RESOLUTION NO. 86- 37
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA REVOKING VARIANCE 70-39 WHICH
PERMITTED AN AUTOMOBILE RENTAL SERVICE WITHIN
AN EXISTING SERVICE STATION AT 1215 NORTH
GRAND AVENUE IN THE R2 DISTRICT.
WHEREAS, Variance No. 70-39 was approved by the City
Council of the City of Santa Ana on January 18, 1971 to allow
an automobile rental service within an existing service
station at 1215 North Grand Avenue in the R2 District; and
WHEREAS, said Variance was approved subject to certain
conditions among which was the condition that not more than
15 automobiles be offered for rent on the site at any one
time; and
WHEREAS, on July 22, 1985, after public hearing, the
Planning Commission of the City of Santa Ana revoked said
Variance due to failure of the grantee to comply with the
aforesaid condition; and
WHEREAS, the decision of the Planning Commission was
appealed to the City Council; and
WHEREAS, after public hearing held on November 18, 1985,
the City Council, by its Resolution No. 85-142, adopted
December 3, 1985, determined that revocation of the said
Variance was not warranted at that time, provided there was
compliance in the future with the conditions of said variance
and provided further that the grantee comply with certain
additional conditions pertaining to the installation of a
block wall and landscaping, as more fully set forth in said
Resolution No. 85-142; and
WHEREAS, it has been represented to the City Council by
the Planning Manager that the grantee has not complied with
the condition of said Variance and the additional conditions
of Resolution No. 85-142 in the time elapsed since the City
Council's previous consideration of the matter; and

WHEREAS, the City Council, on May 5, 1986, again held a
public hearing on the appeal from the Planning Commission's
revocation of said Variance;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based on the evidence submitted at the public
hearings held on November 18, 1985 and on May 5, 1986, this
Council finds and determines as follows:
(a) There has been a regular and long-standing
violation of the condition of Variance No. 70-39 which
restricts the number of automobiles which may be rented
at the site.
(b) Said violation causes an unsafe and unsightly
cluttering of the site and nearby streets with parked
automobiles.
(c) There has been no compliance with the
additional conditions set forth in Resolution No.
85-142 of the City Council.
2. Variance No. 70-39 is hereby revoked.
