RESOLUTION NO. 86-8
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA DENYING CONDITIONAL USE PERMIT
APPLICATION NO. 84-19 TO ALLOW THE SALE OF
ALCOHOLIC BEVERAGES IN A MINI-MARKET IN THE
C2 DISTRICT AT 2501 WEST SEVENTEENTH STREET
WHEREAS, the City Council held a public hearing on
January 20, 1986 on Conditional Use Permit 84-19 to allow the
sale of alcoholic beverages in a mini-market in the C2 District
on property located at 2501 West Seventeenth Street, which ap-
lication was brought before this Council by Appeal No. 533 fol-
lowing its denial by the Planning Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
(a) The proposed use will not enhance the indi-
vidual identity of this neighborhood or improve the quality of
life, public safety or general well being. There are presently
seven businesses licensed to sell alcoholic beverages within 500
feet of the subject property. Approval of the conditional use
permit request would result in an over-concentration of off-sale
establishments within the immediate area of the proposed use.
(b) The proposed use will be detrimental to the
health, safety and General welfare of persons residing or working
in the vicinity in that the basic needs for off-sale of all types
of alcoholic beverages are served by a variety of existing markets
located in this area. The introduction of additional off-sale
establishments will not contribute to the general welfare of
persons residing in the immediate surrounding area.
(c) The requested use of the subject property to
include additional retail sales and off-sale beer and wine will
increase the already intense use of the site. Addition of the
proposed use to the property in its present condition will have
an adverse impact on the site as well as the surrounding proper-
ties.
(d) The existing use of the service station is
nonconforming because parking and landscaping do not meet Code.

Conversion of the service station into a mini-market with off-
sale beer and wine will require additional on-site parking.
The site cannot accommodate the required parking and circulation
standards.
(e) The proposed use is consistent with the
General Plan designation of commercial for the subject parcel.
However, there are plan policies which speak to the appearance of
commercial properties along major arterials. The present condi-
tion of the site is not compatible with plan guidelines in this
area.
2. Conditional Use Permit Application No. 84-19 is
hereby denied.
