RESOLUTION NO. 85~3
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA APPROVING
VARIANCE NO. 84-9 TO ALLOW AN IMPOUND
YARD AT 1840 SOUTH STANDARD AVENUE IN
THE C2 DISTRICT FOR A PERIOD ENDING
JULY 1, I986
WHEREAS, this Council held a public hearing on June 3,
1985, on Variance Application No. 84-9, which application sought
to allow an automobile towing and impound yard business at 1840
South Standard Avenue in the C2 District;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based on the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
(a) A permanent variance on the subject site for
the proposed use is not appropriate because the subject site
is quite capable of supporting commercial development consist-
ent with C2 zoning regulations.
(b) A permanent variance is likewise inappropriate
because such use is detrimental to surrounding residential and
neighborhood oriented uses and would visually degrade the area.
(c) The proposed use is not consistent with the
General Plan designation of Low Density Residential for the
area in which the subject site is located.
(d) A temporary (one-year) variance for the use of
the subject site as an impound yard is appropriate because the
operator of the impound yard requires a reasonable amount of
time to find and secure an alternative site for his business.
2. Variance 84-9 is approved to allow an automobile
towing and impound yard business on the subject site, subject
to the limitations, requirements and conditions set forth in
Exhibit A, attached hereto and incorporated herein.

3. The variance herein granted shall expire on July 1,
1986 and be of no further force or effect thereafter.

PLANNING
A revised site plan shall be submitted for review and
approval. Said plan shall provide for the following:
a) Landscaping in accordance with Municipal Coda
standards including:
1) 2 - 15 gallon trees per each planter area.
2) 8 - 5 gallon shrubs per each planter area·
3) Sufficient ground cover per each planter
area·
b)
Removal of the existing chain link fencing which
surrounds street oriented planter areas. Chain
link fencing shall be replaced with either new
block which matches the existing wall or decora-
tive wrought iron fencing.
c)
Provide a triangular shaped landscape area at the
southeast of the site radius at a maximum width
of ten (1~) feet. Install a Dew block wall be-
hind the landscaped are~.
The siting of a trash enclosure to be constructed
to City Standards with a six (6) foot high block
wall end self-closing wood gate (shpw on revised
site plan).
e) The chain link gate along Standard ~venue shall
be replaced by a decorative wrought iron gate.
The rear gate off the alley shall be treated with
redwood slats.

within 12~ days of City Council approval.
Submit an irrigation plan ~howing that the required
improved landscaping will be adequately served by the
existing system.
The trash bin(s) shall be permanently stored in the
required trash enclosure except for trash pick-up
day.
Signage shall be submitted for review and approval by
the Community Development and Housing Agency. Only
one wall sign and one monument sign will be permitted
for the site.

Nours of operation shall be limited to 8:~ A.M. to
$:~0 P.M. So as not to adversely affect surrounding
residences.
7. The gate shall remain open during business hours to
provide customers access to parking.
8. The business shall be operated in conformance with
the City's Noise Ordinance.
9. Lights shall be oriented, shielded and located so as
to prevent adverse glare on adjoining properties.
Lighting shall be provided in accordance with City
standards.

Vehicles may be stored on the premises on a temporary
basis only. Each impounded vehicle shall be stored
for no longer than 50 days. No stacking of vehicles
or storage of boats, trailers, tractors or other
equipment which have not been impounded will be per-
mitted.
No repairing of vehicles or outdoor work of any type
shall be conducted on the premises.
Barbed wire along Standard Avenue and Occidental
Street shall b9 removed within 15 days of City Coun-
cil approval. Barbed wire along the alley shall be
permitted.

The proposed storage building and yard shall comply
with all applicable sections of the 1982 Uniform Fire
Code, California Administrative Code and City of
Santa Aha Municipal Code which shall include but not
be limited to:
a) The building shall be within 15~ feet of an ac-
cessible fire hydrant.
b) Portable fire extinguishers shall be provided in
conformance with NFPA %1~.
POLICE
Storage yard shall be equipped with lights which will
provide a minimum maintained one footcandle of light
on ~torage surface from dusk til ~awn.
2. Light shall be provided with vandal resistant cov-
ers.
