HomeMy WebLinkAbout85-068REL .' adg/a 5/28/85 RESOLUTION NO. 85- 68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY ~F SANTA ~NA APPRDVING (JONDITIONAL USE PERMIT NO. 85-12 TO ALLOW ~N 81-UNIT PRO3ECr LOCATED AT 1421 LA BONITA STREET IN THE R2-P~D DISTRICT ~MEI~AS, this Cot~cil held a public hearin~ on May 20, 1985 on Conditional Use Permit Application No. 85-12 to allow an 81-u~it procec~, on property located at 1421 La Bonita Street in the R2-P~D district, and shown on the map attached hereto as Exhibit A and incorporated herein by reference; and WHE1REAS, prior to taking action on the said applica- tion, this~2oumcil' reviewed and approved the negative declaration prepared for the project; NOW, THEI~FORE, BE IT I~SOLVED BY ~HE CITY COUNCIL OF THE CITY OF SANTA ANA AS FO~: 1. Based upon the evidence su~nitted at the abovesaid hearing, this Co~cil finds and determines as follows: (a) The approval of this conditional use permit will allow for develcpment of the subject property in a manner that will serve to enhance the property and benefit the neighborhood by providing a desirable residential envirorment. The 81 units will provide needed housing for a number of citizens in conformance with the city's General Plan and N~development Plan. (b) The project will not be detrimental to the health, safety, or general welfare of persons residin~ or working in the vicinity since the proposal will substantially upgrade the site and enhance the area. (c) The proposed residential development will be an econcmically beneficial addition to the cut.tLunity by substantially increasing the value of a primarily undeveloped site while enhancing the econcmic stability of adjacent properties. (d) N-=ceiving approval of this conditional use permit, subject to the conditions of approval, will meet the intent and purpose of the zoning code by providing a high quality residential condcminium project. RESOLUTION NO. 85~8 PA6E TW0 (e) The project, as proposed, is in conformance with the General Plan which designates the property for residential develop- ment up to 22 dwelling units per acre. Approval of the application will permit the development of an attractive housing project con- sistent with the goals of the Housing Element of the General Plan. No specific plans are applicable to the site. 2. Conditional Use Permit No. 85-12 is hereby approved, subject to the limitations, requirements and conditions set forth in Exhibit B, attached hereto and incorporated herein by reference. PLANNING That the site plan and elevations, including but not limited to, building footprint, open space, parking areas, perimeter and interior wa~ls, and materials shall not be altered except for minor modifications approved by the Planning Manager and shall be con- structed consistent with approved plans. Covenants, Conditions and Restrictions are required per TT 12386. CCR's shall include perpetual mainte- nance of all common open space, landscaping, perime- ter and interior walls, mutual ingress/egress and circulation at the entrances and along private street, and a parking management plan. Submit revised site plan to include the following: a) Provision of two trash areas within the boundaries of Phase I. b) Removal of open parking spaces designated as number 5 and 41. c) Location of the perimeter wall at the southeast corner of the site shall be at the project site property line. The drainage channel easement shall be covered and culverted according to City specification. d) The resident access kiosk at LaBonita entrance shall be. removed and incorporated with guest access to provide a clear 20 foot width emergency vehicle access. Due to the width of the private street, no parking shall be permitted on the street. Red curb and post signs at entrance points prohibiting parking on street. Se Submit landscape and automatic irrigation plan for approval of Planning Division. Said plan shall be reviewed and approved prior to issuance of building permits. ® Building permits shall not be issued until such time as AA 923 is effective and Tract Map 12386 is recorded· HIBIT B Perimeter wall at LaB0nita Street shall be redesigned to provide relief in street view. Additional land- scaping or landscape pockets in front of the wall shall be provided. Wall shall be of decorative block material with design relief. B. PERMITS AND INSPECTIONS Submit 3 copies of complete structural plans for plan check review, showing compliance to the Uniform Building, Plumbing, Mechanical and Fire Codes, the National Electric Code, the State Regulations for Sound and Energy, the Santa Aha Fire Flow and Security Ordinance, and the Federal Flood Zone Pro- tection. Co UTILITIES AGENCY 1. Standard Conditions a) Pay sewer connection fees. b) Pay O.C.S.D. No. 2 fees. c) Pay water main charges. d) Pay costs of water seruice, water meter, and fire protection facilities installations. 2. Other Conditions a) If public water and sewer systems are desired, the developer shall provide 28' minimum curb to curb width, vertically curbed, private streets in conformance with S,A.M.C. 34-165. b) Dedicate 28' minimum width exclusive underground, non-exclusive surface easements for public util- ity purposes to the City of Santa Aha.. c) Provide improvement plans as required by the Utilities Agency. d) Construct sewer facil'ities as required by the Utilities Agency. e) Relocate the existing sewer main at the southeast corner of the property into the private street as required by the Utilities Agency. f) Construct water facilities as required by the Utilities Agency. NOTE: Complete sewer system, water system with fire protection facilities, and looped private street must be installed in their entirety with Phase i building construc- tion. D. PUBLIC SERVICES AGENCY 1. File and record a tract map and comply with all ap- proved conditions thereon. 2. Prior to the issuance of building permits, complete the following: a) Submit the following items to the Public Services Agency: I) A runoff study based on a storm of a ten year frequency showing ~xisting and proposed fa- cilities and methods of draining this site and tributary areas without exceeding the capacity of any street, on-site or off-site. 2) An acceptable final grading plan or an on-site drainage plan for review and approval, showing the direction and means of flow to the adjacent street(s) or channel(s) when this property is developed. Plan is to include existing and proposed elevations at the property lines. Applicants should check with the Public Services Agency for the ex- tent of study needs. 3) Improvement plans as follows: (a) For any required drainage facilities as approved by the Public Services Agency. (b) For the private streets in conformance with Section 34-165 of the Santa Aha Municipal Code as approved by the Public Services Agency. (c) LaBonita Street and other off-site streets as required and necessary. 3. Prior to the 'release of utilities and/or other security complete the following: a) Construct required drainage facilities. b) Construct private street as approved. NOTE: The private access ornamental lighting photo-cells. way shall have actuated by c) Improve LaBonita Street as follows: d) e) 1) Construct entrance treatment as approved, consisting of changes proposed in present street configuration. 2) Remove portion of sidewalk adjacent to the curb and construct four foot wide sidewalk at the property line or meandering. Join side- walk northerly. 3) Construct ornamental street lights with un- derground power distribution. Contact City Lighting Consultant at 834-4929 for details. 4) Plant street trees' per City Standard 124. Contact Street Tree Superintendent at 834-4922 for locations and species. 5) Landscape area between curb and sidewalk with grass or ground cover. Pay drainags assessment fee. Pay Transportation System Improvement Fee per Section 8-44 of the City Code. FIRE The proposed townhouse development shall comply with applicable sections of the Uniform Building Code, the Uniform Fire Code, and the California Administrative Code, Titles 19 and 24, and shall include but not be limited to the following requirements: a) Entrance from LaBonita must be provided with 2~' clear width. b) Entrance gate openings must comply with the re- ' gulfed turning radius. c) Security gates shall be provided witE Knox access controls. d) Portable fire extinguishers shall be provided in accordance with N.F.P.A. ~10. e) Accessible fire hydrants must be located within 15g feet of all portions of the exterior walls of all buildings. Access roadways stalled and in construction· and fire hydrants shall be service prior to commencement of POLICE Must comply with the provisions of Chapter 8, Article Il, Division 3 of the Santa Ana Municipal Code, Building Security Ordinance. This applies to all new construction. 2. Upgraded Security Lighting a) Exterior doorways shall be equipped with a light- ing device capable of providing a minimum main- tained one footcandle of light at the base of the door. b) All walkways and aisles shall be equipped with a lighting device capable of providing a minimum maintained one footcandle of light between lights. c) Open parking lots shall be provided with a mini- mum maintai.ned one footcandle of light on parking surface from dusk until dawn. d) Ail exterior lights must be equipped with vandal resistant covers. Light shall not shine away from subject property. 3. Above Code Requirements a) A Knox box is required for the security gates and must be submastered to the Police and Fire De- partments.
