RESOLUTION NO. 85-74
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA APPROVING VARIANCE
APPLICATION NO. 85-3 TO PERMIT FOOD PROCESSING
AND WHOLESALING, TO WAIVE A PORTION OF THE
REQUIRED PARKING, TO PROVIDE A NON-INTEGRATED
PARKING DESIGN, AND TO REDUCE REQUIRED SIDE YARDS
ON PROPERTY LOCATED AT 838 EAST FIRST STREET
IN THE C2 AND P DISTRICTS
WHEREAS, this Council held a public hearing on May 20,
1985, on Variance Application No. 85-3, which application sought to
allow food processing and wholesaling, to waive a portion of the
required parking, to provide a non-integrated parking design, and to
reduce required side yards on property located at 838 East First
Street in the C2 and P districts, and shown on the map attached
hereto as Exhibit A and incorporated herein by reference; and
WHEREAS, prior to taking action on the said application,
this Council has reviewed the negative declaration prepared for
the project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Based on the evidence submitted at the abovesaid hear-
ing, this Council finds and determines as follows:
(a) Properties to the northeast and southeast of the
subject property are developed with a mixture of heavy and light
industrial uses. The strict application of the zoning ordinance
would deprive the subject property of the privilege of development
and use in a manner compatible with surrounding uses.
(b) Modification of parking and side yard requirements
is necessary to allow development of the subject property in the
manner proposed.
(c) The granting of this variance is necessary to
preserve the right of the owner of the subject property to use
such property in a manner compatible with surrounding uses.
(d) This variance is subject to conditions which will
protect nearby residential areas from potential adverse effects.
The attractive buildinG design will provide a visual upgrading
to the area. Therefore the granting of the variance will not be
detrimental to the public welfare or to surrounding property.

(e) The subject property is located in an area desig-
nated for use and development as a "Mixed Use Corridor" by the
General Plan. Such corridors are intended to provide important
neighborhood facilities and services as well as support facilities
and services for industrial districts. The proposed development
of the subject property will not adversely effect the General Plan.
(f) For the reasons set forth in the initial study pre-
pared for this project, this project will not have a significant
effect on the environment, and the negative declaration prepared
for this project is therefor approved.
2. Variance 85-3 is hereby approved to allow food
processing and wholesaling, to waive a portion of the required
parking design, and to reduce required side yards on property
located at 838 East First Street, subject to the following limi-
tation and requirements, set forth in Exhibit B, attached hereto
and incorporated herein.

PLANNING
That the loading zone be relocated to take access
from the Cedar Street building side. Said loading
area shall not be located within 100 feet from the
closest residential property line, or within 100
feet of the Walnut/Cedar Street intersection.
That loading/delivery activities do not occur before
the hour of 7:00 A.M. or later than 9:00 P.M. on
weekdays nor before the hour of 10:00 A.M. or later
than 6:00 P.M. on Saturdays and sundays.
That an additional 18 parking spaces be secured
through purchase or long-term irrevocable lease
agreement prior to issuance of building permits.
Said parking shall be located no further than 300
feet from the use. The applicant may choose to
reduce the size of the building to meet parking
code requirements.
That all landscaping and improvements be installed
prior to release of use and occupancy permits.
That the building be designed to incorporate 10 foot
setbacks where it is abutting residential uses.

That the proposed use or any future uses shall not
exceed 55db daytime noise levels and 50db nightime
noise levels, as measured from the nearest resi-
dential property line.

That the variance be reviewed for compliance to
conditions of approval every two years or more
frequen.tly if activated by any complaints received
by the community.

That a written report from a certified acoustical
engineer be sumitted for review of the Planning
Division. The report shall address building con-
struction, site design and building distance from
surrounding uses, as well as identify compliance
to City noise standards or propose acceptable
mitigation measures. This report is required prior
to acceptance of building plans for plan check.

PERMITS AND INSPECTIONS
1. Secure permits.
2. Demolish all buildings On PrOperty.
Submit complete engineered plans for plan check re-
view showing compliance to the Uniform Building,
Plumbing, Mechanical and Fire Codes; the National
Electric Code; the Santa Ana Fire Flow Ordinance; the
Santa Ana Security ordinance; and the State Regu-
lations for Sound and Energy. Three (3) copies of
plans are required.
UTILITIES AGENCY
1. Pay sewer connection fees.
2. Pay O.C.S.D. No. 1 fees.
3. Pay water main charges.

Pay cost of water service and fire protection facili-
ties installation.
PUBLIC SERVICES AGENCY
Dedicate the following easements to the City for
street purposes:
a)
Spandrel with a radius of twenty-seven (27) feet
at the corner of First and Cedar Streets.
b)
Spandrel with a radius of fifteen (15) feet at
the northwest corner of Walnut and Cedar Streets.
2. Submit street improvement plans to the Public Services
Agency for the required street improvements.
Submit a surface drainage plan to the Public Services
Agency for review and approval.
Construct street improvements on the following streets
as required:
a) First Street

Close existing drive approach with curb,
gutter and sidewalk as is necessary and
reconstruct drive approach per site plan
as required.

Remove the existing curb return and sidewalk
at the corner of Cedar Street, and recon-
struct the curb return with a thirty-five
(35) feet radius with the ECR at seventeen
(17) feet from the survey centerline
of Cedar Street. Construct a wheelchair
ramp per City Standard.
Cedar Street
1) Construct curb and gutter at seventeen (17)
feet from street survey centerline.
NOTE:
Total R/W on Cedar Street is 53.4''
curb to curb width will be 37.4' with
eight foot wide sidewalks each side
of the street. Refer to City plan
1-8-16 for east side of the street.

Walnut Street
Construct a curb return at the corner of
Cedar Street with a radius of twenty-five
(25) feet.
Construct a wheelchair ramp at the corner of
Cedar and Walnut Streets per City Standard.
Construct eight (8) foot wide sidewalk adja-
cent to the existing curb and landscape addi-
tional three feet of street easement to match
on-site landscaping.
Construct proposed drive approach per City
Standard without interfering with the exist-
inG street tree.

The proposed tortilla factory shall comply with all
applicable sections of the 1982 Uniform Fire Code,
the California Administrative Code and the City of
Santa Ana Municipal Code which shall include but not
be limited to:

Must comply with the provisions of Chapter 8, Article
II, Division 3 of the Santa Ana Municipal Code,
BuildinG Security Ordinance.
Upgraded Security Lighting Requirements:
a)
Exterior doorways shall be equipped with a lighting
device capable of providing a minimum maintained
one footcandle of light at the base of the door.
b)
All walkways and aisles shall be equipped with a
lighting device capable of providing a minimum
maintained one footcandle of light between lights.
c)
Open parking lots shall be provided with a mini-
mum maintained one footcandle of light on parking
surface from dusk until dawn.
d)
All exterior lights must be equipped with vandal
resistant covers. Light shall not shine away
from the subject property.
