HomeMy WebLinkAbout85-0443/6/85 RESOLUTION NO. 85- 44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING VARIANCE APPLICATION NO. 84-6 TO~ EXPAND A BOARD AND CARE FACILITY AT 1101-1219 NORTH JACKSON STREET WHEREAS, Variance No. 72-83 was approved on January 2, 1973 to allow ,a board and care facility for up to 84 develop, mentally disabled adults at 1101-1219 North Jackson Street in the City of Santa Ana; and WHEREAS, Variance Application No. 84-6 has been filed seeking to increase the number of residents which may be housed in said facility; and WHEREAS, this Council held a public hearing on March 4, 1985 on said Variance Application No. 84-6; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based on the evidence submitted at the abovesaid hear- ing, this Council finds and determines that the findings which justified Variance No. 72-83 continue to justify a variance for the subject facility with the maximum occupancy increased to 120 persons for the following reasons: (a) The special circumstances justifying the issuance of Variance No. 72-83 have not changed. (b) The need to preserve substantial property rights which justified Variance No. 72-83 has not changed. (c) The increase in occupancy of the subject facility as hereinafter limited will not be materially detrimental to the public welfare or injurious to surrounding property. (d) as hereinafter of the city. The increase in occupancy of the subject facility limited will not adversely affect the general plan RESOLUTION NO. 85-44 PAGE TWO 2. Variance 84-6 is approved to allow an expansion of the occupancy of the subject facility, ~ubject to'the following limitations, requirements and conditions: (a) The .number of residents shall not exceed 120 persons. (b) Parking areas shall be striped to accommodate 36 open parking spaces, and 19 enclosed garage spaces shalt be provided. (c) The owner and/or operator of the subject facility shall comply with all applicable state, county and city laws and regulations and shall submit complete floor plans for each build- ing to the Community Development and Housing Services Agency for determination of compliance with building and fire safety laws and regulations. (d) The owner/operator of the subject facility shall submit a landscaping plan to the Community Development and Hous- ing Services Agency. Landscaping shall be installed and con- tinuously maintained in accordance with such plan as approved by the said Agency. (e) The subject property shall be continuously main- tained in good, sanitary and attractive condition. (f) Signage shall be limited to the existing small sandblasted wood facility name sign. (g) Trash areas shall.be constructed in accordance with City standards at locations approved by the Community Development and Housing Services Agency. (h) The owner of the subject property shall file a parcel map combining the five lots into one parcel. (i) 'The owner/operator of the subject facility shall cooperate with City personnel undertaking the periodic review of this variance, as hereinbelow provided. 3. The Planning Division of the Community Development and Housing Services Agency shall review the subject facility annually to determine if there is compliance with the above stated conditions and if problems have arisen which necessitate RESOLUTION NO. 85- 44 PAGE THREE additional conditions. If problems have arisen, the Planning Commission may impose additional conditions reasonably necessary to avoid or mitigate such problems, after providing the owner/ operator of the subject premises an opportunity to be heard. 4. This Variance 84-6 supersedes Variance 72-83, which shall no longer be of any force and effect; provided however, that in the event that this Variance 84-6 is determined to be invalid in a court of law, Variance 72-83 shall have the same force and effect as would be the case if this Variance 84-6 had not been approved.
