HomeMy WebLinkAbout84-12110/8/84 REL:adg RESOLUTION NO. 84-121 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING MINOR EXCEPTION NO. 84-17 TO ALLOW A SIX-FOOT HIGH WALL WITHIN THE FRONT YARD SETBACK ON PROPERTY LOCATED AT 1920 NORTH HELIOTROPE DRIVE IN THE R1 DISTRICT WHEREAS, this Council held a public hearing on October 1, 1984, on Minor Exception Application No. 84-17, to allow a six- foot high wall within the front yard setback on property located at 1920 North Heliotrope Drive in the R1 District; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Council finds and determines as follows: (a) The strict application of the wall height require- ment would deprive the property of privileges not otherwise at variance with the intent and purpose of the zoning regulations. The existence of similar fences in the vicinity and the extensive front yard setback on the property are special circumstances which make a six-foot wall on the property compatible with such intent and purpose. (b) The proposed wall will provide additional security for the property, which is a substantial property right. (c) As conditioned hereinbelow, the wall will be architecturally compatible with the surrounding neighborhood. (d) The proposed wall does not conflict with any goal, objective or other provision of the General Plan. RESOLUTION NO. 84- 121 PAGE TWO 2. Minor Exception No. 84-17 is approved to allow a six- foot high wall within the front yard setback of the subject property, subject to the following requirements and conditions: (a) The wall must be constructed in accordance with a plan approved by this Council, said plan to be submitted to the Director of Community Development and Housing Services for review and submitted to this Council within 45 days hereof. (b) The wall must be constructed predominantly of wrought iron, without pointed features at the top, and must have visibility corridors at regular intervals (c) The wall's driveway gate must be set back at least 22 feet from the sidewalk. (d) Ail required building and electrical permits must be secured, and construction must be in accordance therewith. ATTEST: ADOPTED this 15th __ day of 0ctober , 1984.
