HomeMy WebLinkAbout84-048REL:ar 4/6/84 RESOLUTION NO. 84-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 83-14 TO PERMIT SIX EXISTING DETACHED SINGLE-FAMILY DWELLINGS TO BE USED EXCLUSIVELY TO OPERATE AN ALCOHOLIC REHABILITATION CENTER AT 401-421 NORTH COOPER STREET IN THE R1 DISTRICT WHEREAS, this Council held a public hearing on April 2, 1984, on Variance Application No. 83-14, which application sought to allow six existing detached single- family dwellings to be used exclusively to operate an alcoholic rehabilitation center at variance with the use restrictions of the R1 (Single-family Residence) district and off-street parking requirements on property located at 401 through 421 North Cooper Street and shown on the map attached hereto as Exhibit A and incorporated herein by reference; and WHEREAS, prior to taking action on the said application, this Council reviewed the negative declaration (I.S. No. 83-151) prepared for the project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based on the evidence submitted at the above- said hearing the Council finds and determines as follows: (a) The strict application of the use re- strictions of the R1 district would deprive the subject property of privileges not otherwise at variance with the intent and purpose of said zoning requirements, since, due to the special circumstances of the location and surround- ings of the subject property, its use as an alcoholic re- habilitation center having a residential character and appearance will not adversely affect surrounding residential property. (b) The variance from the use restrictions of the RI district is necessary for the preservation and enjoyment of the right of the owners and occupants of the subject property to use the subject property in a manner RESOLUTION NO. 84-48 PAGE TWO compatable with the residential character of the neigh- borhood in which it is located. (c) Because the subject variance has been approved subject to periodic future review by the city, the use as an alcoholic rehabilitation center will be conducted in a manner compatable with a residential neighborhood, and therefore will not be materially detrimental to the public welfare or injurious to surrounding property. (d) Because of the residential character and appearance of the use as an alcoholic rehabilitation center, this variance will not adversely affect the residential designation of the area as set forth in the general plan, nor will it adversely affect any other provision of the general plan. (e) For the reasons set forth above, the negative declaration prepared for this project, with it finding that the project will not have a significant effect on the environment, is hereby approved. 2. Variance 83-14 is hereby approved to permit six existing detached single-famiLy dwellings located at 401 through 421 North Cooper Street to be used exclusively to operate an alcoholic rehabilitation center at variance with the use restrictions of the R1 district and off-street park- ing requirements, sub3ect to the following limitations, requirements, and conditions: (a) The use and development of the subject property shall be in accordance with plot, landscape, and mechanical appurtenance screening plans approved by the Director of Planning and Development Services, subject to minor modifications approved by the Director. Landscaping shall be continuously maintained in accordance with the approved landscaping plan. (b) Ail improvements on the subject property shall be maintained in compliance with all requirements of Chapters 8 and 14 of the Santa Ana Municipal Code. (c) Any trash area shall be enclosed in accordance with Planning and Development Services Department standards. RESOLUTION NO. 84-48 PAGE THREE (d) A six-foot high, six-inch wide masonry wall shall be constructed and maintained along the rear property lines at 401, 405, 409 and 421 North Cooper Street. (e) Six-foot high wood fencing shall be constructed and maintained along the side yard lot lines between 413, 417 and 421 North Cooper Street. (f) Ail garages except the garage at 417 North Cooper Street shall be restored and maintained for the purpose of providing enclosed parking for vehicles. (g) Ail improvements on the subject property shall be secured in accordance with the provisions of the Santa Ana Security ordinance (Santa Ana Municipal Code ~S 8- 200 et seq.) subject to such modifications as may be approved by the Chief of Police. (h) This Variance No. 83-14 shall be re- viewed by the Director of Planning and Development Services once each year to determine whether grounds for the initia- tion of revocation procedures exist. The owner and occupants of the subject property shall cooperate fully with the Direc- tor and his designated representatives undertaking such review. ADOPTED this 16th day of April , 1984. ATTEST: R.
