RESOLUTION NO. 84-55
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA APROVING MINOR EXCEPTION NO. 83-41
TO ALLOW THE SALE OF BEER AND WINE FOR OFF-SITE
CONSUMPTION ON PROPERTY LOCATED AT 2406 WEST
EDINGER AVENUE
WHEREAS, this Council held a public hearing on
May 7, 1984, on Minor Exception Application No. 83-41, to
allow the sale of beer and wine in an existing mini-market
located on property located at 2406 West Edinger Avenue in
the C5 District; and
WHEREAS, prior to taking action on the said applica-
tion, this Council has reviewed the negative declaration
prepared for the project;
NOW, THEREFORE~ BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Council finds and determines aS follows:
(a) The sale of beer and wine in package form for
off-site consumption is a service which is commonly provided
by neighborhood convenience markets and expected by their
customers. This minor exception is therefore desirable to
provide a service which will contribute to the general well-
being of the community by promoting shopping convenience.
(b) The provision of beer and wine for sale for off-
site consumption in the neighborhood convenience market will
not create any excessive concentration of establishments sell-
ing alcoholic beverages in the vicinity and will not adversely
impact the crime rate in the vicinity or otherwise create any
nuisance to nearby residents and businesses. Therefore, this
minor exception will not be detrimental to the health, safety
or general welfare of persons residing or working in the
vicinity.
(c) The sale of beer and wine for off-site consumption
at the proposed market pursuant to this minor exception will not
violate any regulations or conditions of the zoning chapter of
the municipal code nor adversely affect the general plan of the
city.

(d) For the reasons set forth in the Initial Study,
the negative declaration prepared for this project, with its
finding that the project will not have a significant effect on
the environment, is hereby approved.
2. Minor Exception No. 83-41 is approved to allow the
sale of beer and wine for off-site consumption at a neighbor-
hood convenience market on the subject property, subject to
the limitations, requirements, and conditions set forth in
Exhibit A, attached hereto and incorporated herein by refer-
ence.
