANNON STREET bk:02/08/03 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: Tentative Parcel Map No. 2003-02 seeking to create an industrial condominium type development at 4042 West Garry Avenue came before the City Council of the City of Santa Ana for a public hearing on February 18, 2003. The Planning Commission of the City of Santa Ana held a duly noticed public hearing on February 10, 2003 on Tentative Parcel Map No. 2003-02 and voted 5:0:1:1 (Nalle abstaining and Verino absent) to recommend that the City Council approve Tentative Parcel Map No. 2003-02 as conditioned. The City Council of the City of Santa Ana determines that the following findings have been established: The proposed project, as conditioned, and its design and improvements are consistent with the Low Density Residential land use designation of the General Plan and are otherwise consistent with all other elements of the General Plan and any applicable specific plans. The proposed subdivision is consistent with the Industrial designation and will have no adverse affects on the surrounding industrial developments. ii. The proposed project, as conditioned, conforms to all applicable requirements of the zoning and subdivision codes, as well as other applicable City ordinances. The proposed subdivision conforms to the minimum development standards for the Heavy Industrial (M2) zoning Resolution No. 2003-024 Page 1 of 7 designation, as well as meeting the intent of the State of California Subdivision Map Act provisions. iii. The project site is physically suitable for the type and density of the proposed project. The project site exceeds the minimum required lot size for industrial development. There are no physical constraints on the site to preclude development. iv. The design and improvements of the proposed project will not cause substantial environmental damage or substantially and avoidable injure fish or wildlife or their habitat. The environmental assessment has determined that mitigation will reduce any impacts to the environment to levels of insignificance. There are no wetlands or unusual flora or fauna on or around the project site. Additionally, no developments surrounding this site will be negatively affected by this proposal. V= The design or improvements of the proposed project will not cause serious public health problems. The project proposed for this subdivision of land meets or exceeds City development standards. As conditioned, all future development is required to be in compliance with all applicable industrial zoning district requirements. vi. The design of improvements of the proposed project will not conflict with easements necessary for public access through or use of the property within the proposed project. There are no easements that would affect the use or development of this site. In accordance with the California Environmental Quality Act, the Council has previously adopted and certified Mitigated Negative Declaration and Mitigation Monitoring Program, Environmental Review No. 2002-242 for this project. The Request For Council Action and all matters presented to the Council are incorporated herein by this reference as though fully set forth. Resolution No. 2003-024 Page 2 of 7 Section 2. The City Council of the City of Santa Ana hereby, approves Tentative Parcel map No. 2003-02 as conditioned in Exhibit "A" attached hereto and incorporated herein. HEALY, Clerk of the Council, do hereby attest to and certify the attached Resolution No. 2003-024 to be the original resolution adopted by the City Council of the City of Santa Ana on February 18, 2003. ~ie~ the Council City of Santa Ana Resolution No. 2003-024 Page 3 of 7 Conditions for Approval for Tentative Parcel Map No. 2003-02- Conditions of AoDroval Tentative Parcel Map No. 2003-02 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the Califomia Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A. Planning Division Comply with Development Review Committee comments dated November 19, 2002 for Site Plan Review DP No. 02-47R. Project landscaping, including irrigation systems, shall be maintained as one common area under control of the Association for the integrated development. Should any one parcel become vacant, it would be the responsibility of the association to ensure maintenance of that parcel. The CC&R's shall be revised to reflect this condition. The project shall function as an integrated development. No fences will be permitted across drive aisles for the purpose of creating yard areas for individual parcels. All pot holes, raised paving and broken curbs within the boundaries of the map shall be repaired and parking areas slurry coated and restriped to City standards as part of a normal maintenance program. Conditions Covenants and Restrictions (CC&R's) must be approved by the City prior to final map approval. The CC&R's must address common area maintenance, drainage, architecture, parking, circulation, etc. and shall be recorded with the map. Resolution No. 2003-024 Page 4 of 7 FEBRUARY 18, 2003 PAGE 2 OF 4 All development within the area of the parcel map is subject to development and permit fees in effect at the time of permit issuance. All development within the area of the parcel map is subject to all design and development standards in effect at the time of building permit issuance. The certificate of compliance and new grant deed for each parcel shall be recorded within one year of lot line adjustment approval. Two copies of the recorded final parcel map shall be submitted each to the Planning Division, Fire Department, Building Division, and Public Works Agency within 10 days of recordation. 10. The tentative map, final map and all improvements required to be made or installed by the subdivider shall be in accordance with the design standards and specifications of the City of Santa Ana and at the requirements of the State Subdivision Map Act. 11. All utility service lines must be installed underground. 12. Electric power service must be separately metered for each dwelling unit. Mitiqation Measures All materials excavated or graded will be sufficiently watered to prevent excessive amount of dust. Watering with complete coverage shall occur at least twice daily, once in the late morning and once after work is done for the day. All clearing and earthwork activities shall cease during period of high winds (winds greater than 25 mph averaged over one hour) or during Stage 1 or Stage 2 smog episodes. Streets surrounding the project site should be cleaned at the end of each day of construction: EXHIBIT "A" Resolution No. 2003-024 Page 5 of 7 FEBRUARY 18, 2003 PAGE 3 OF 4 10. 11. All materials transported offsite shall either be sufficiently watered or securely covered to prevent excessive amounts of dust. The amount of area disturbed by clearing and earthwork activities shall be minimized at all times. To the extent feasible, equipment engines shall be maintained in good condition and in proper tune according to manufacturer's specifications. In the event unknown archeological resources are encountered, all earthwork activity in the area of the finding shall halt and the City of Santa Ana Environmental Coordinator shall be contacted for appropriate action. Prior to issuance of building permit, the applicant shall submit for review and approval a surface drainage/grading/erosion control plan prepared by a registered Civil Engineer, showing the direction and means of flow to the adjacent street. The plan is to include existing and proposed elevations at and adjacent to all property lines. Drainage routed to the street must be directed beneath the sidewalk and through the curb. Prior to issuance of a grading permits, the applicant shall provide proof of coverage under NPDES General Construction Activity Storm Water Permit, which includes a copy of the project permit number and two copies of the Storm Water Pollution Prevention Plan. Prior to issuance of a grading permit, the applicant shall prepare an NPDES post-construction storm water management plan per Orange County Drainage Area Management Plan (DAMP) that includes all structural and non-structural Best Management Practices for the project. Submit and have approved a surface drainage/utility plan that includes all Structural Best Management Practices. Provide two copies of the Water Quality Management plan that includes a description of all applicable Structural and Non- Structural Best Management Practices, which may apply to this project. Prior to the issuance of building permits, the project applicant shall submit to the City's Public Works Agency a final drainage study for review and approval showing existing and proposed facilities and methods of draining the site without exceeding the capacity of any street or adjacent storm drain facility. 13. Prior to issuance of building permits, the project applicant shall provide the City with the project's fair share contribution toward the future installation of a traffic signal at the intersection of Segerstrom Avenue/Croddy Way. 14. To mitigate the Harbor Boulevard/Segerstrom Avenue to an acceptable LOA for the a.m. peak hour, it is recommended that a protected left turn lane for east and west left turns be implemented with the westbound to southbound movement being a double left- turn lane. The mitigation measure should only be implemented as area wide improvement when actually needed. That is only after the assumed cumulative projects are completed and the actual traffic volumes approximate the projected year 2020 volumes. Fire Department 1. Depending upon interior separation wall construction or change of occupancy and use, two separate fire pumps may be required. EXHIBIT "A" Resolution No. 2003-024 Page 7 of 7
