HomeMy WebLinkAbout86-081 REL:jd(24) **** REPEALED BY RES. 87-60***** 6/23/86 RESOLUTION NO. 86-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING FEES FOR THE ADMINISTRATION OF THE HAZARDOUS MATERIALS RELEASE RESPONSE PLANS AND INVENTORY LAW WHEREAS, pursuant to Chapter 6.95 (commencing with Sec- tion 25500) of Division 20 of the Health and Safety Code of the State of California, businesses which handle hazardous materials must submit emergency response plans and annual inventories of hazardous materials to the local enforcing agency; and WHEREAS, under Section 18-2 of the Santa Ana Municipal Code, the City of Santa Ana assumes responsibility for the imple- mentation of said state law; and WHEREAS, pursuant to Section 25513 of said state law, the City Council is authorized to adopt a schedule of fees to be collected from those business which are required to submit plans in an amount sufficient to pay the costs incurred by the city in carrying out the provisions of said state law; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana as follows: 1. Business plans (a) Each submission of a business plan (as defined in Health and Safety Code Section 25501) and each certification provided pursuant to Health and Safety Code Section 25505(c) shall be accompanied by a fee based upon the "quantity range" of the subject business in accordance with the following schedule: Quantity Range Fee 1 $157.00 2 $193.00 3 $230.00 (b) "Quantity range" refers to the maximum quantity of all hazardous materials present on the business premises at any one time. The three quantity ranges are identified as follows: Unit of Measurement Quantity Range Gallons Cubic Feet Pounds 55-1,000 200-1,000 50-1,000 2 1,001-10,000 1,001-5,000 1,001-5,000 3 over 10,000 over 5,000 over 5,000 RESOLUTION NO. 86-81 Page two 2. Inventories Each submission of an annual inventory pursuant to Health and Safety Code Section 25508 shall be accompanied by a fee based on the total number of hazardous substances and waste cate- gories listed on the annual inventory in accordance with the follow- inG schedule: Number of Fee Materials Listed Prior to July 1, 1987 Fee Thereafter 1 - 2 $110 $100 3 - 6 $165 $150 7 or more $220 $200 3. Late Filin~ Penalty The Fire Chief shall impose a late filinG penalty based on additional administrative costs incurred due to the late filing of any business plan, certification, or inventory.
