RESOLUTION NO. 86-~
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA APPROVING CONDITIONAL USE PERMIT NO.
86-5 TO ALLOW SALE OF BEER AND WINE IN A RETAIL
ESTABLISHMENT OF LESS THAN 3000 SQUARE FEET ON
PROPERTY LOCATED AT 4201 WEST FIRST STREET.
WHEREAS, this council held a public hearing on May 19,
1986 on Conditional Use Permit Application No. 86-5 to allow
sale of beer and wine in a retail establishment of less than
3000 square feet on property located at 4201 West First
Street, said application having come before this Council by
Appeal No. 540 following its denial by the Planning Commission;
and
WHEREAS, prior to taking action on the said application,
this Council reviewed and approved the negative declaration
prepared for the project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing, this Council finds and determines as follows:
(a) The proposed use will provide the community
with a business establishment providing a convenience to consumers.
(b) The use, as proposed, would not be detrimental
to the health, safety and general welfare of the persons
residing or working in the area. The intent of the owners is
to operate a store providing off-site consumption sales with
no on-site consumption occuring at this site.
(c) The site, as designed, is a beneficial influence
to the economic stability of the community.
(d) The project, as proposed, complies with the
zoning regulations and specifications for such use.
(e) The project, as proposed, will not adversely
affect the General Plan designation applicable to this site.

2. Conditional Use Permit No. 86-5 is hereby approved,
subject to the limitations, requirements and conditions set
forth in Exhibit A, attached hereto and incorporated herein
by reference.

Hours of operation shall not exceed 7:00 A.M. to
ll:O0 P.M. daily.
There shall be no signs advertising the sale of
beer and wine.
No more than 10% of the floor area shall be devoted
to the sale, display, and storage of alcoholic bev-
erages,
There shall be no delivery of alcoholic bever-
ages to drive-thru customers,
All business conducted on the premises shall be
licensed by the City of Santa Ana.
Provide a permanent trash enclosure per City stand-
ards.
Revise the parking and Circulation plan to provide
five (5) parking stalls.
Revise landscape area to provide a five (5) foot wide
landscape planter adjacent to the front property line.
B. PERMITS AND INSPECTIONS

energy. Federal flood zone protection.

Windows shall not be obstructed with displays
or advertisements which would prevent sur-
veillance by patrol officers outside the struc-
ture.
Merchandise displays shall be kept at a maxi-
mum of three feet (including merchandise) in
windows. All other display islands must be
kept at a maximum 5 foot height to insure ad-
equate visibility by clerks.
Interior lights shall be left on at night to
insure interior visibility by patrol officers.
The cash registers shall be located in a posi-
tion that affords them maximum visibility from
the building's exterior.

3. Pay Cost of Water Service and Fire Protection
Facilities.
NOTE: Developer is advised to contact Orange
County Sanitation District No. 2 for de-
tails of connection to their sewer main in
First Street.
FIRE
1.
The proposed market shall comply with all applicable
sections of the 1982 Uniform Fire Code, California
Administrative Code, and City of Santa Aha Municipal
Code which shall include but not be limited to:
a)
Accessible hydrant(s) shall be provided and lo-
cated within 150 feet of all portions of exter-
ior walls on the first floor in conformance with
City Standards Numbers 403 and 423, revised.

b)
Provide portable fire extinguishers. PFPA No.
10, UFC lO.301(a).
POLICE
Must comply with the provisions of Chapter 8, Article
II, Division 3 of the Santa Aha Municipal Code,
Building Security Ordinance. This applies to all new
construction.

Exterior doorways shall be equipped with a light-
ing device capable of providing a minimum main-
tained one footcandle of light at the base of the
door.
b)
All walkways and aisles shall be equipped with a
'lighting device capable of 'providing a minimum
maintained one footcandle of light at the base
of the door.
c)
All exterior lights must be equipped with vandal
resistant covers. Lights shall not shine away
from subject property.
d)
Open parking lots shall be provided with a min-
imum maintained one footcandle of light on park-
ing surface from dusk until dawn.
