HomeMy WebLinkAbout85-053REL: adg 314185 RESOLUTION NO. 85- 53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AGREEING TO A REDISTRIBUTION OF PROPERTY TAXES FOR REORGANIZATION NO. 77 SANTA ANA FREE- WAY BEING TRANSFERRED FROM THE CITY OF SANTA ANA TO THE CITY OF ORANGE WHEREAS, the cities of Orange and Santa Ana have both agreed to the filing of Reorganization No. 77 Santa Ana Freeway with the Local Agency Formation Commission; and WHEREAS, Reorganization No. 77 Santa Ana Freeway in- volves territory to be transferred from the City of Santa Ana to the City of Orange; and WHEREAS, Section 99(b) of the Revenue and Taxation Code requires jurisdictions involved in any jurisdictional change to agree to a property tax redistribution prior to the change be- coming complete; and WHEREAS, properties included within Said reorganization are occupied by freeway and railroad rights-of-way; and WHEREAS, the City of Santa Ana agrees that those property taxes which may currently be assigned to the City of Santa Ana for said reorganization area will be relocated to the City of Orange upon completion of this municipal reorganization. RESOLUTION NO. 85-53 PAGE TWO NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Santa Ana does hereby agree to the above-described property tax redistribution for Reorganization No. 77 Santa Ana Freeway. Griset Mayor COUNCILMEMBERS: Gr i se t Aye Ac os t a Aye Hart Aye Johnson Aye Luxembourger Y~ McGuigan Aye Young Aye APPROVED AS TO FORM: er 1 2 3 4 5 6 7 8 9 10 ' 11 12 - 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION OF.THE LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY, CALIFORNIA APRIl' 3, 1985 On motion of Commissioner Saltarellt, duly seconded and carried, the followlng resol uti on was adopted: WHEREAS, a resolution for theproposed reorganization designated Orange County Municipal Reorganization I~o. 77 (transfer of the terrtt.~ry from.the City of Santa Aha to the City of Orange)was heretofore filed by the city of'OPa*nge and accepted for filing on March 5, 1985, by the Executive Officer of the Local Agency'Fonna'tion Commission pursuant to Part 2 of Title 4, Division 2, commencing with Section 35000 et seq of the Government Code; and WHEREAS, the Executive Officer, pursuant to Government Code Section 35152 set April 3, 1985 as the hearing date of this proposal; and WHEREAS, the Executive Officer, pursuant to Government Code Section S4794 has reviewed this proposal and prepared a report including his recommendation thereon, and has furnished a copy of this report to each person entitled to a copy; and WHEREAS, said resolution was accompanied by P.~.Of satisfactory to the Co,mission that the single owner of land within the territory proposed to be reorganized has given his signed consent to such reorganization; and WHEREAS, this Commission on April 3, 1985 considered the proposal and report Of the Executive Officer, and considered the factors determined by the Commission to be relevant to this proposal, including but not limited to factors specified in Government Code Section 54796; and WHEREAS, the Executive Officer determined this transfer of territory project to be categorically exempt from the provisions and requirements of the California Environmental Quality Act. Orange DOES HEREBY RESOLVE, DETERMINE and ORDER as follows:_ Section 1. Subject to the terms and conditions hereinafter specified, said proposal is approved. Section 2. The boundaries of the territory proposed to be reorganized are specifically described in the legal description attached hereto andby this reference made a part hereof. The Orange City Council, as the conducting authority, is authorized to .reorganize said territory without notice and hearing and without an election, pursuant to Section 35151 of the Government Code. The City of Orange, as~appltcant, shall be lt'able for and paY the applicable State Board of Equalization filing ami processing fee prior to the issuance of the final statement of boundary change by the Executive Officer of the Local Agency Formation Coneission. The Executive Officer is hereby ordered and directed to mail certified copies of this resolution in the manner and as provided in Section 3515g of the Government Code. OONALD A. HOLT, DONALD O. TURNER Executive Officer of the Local Agency Formation Commission of Orange County, California Resolution No. 85-23 EXHIBIT "A" ORANGE COUNTY MUNICIPAL REORGANIZATION NO. 77 (Deannexation from the City of Santa Ana and Annexation no. 368 to the City of Orange) A portion of the territory annexed to the City of Santa Aha per Ordinance No. 874 by the City Council of the City of Santa Ana, County of Orange, State of California on April 29, 1929, described as follows: BEGINNING at any angle point in the existing boundary line of the City of Orange, as established by "Annexation No. 266" to said City of Orange, saSd.angle point being the most Easterly point of said "Annexation No. 266;" thence along sai~ existing boundary line, as annexed to said City of Orange, per said "Annexation No. 286," "Annexation No. 79," and "4th Annexation" through its various courses in a general Northwesterly, Easterly, and Southeasterly direction to the most Southerly point of said "4th Annexation" said point also being the most Westerly point of "Annexation No. 57" to said City of Orange; thence continuing along the Southwesterly boundary line of said "Annexation No. 57," South 40°52'33" East to a point on the Southeasterly bank of the Santa Ana River, thence leaving said existing boundary line, Southwesterly along said.SRutheasterly bank to the Point of Beginning.
