HomeMy WebLinkAbout84-066REL:adg 5/21/84 RESOLUTION NO. 84-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 22 WHEREAS, by order of the City Council on March 19, 1984, a public hearing was called for June 4, 1984 at the hour of 7:30 p.m., at the Council Chambers of the City Hall, 22 Civic Center Plaza, Santa Ana, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal Of poles, overhead wires and facilities for supplying electrical com- munication or similar or associated service, for the formation of the Underground Utility District No. 22 within that certain area of the City described as followed: A 200-foot strip of land bounded 100 feet on each side of the following described centerline: Beginning at the point of intersection of the centerline of Grand Avenue and Corporate Terrace, a private street; thence Southerly and Southwesterly to the centerline of Dyer Road: thence Westerly along the centerline of Dyer Road to the intersection of the centerline of Halladay Street (North); thence Northerly, from last said centerline, along the center- line of Halladay Street to the Westerly prolongation of the Northerly line of Assessor's Parcel No. 411- 063-28. Except therefrom Assessor's Parcel No. 411- 131-12. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana: RESOLUTION NO. 84- 66 PAGE TWO 1. That pursuant to Santa Ana Municipal Code Sections 37-1 to 37-13, the abovedescribed area is hereby declared an Underground Utility District, and is designated as Underground Utility District No. 22 of the City of Santa Ana. Attached hereto, marked "Exhibit A," and hereby incorporated as a part of this Resolution, is a map delineating the boundaries of said District. 2. That the City Council does hereby fix October 1, 1985 as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead structures and the underground instal- lation of wires and facilities for supplying electric, com- munication, or similar or associated service within Underground Utility District No. 22 on or before December 1, 1985. 3. That the Clerk of the Council is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 22 of the adoption. Such notification shall be made by mailing a copy of this Resolution, together with a copy of said Santa Ana Municipal Code Sections 37-1 to 37-13 to all affected property owners as such shown on the last equalized assessment roll and to the affected utilities. 4. That the City Council of the City of Santa Ana hereby finds and determines as follows, upon the basis of the evidence presented at said hearing; that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated overhead structures within said area of the City, and the underground installation of wires and facilities for RESOLUTION NO. 84-66 PAGE THREE supplying electric, communication, and similar or associated services, so as to eliminate hazards caused by fallen lines and poles and to improve visibility of pedestrian traffic to vehicle drivers.
