HomeMy WebLinkAbout86-110REL: adg-6 11/21/86 RESOLUTION NO. 86- 110 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DENYING CONDITION~L USE PERMIT APPLICATION NO. 86-14 TO ALLOW THE SALE OF ALCOHOLIC BEVERAGES IN A MARKET IN THE C1 DISTRICT AT 218 SOUTH FLOWER STREET WHEREAS, the City Council held a public hearing on November 17, 1986 on Conditional Use Permit No. 86-14 to allow the sale of alcoholic beverages in a market in the C1 District on property located at 218 South Flower Street, which application was brought before this Council by Appeal No. 543 following its denial by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Council finds and determines as follows: (a) The proposed use addition of beer and wine sales to the existing market goods would provide a service that is presently being supplied by other nearby establishments. Also, with the near proximity of Santa Ana High School and the heavy crime rate in the area, the benefits to the community are outweighed by the inherent problems associated with off-premise beer and wine sales. (b) The City of Santa Ana Police Department has desig- nated this property as a congregational site for youths in the area. To compound these problems is the high crime rate. To approve this request would serve to further these problems and place an additional burden on the law enforcement activ- ities in the area. (c) Any action that will reduce the quality of life in this area would affect the economic stability of that area. The approval of this conditional use permit would inhibit future quality development in this neighborhood by adding to the existing problems. RESOLUTION NO. 86- 110 PAGE TWO (d) The C-1 Zone does allow for the proposed use. However, it is required that land uses be compatible. The addition of beer and wine sales for off-premise con- sumption and its associated law enforcement problems would not be compatible with the surrounding single-family neighborhood and nearby high school. (e) The proposed use would be in compliance with General Plan designation of Medium Urban Residential which permits .neighborhood oriented commercial businesses. the denied.
